AN ORDINANCE OF THE CITY OF OCOEEr FLORIDA r RELATING TO WATER AND SEWERS; AMENDING THE PRESENT CHAPTER 22 OF THE CODE OF ORDINANCES; AMENDING SECTION 22-35 TO PROVIDE AN ALTERNATIVE METHOD FOR THE CALCULATION OF WATER CAPITAL CHARGES; AMENDING SECTION 22-65 PROVIDING FOR AN ALTERNATIVE METHOD FOR THE CALCULATION OF SEWER CAPITAL CHARGES; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEEr FLORIDAr AS FOLLOWS: Section 1. The City Commission of the City of Ocoee has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapter 166, Florida Statutes. Section 2. The present Section 22-35 Ordinances of the City of Ocoee is hereby a new subsection (f) as follows: of the Code of amended by adding Sec. 22-35. Water Capital Charges. (a) The intent of this section is to establish charges for the purpose of compensating the City for costs incurred in providing water treatment facilities and in extending water lines to a point of reasonable availability for connection to the City Water System. The charges shall be computed on the basis of real property use, zoning and size in approximate proportion to the benefits received. (b) A water capital charge is hereby established at $966.00 per equivalent residential unit (ERU). Those persons, corporations, or entities which have previously prepaid the existing water connection fee or who have entered into an agreement with the City providing credits against the water connection fee shall be exempt from paying this water capital charge. (c) For the purpose of calculating and imposing the water capital charge the ERU factor for a connection shall be as follows: Food Service: Restaurant/cafeteria Restaurant (24 hours) Restaurant ("fast food") Bar/cocktail lounge UNIT Factor Per Dwelling Unit 1.000 Seat 0.017 Opr. (Add for food service and add for retail space if applicable.) Meeting and/or Banquet Rooms (Total sq.ft/15 sq.ft./person x .017X # of seats) . One ERU is hereby established and determined to be equal to a f low of 300 gallons per day (GPD), Average Annual Basis. The water captial fee shall be determined by multiplying the ERU factor listed in subsection (c) above times $966.00, times the number of units. For all establishments not listed in subsection (c) above, the water capital charge shall be determined by multiplying the number of fixture units, as published in the Standard Plumbing Code, by 25, times $966.00, and dividing that numerator by 300 GPD/ERU. . (e) The water capital charge issuance of the building permit the Ocoee Code of Ordinances. shall be paid prior pursuant to Section to 5-42 the of (f) If an applicant for a water connection wi thin any of the categories set forth in subsection (c) above can demonstrate to the satisfaction of the City Engineer that actual unit usage will be less than the equivalent residential unit usage assigned to such establishment as set forth in subsection (c) above, then the City Engineer may determine based on actual usage, anticipated usage, peak load requirements, or any combination of the foregoing using accepted engineering standards, a different or lesser total equivalent residential unit value. If the City Engineer determines that the actual water usage will be greater than the equivalent residential unit usage assigned to such category as set forth in subsection (c) above, then the City Engineer may determine, based on actual usage, anticipated usage, peak load requirements, or any combination of the foregoing using accepted engineering standards, a different or greater total equivalent residential unit value. An applicant may pay the water capital charge set forth in subsection (c) above and submit one year's data on actual usage to the City Engineer for review and determination of a different or lesser total equi valent residential unit value. If the City Engineer determines that the actual water usage is less than the equivalent residential unit usage assigned to such category as set forth in subsection (c) above, then the City shall return a pro rata portion of the water capital charge to the applicant. If the Ci ty Engineer determines that the actual water usage is greater than the equivalent residential unit usage assigned to such category as set forth in subsection (c) above, then the applicant shall pay an additional pro rata share to the City in addition to the water capital charge previously paid. Section 3. The present Section 22-65 of the Code of Ordinances of the City of Ocoee is hereby amended by adding subsection (f) as follows: Sec. 22-65. Sewer Capital Charges . (a) The intent of this section is to establish fees for the purpose of compensating the City for costs incurred in providing sewage treatment facilities, effluent disposal facilities and pumping stations and extending water lines to a point of reasonable availability for connection to the City Sewer System. The charges shall be computed on the basis of real property use, zoning and size in approximate proportion to the benefits received. (b) A sewer capital charge is hereby established at $2865.00 per equivalent residential unit (ERU). Those persons, corporations or entities which have previously prepaid the existing sewer capacity charges or who prepaid sewer capacity charges to Prima vista Utility Company, Inc. Section 4. Severability. If any Section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective Date. This Ordinance shall become effective immediately upon passage and adoption.
