DISCUSSION: On October 31, 2007, the Planning Division received a site plan for Oaks Commerce Center, which proposes the construction of a commercial retail center totaling 15,000 square feet in area. This development is anticipated to generate approximately $140,000 in road impact fees for the City. Oaks Commerce Center is located on Lot 1 of the Goodman Centre Subdivision, which is located on the west side of Clarke Road, approximately 500-feet north of the intersection of Clarke Road and SR 50. This subdivision consists of 5 commercial lots, and is approximately 30.48 acres in size. The site plan that was submitted details the construction of a right-in only entrance leading into the site from Clarke Road. It was conveyed to the applicant during the review process that the Conditions of Approval (COA's) for Goodman Centre give the developer the option of constructing the right-in entrance for temporary use only, but stipulates that at such time that the property to the south develops and cross-access is provided between the two properties, the temporary right-in only entrance must be removed. The COA's require the construction of a continuous right turn lane on Clarke Road, connecting with the existing right turn lane leading into Goodman Center and the right turn lane at SR 50. The developer of the project stated the actual required deceleration lane is one-half the length of the full right turn lane that is required. The developer provided estimates on the cost of the full right turn lane totaling $70,000. The developer is asking the City to cover approximately one-half the cost of the construction of the right-turn lane, or $35,000. Staff believes there could be an argument that the additional turn lane benefits the general transportation system of the City, and that it would expedite this improvement. STAFF RECOMMENDATION: Staff respectfully recommends that the Mayor and City Commissioners authorize a $35,000 road impact fee credit for the developer of the Oaks Commerce Center to facilitate construction of the continuous right turn lane along Clarke Road. The developer intends to install a right-in only turn entrance at the southern end of lot 1. A minimum length deceleration lane is required in conjunction with this entrance. The developer is willing to install a full right hand turn lane from the intersection of Matthew Paris Blvd and Clark Rd to the existing turn lane on Clark Road at SR 50. We have estimated the cost differential to be $35,000.00. We herein request impact fee credits of $35,000 to offset the increased construction cost.
