ORDINANCE No. 91-01 AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, AMENDING ARTICLE III OF CHAPTER 10, OF THE OCOEE CITY CODE RELATING TO SPRINKLER, STANDPIPE AND FIRE PROTECTION SYSTEMS BY THE ADOPTION OF A NEW SECTION 10-47 REQUIRING A SECURED KEY ACCESS SYSTEM; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, many commercial and industrial buildings have fire alarm or fire suppression systems and are locked, for security, during unoccupied hours; and WHEREAS, the installation of a master key operated rapid entry key safe will provide immediate damage free access to such buildings for emergency action in response to a fire alarm; and WHEREAS, the City Commission has determined the installation of rapid entry key safes are such a significant safety feature that this Ordinance shall effect the following: 1. Future buildings which have fire alarm or fire suppression systems; 2. Existing buildings which have fire alarm or fire suppression systems; and 3. Existing buildings which have fire alarm or fire suppression systems which undergo remodeling or renovations by permit or changes in owner or occupancy. NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, THAT: SECTION ONE. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. SECTION TWO. A new Section 10-47 of Article III of Chapter 10 of the Code of Ordinances of the City of Ocoee, Florida, is hereby adopted as follows: Section 10-47. Secured Key Access System Required. ~. Rapid entry key safe or vault with a single lock and alarm tamper switch(es) which is monitored by a central station alarm company twenty-four hours per day shall be installed in the following structures: 1. All new commercial and/or manufacturing buildings with 4,000 square feet or more gross floor area which are issued building permits after February 1, 1991; 2 . All existing commercial and/or manufacturing buildings which have a fire alarm system or other fire protection systems which are issued building permits for remodeling or renovations after February 1, 1991; and 3 . All existing commercial and/or manufacturing buildings which have fire alarm systems or other fire protection systems for which a new occupational license, other than a renewal license, is required to be obtained by the owner and/or any occupant thereof. B. The ordering, payment and installation of the rapid entry key safe or vault will be the responsibility of the owner. The device and its installation must meet the prior approval of the Chief of the Ocoee Fire Department. All keys, material safety data sheets and floor plans that are deemed necessary by . . . . the Ocoee Fire Department to achieve safety and effectiveness during fire and rescue operations shall be supplied to the Ocoee Fire Department. SECTION THREE. If any section, phrase, sentence, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. SECTION FOUR.
