Subject: Change Order NO.2 with Tony's Construction Co. for Central Park Phase II Improvements.
Background Summary:
The construction underway at Central Park will significantly improve the spectator and player experience
and reduce maintenance costs through improved stormwater management. Spectator safety is being
enhanced by new retaining walls, level bleacher areas, new aluminum bleacher structures, ADA-
compliant access paths, and new guardrails and handrails. The player experience is being improved
through new dugouts, backstops, facility interconnections via new sidewalks, and field fencing.
In keeping with these objectives, six small additions to the work are proposed to complete Phase II. That
additional work includes:
1. Installing a curb along the downhill side of a new concrete driveway to control erosion.
2. Installing a concrete ramp from a new elevated sidewalk to the football field.
3. Relocating the upper flight of a long stairway away from a perpendicular sidewalk so as to improve
pedestrian safety and to construct a small retaining wall to control erosion adjacent to the
stairway.
4. Replacing a narrow sidewalk with one conforming to the City's 6-foot width standard for two-way
travel within parks.
5. Removing a large oak tree that is too close to a retaining wall and spectator area.
6. Raising a yard drain within a pedestrian-accessible grass area so as to remove a fall hazard.
Issue:
The Engineering Department has proposed changes to the Central Park Phase II improvement project
and requests that the City Commission approve Change Order No. 2 for this project with Tony's
Construction Co.
Recommendations
The Engineering Department recommends that the City Commission approve Change Order No. 2 for
the additional work and increase the Central Park Phase II construction contract by $8,000.00, with no
adjustment to contract time, and authorize the Mayor and City Clerk to execute the change order. To
fund the change, staff recommends that the City Commission approve the allocation of $8,000 from
capital budget funds previously authorized for this project.

CHANGES ORDERED:
I. GENERAL
This change order is necessary to cover changes in the work to be performed under this Contract.
The GENERAL CONDITION, SUPPLEMENTARY CONDITIONS, SPECIFICATIONS and all
parts of the Project Manual listed in Article 1, Definitions, of the GENERAL CONDITIONS apply to
and govern all work under this change order.
II. REQUIRED CHANGES
At Football Field:
1. Install Type-F curb along northern edge of driveway leading from the Field House to the
Football Field. The curb is to turn to the north and terminate at the sidewalk leading from the
T-Ball Field to the Football Field.
2. Remove existing sidewalk and install new concrete ramp from the Visitor side sidewalk to the
gate onto the Football Field in the southeast comer ofthe field.
3. Relocate the upper stair section on the southeast stairway and construct a 10- foot retaining
wall, as shown on the attached plans. Install a continuous handrail on both sides for the entire
length of the stairway, including the intermediate landing.
4. Replace the 4-foot-wide sidewalk near the Visitor bleachers with a 6-0foot sidewalk joining
the sidewalk constructed under Change Order 1.
5. Remove large oak tree between the Field House and Minor Field.
6. Raise the yard drain in the grass area between the South Parking Lot and Minor Field.
III. JUSTIFICATION
The construction of a new concrete driveway from the Field House to the Football Field required a
sloped surface to handle water runoff properly. A curb on the lower side is required to channel runoff
water away from the grass areas, where erosion could occur. The new, raised sidewalk along the east
(Visitor) side of the Football Field resulted in a step-down from the sidewalk to the lower sidewalk
leading to the Football Field in the southeast comer. Removing this short sidewalk, which is in poor
condition, and constructing a ramp will correct the problem. The upper section of the southeast
stairway is immediately adjacent to the south sidewalk and poses a hazard to pedestrians. Its
relocation further north by imposing an upper landing will correct this problem. The existing 4-foot-
wide sidewalk presented a choke point for pedestrian traffic traveling from the parking lot to the
Visitor bleachers. Changing this short section to the same width (6 feet) as the adjoining sidewalk
installed under Change Order 1 will remove this deficiency. The root system of the large oak tree
was too damaged by recent construction activities and needs to be removed before it becomes a
hazard. The yard drain is now two feet below the surface grade as a result of installing a higher
retention wall and needs to be raised to avoid a fall hazard in an area of pedestrian access.
IV. NARRATIVE OF NEGOTIATIONS
Costs are based on a Contractor price proposal that were reviewed by the Engineering Department
and modified following subsequent negotiations.

Acknowledgements:
The aforementioned change, and work affected thereby, is subject to all provisions of the original
contract not specifically changed by this Change Order; and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on
the original contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the
adjustments in Contract Price and Time shown hereon constitute full and complete compensation and
satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a
result of this Change Order. No other claim for increased costs of performance or modifications of
time will be granted by the OWNER for the Work covered by this Change Order. The
CONTRACTOR hereby waives and releases any further claims for cost or time against the OWNER
arising from or relating to the matters or Work set forth or contemplated by this Change Order.
