MINUTES OF THE CITY OF OCOEE
CODE ENFORCEMENT BOARD MEETING
NOVEMBER 27, 2007
CALL TO ORDER
Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order
at 7:00 p.m. in the Commission Chambers at City Hall. Member Hopper led the Invocation
and Member M. Godek led the Pledge of Allegiance to the Flag. The roll was called and a
quorum was declared present.
PRESENT: Chairman Godek, Vice Chair Chancey, Members Ballard, Hopper, M. Godek,
and Lowery. Also present were Code Enforcement Supervisor Loeffler, Code
Enforcement Officer Siegrist, Code Enforcement Officer Delgado, Code
Enforcement Officer Rodriguez, Permitting Clerk Everett, Attorney V ouis, and
Deputy City Clerk Sibbitt.
ABSENT: Member Stanley was absent excused.
GUESTS: None.
Permitting Clerk Everett administered the oath to Code Enforcement Officer Loeffler, Code
Enforcement Officer Siegrist, Code Enforcement Officer Delgado, Code Enforcement Officer
Rodriguez, and anyone intending to speak regarding a case.

Officer Delgado gave a detailed history of the case and provided exhibits. The property was
re-inspected and as of November 27, 2007, the property was in non-compliance.
Bernadette McCoy and Natasha McCoy (daughter), respondents for the property, stated
the cars belong to the tenants and she did notify them when she received a letter from the City
warning them of the violations. On October 31, 2007, she went to see the tenants and no cars
were present at the location. She stated she received another letter several days later stating
that on November 2, 2007, the cars were still there. She contacted Mr. Munez about the
vehicles and he stated he had removed them from the property; however, she did not go by the
house after November 2nd to verify. Ms. McCoy further stated she spoke with the tenant
again and Mr. Munez informed her he would be present for this meeting but unfortunately he
has failed to show. Member Hopper stated it is obvious that even though he moved the
vehicles they were returned back to the property. Officer Delgado stated there is only one
vehicle on the property and she also advised the tenant today that it would be beneficial for
them to attend tonight's meeting. Ms. McCoy stated she will go by the home and try to work
things out with Mr. Munez. Vice Chair Chancey reminded the respondent that once the car
is removed they need to make sure to call for a re-inspection or the City will assume it is not
in compliance. Member Hopper informed the owners to try to stay on top of the tenants.

the respondent in violation as cited as of October 31, 2007. and be f!iven until December 7,

damaged, and rotted. The interior walls damaged, exposed to the elements. A noxious odor coming from the
inside of the mobile home; unduly annoys the surrounding community. On the lot: misc. trash and debris, a half
tom down fence, and overgrown weeds and grass.
Jackie Harper and Russell Harper, representatives for the respondents, stated for Case No.
05-024 they are requesting for a reduction because they are praying for mercy and they did
hire someone to remove the mobile home. Member M .Godek inquired as to who removed
the mobile home. Mr. Harper stated it was removed by a licensed company. Member
Ballard inquired when the mobile home was removed and Mr. Harper stated he could not
recall. Mr. Harper stated they had family problems which is why it took awhile for them to
come into compliance. Member M. Godek inquired as to why they waited over two years
before coming before the board to get a reduction of fine. He further inquired if it was
because they were hoping to sell the property in the near future. Both Harpers' agreed that
they are hoping to eventually sell the property in the near future. Vice Chair Chancey
inquired from Officer Loeffler if they came into compliance because they removed the trailer.
Officer Loeffler stated the trailer was on the lot for a while boarded up with a "No
Trespassing" sign before it was removed. Member Lowery tried to get clarification on why
they were coming before the board two years after the fact. Member Hopper inquired if the
property was in compliance in 2005. Officer Loeffler stated it was in compliance in July of
2005. The fine was $250/a day. Mr. Harper stated his grandfather owns the property but he
takes care of the property for him. He explained his grandfather and uncle are going into
litigation over the properties of his deceased great grandfather. Member Hopper stated even
if the board decides on something they will have to go before the City Commission. Vice
Chair Chancey inquired if there were any other active violations in the City by the
respondent. Officer Loeffler stated as for active occurring fines he is not sure about this
particular ownership. Member M. Godek inquired if they owned any other property in the
City of Ocoee. Mr. Harper stated they do own other properties within the City limit.

Mr. Harper stated the property is in compliance and he has it mowed every month.
Chairman Godek stated the concern is between June 2006 and August 2006 when the fine
was imposed. Mr. Harper stated he had to find a reliable person to mow the grass and he
found someone. Member M. Godek stated this was a repeat violation and it was not the first
time the lawn was not mowed. Officer Rodriguez stated the property has currently been
mowed consistently. Member Ballard inquired since this is a repeat violator when did the
first violation occur. Officer Rodriguez stated it was in the same year within just a couple of
months apart.

the fine from $1300 to $1000 and to be paid within 7 davs of Commission approval or it will

Ms. Harper stated she is requesting the mercy of the board and their testimony is the same.
Member Lowery inquired how many other properties they owned within the City limits. Ms.
Harper stated they own about 13-14 properties. Mr. Lowery further stated what gets to him
is that he is looking at properties that are repeat violators. He inquired as to why the other
properties were being maintained and these were not. Mr. Harper stated a lot of the other
properties have renters that maintain the property for them. Mr. Harper further stated he had
not received any violation letters on this property since they were being sent to his
grandfather. Had he been receiving the letters he would have fixed the violations.

Officer Siegrist gave a brief history of the case and provided exhibits. He further stated

Myrna Rogers, respondent in violation, stated she is working with an architect on this and
they were told by the architect that they would have drawings ready but they have not received
anything yet. Member Lowery inquired if the architect has given them any paperwork. Ms.
Rogers stated her husband had been taking care of this but he is with his father at Hospice.
Chairman Godek stated they have two options: 1) they can extend a compliance order or 2)
they can impose fine. Vice Chair Chancey inquired what the turn around time is for a
permit. Officer Siegrist stated he cannot give anything official but it could be 3-4 weeks.
Member M. Godek stated they have given two extensions already and he feels they should
impose fine. Vice Chair Chancey stated if they do not extend it they would have to impose
the fine starting from today. Ms. Roger stated she would like to try to obtain a permit since

they have paid the architect.

Member M. Godek inquired if they are requesting for abatement. Officer Rodriguez stated
the pool is secure. Officer Loeffler stated if they want they can abate the property for the
green water so there is not a mosquito problem. Member Hopper stated the only problem he
sees with abating the pool is that if they do it for this property they will have to do it for
others. Chairman Godek inquired if they have heard from anyone. Officer Rodriguez
stated she has only heard from the neighbors who told her the property was in foreclosure.
Member Hopper inquired if they could pump the pool out if it gets really bad. Member
Lowery stated one problem with draining out the pool is that you do not know how secure the

structure is underneath and draining it out could cause damage.

Member Ballard, Lowery, and M. Godek wished everyone a Happy Holiday and thanked
staff for doing such a good job.
Member Hopper stated he will be resigning as of tonight since he will be moving to an
outparcel in the County and not within the City limits. He further stated he enjoyed working
with everyone and wanted to thank the Commission and Mayor for always considering him for
re-appointment. He further stated he will always be a citizen of Ocoee.
Chairman Godek thanked Member Hopper for his years of service and insights. He further
stated that Mr. Hopper will be missed. Chairman Godek announced since the board would
need a new member he would like to recommend that Alternate Member Sais be moved up to
Regular Member. He also wished everyone a Merry Christmas and Happy New Year.
