Wheeler 407 -905-3100, ext. 1505 Reviewed By: Department Director: City Manager: Subject: Award of Construction Contract to Southern Site Works, Inc. for Construction of Turn Lanes on West Road and Piggyback Contract with Orange County West Road Realignment Contract Background Summary: The West Road Realignment Proj~ct (also known as Clarcona-Ocoee Road from Ocoee-Apopka Road (CR 437) to SR 429 County Project No. CIP 3038 West) is being undertaken by Orange County and is under construction at this time. The project consists of the realigning of West Road from SR 429 to Ocoee-Apopka Road, forming a "plus" intersection with Ocoee Crown Point Parkway, constructing a four lane urban road section, widening portions of Ocoee-Apopka Road for improved left turning movements, and providing drainage improvements for the road project. The Turn Lanes on West Road Project consists of constructing two right turn lanes and one left lane from West Road into the Fountains West commercial development within the road right-of-way. The turn lanes were a requirement of the City because of the magnitude of the commercial development and the associated traffic impacts on the road. The developer should have paid Orange County to include the turn lanes into its project. However, through a developer agreement amendment, Ocoe, LLC - Halverson, Inc., agreed to pay the City of Ocoee and let the City negotiate with Orange County for the turn lanes. The developer, Ocoe, LLC - Halverson, Inc. has paid the City of Ocoee $200,000 for the construction of the turn lanes. The City staff has been working closely with Orange County with regards to the realignment construction and was able to roll the turn lanes into the project, but waited until after Orange County awarded their project. The City contracted with the same consultant that Orange County employed to perform the design of the turn lanes and the meshing of the turn lanes into the current construction project. The consultant, Inwood Consluting Engineers, Inc., completed the design and obtained approval from Orange County for the addition of the turn lanes prior to the break for the Christmas holidays. Using the contractor's bid, Inwood was able to provide the additional material quantities and estimated cost based upon the bid prices in the County's contract. The cost for the turn lanes was estimated at $134,356.00 using the bid prices. In essence Ocoee is "piggybacking" on the Orange County contract for the West Road Realignment Project to construct the turn lanes as part of that same project. Orange County allowed the City to negotiate directly with the County's contractor, Southern Site Works, Inc. Southern Site Works, Inc. accepted the cost for the turn lanes but has requested an additional $3,046.00 for bonds and insurance as it would relate to a separate project and not a change order to an existing project. As a reference had the work been change ordered into the County's project, the contractor would be including additional bond costs, too. Therefore the total project cost is $137,402.00. Southern Site Works, Inc. is not looking for any increase in contract time as it relates to the turn lanes, they are projecting that they will be completed according to their end date per their contract with Orange County at July 10, 2008. Issue: Whether the City of Ocoee should piggyback on the Orange County Contract to construct the West Road Realignment Project and authorize Southern Site Works, Inc. to build turn lanes within the Orange County project. Recommendations Staff recommends that the City Commission authorize the Mayor and City Clerk to execute a contract with Southern Site Works, Inc. in the amount of $137,402.00 for the Turn Lanes on West Road Project in accordance with the following steps: . Authorize the Engineering and Public Utilities Departments to execute the Notices of Intent To Award and secure executed contract documents, bonds and insurance from the contractor. . Authorize the Mayor and City Clerk to execute the contracts with Southern Site Works, Inc. at such time as the contract documents are reviewed for compliance by staff and legal counsel, as needed. The plans were submitted and accepted by Orange County. The contractor, Southern Site Works, is currently constructing the West Road Extension per the original design plans. The plans revisions have been completed prior to completion of a substantial portion of the construction of the original design allowing the revisions to be incorporated without significant reconstruction or delay. In order to realize the full potential cost savings of incorporating the new turn lanes into the construction . of the original design, it is recommended that the City of Ocoee select Southern Site Works to accomplish the construction. mwood has prepared a cost estimate using the bid unit prices for the original project and the difference in quantities between the original design and the revised design. The cost estimate separates premium costs to the City of Ocoee and a potential cost savings to Orange County. Thank you for the opportunity to work with you and your staff.
