CODE ENFORCEMENT BOARD MEETING
SEPTEMBER 25, 2007
CALL TO ORDER
Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order
at 7:00 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation
and Member M. Godek led the Pledge of Allegiance to the Flag. The roll was called and a
quorum was declared present.
PRESENT: Chairman Godek, Vice-Chair Chancey, Members Hopper, M. Godek, and
Stanley. Also present were Code Enforcement Supervisor Loeffler, Code
Enforcement Officer Siegrist, Code Enforcement Officer Rodriguez, Code
Enforcement Officer Delgado, Division Chief Stanley, Permitting Clerk
Everett, Attorney Sneed, and Deputy City Clerk Sibbitt.
ABSENT: Members Ballard and Lowery were absent excused.
GUESTS: None.
Permitting Clerk Everett administered the oath to Code Enforcement Officer Loeffler, Code
Enforcement Officer Siegrist, Code Enforcement Officer Rodriguez, Code Enforcement
Officer Delgado, Division Chief Stanley and anyone intending to speak regarding a case.

Observation: Shed without required permits, plans, approval and inspection.
Officer Delgado gave a brief history and stated this case was continued from last meeting to
allow for the owner to obtain permission from the HOA for the shed. She further stated they
heard from the respondent today and permits have not been submitted or issued.

Rishi and Valene Sagar, 1218 Stonewater Circle, stated he is inquiring if he could get an
extension to allow for approval from the HOA prior to submitting for a permit. He further
explained their subdivision has changed management companies and they just got a hold of
the new company 2 weeks ago and sent them a permit approval packet. Officer Delgado
stated to the board that one of the complainants she spoke with regarding the shed advised her
that the HOA prohibited sheds in that subdivision. Mrs. Sagar stated this is the first that she
has heard that the shed would not be allowed. Chairman Godek inquired as to how much
time would be needed to get the situation resolved with the shed. Mr. Sagar stated he has
filled out the proper paperwork and has submitted it to the HOA. Chairman Godek stated
the Code Board's concern is that they satisfy the violation, whether it is by getting a permit or
taking the shed down. Member Hopper suggested that Mr. Sagar talk to the HOA president
and if the HOA by-laws do not allow for a shed then he should take it down and notify the
City if removed.

Officer Rodriguez gave a brief history of the case and stated the property is in compliance
today. It came into compliance on June 1, 2007, when the new owners purchased the home.
Fine amount is $11,600.
Nelson Silva, property owner, stated they purchased the house on May 31, 2007, through
Orange County Courthouse foreclosure. He stated that usually a title takes about 2-3 weeks to
get and the judge and lawyers handling the foreclosure process neglected to include the lien
that the City had recorded in their disclosure form so he was not aware of the lien on the
home. Attorney Sneed stated the lien was recorded with Orange County on December 7,
2006. Member Hopper inquired if Mr. Silva had done a title search since liens do appear
during title searches. Mr. Silva stated a title search was done after the property was
purchased. Member Hopper further stated this is a usual story with the Code Board;
howt?ver, investors know when they purchase property in foreclosure that there are many
problems associated with it. He stated it is unfortunate that he was not disclosed the
information on the lien prior to purchase, but that is not the fault of the City. His issue should
be with the attorney and not the City. Vice Chair Chancey stated he agrees with Mr. Hopper
but it is the City's benefit that someone has purchased the home and corrected the situation.
Member Stanley inquired if there were other liens and did they pay the other liens.
Chairman Godek inquired as to what was the amount he would like the fine reduced too.
Mr. Silva stated that is why he is before the board. Member Stanley inquired as to how
much time/money the City had put into this case. Officer Loeffler stated it is minimal
(paperwork and digital pictures).

to the City Commission to reduce fine to $1000 that be vaid within 30 davs of Citv
Commission avproval or it will revert to the original fine. Motion carried 4-1 with Member

Officer Siegrist stated the Code Enforcement action started March 14th and property was in
compliance on August 8th.
Paul Robertson, representative for the respondent, stated once he was notified about needing
a permit, they submitted drawings to the City. He further stated the superintendent in charge
was waiting for the City to contact him on whether the drawings were approved. The City had
comments and faxed them to their office, however no one in their office recalls seeing a fax.
When they received a certified letter from Code Enforcement it got their attention and they
came to the City to try to fix the problem with the drawings. Member M. Godek stated if
they are in the construction business they should be aware of the permitting process. Member
Hopper inquired if they built the structure. Member Stanley stated this seems to be a lack of
following through.

Jeff Currey, representative for respondent, stated his store was found in violation of fire
extinguisher and they did comply on 08-02-07, but were not aware that they had to call for a
re-inspection. Vice Chair Chancey stated he would reduce the fee to $400 for the two days

after the compliance date. Member Hopper stated he believes it was mentioned at another
meeting that an employee from their store borrowed a fire extinguisher from another store in
the mall. Mr. Currey briefly explained his situation with the extinguisher and stated he had
picked up an extinguisher that was not tagged.

Officer Rodriguez gave a brief history of the case. Officer Loeffler stated he received many
e-mails through e-better place regarding this property. He further stated after much research
they found that the respondents do not reside at the address.
Charles Durrance, owner of the property, stated he did not receive notices but his grandson
did and he did not forward them to him. He stated he does not agree with some of the
statements. They purchased the property on August 30th and have not owned the property for
6 months as was indicated to the City. Kurtis Hensen, resident at the property, stated the
grass had been cut the whole time he lived there. Officer Loeffler stated the front yard was
always mowed it was the backyard and the bobcats that were not in compliance. He further
stated once they got in contact with the grandparents the yard was brought into compliance
and has remained that way.
