Background Summary:
Unsuitable underground material was discovered while excavating the southern end of the new
stormwater pond in the Pioneer Key area. Project excavation work was halted while geotechnical
inspections and re-engineering was completed to respond to the situation. It was ultimately determined
that an old excavation existed on the site beneath and to the south of a small pond that was on the site
when construction began. Much of the effected area was found to be filled with construction debris
buried in the early part of this decade. The area was underlain by a 12-inch root mat. This area included
the southern portion of the pond, the inflow channel, and the parking area. No pre-construction
geotechnical test sites were located within the area where the unsuitable materials were discovered.
The entrained groundwater was drained from the face of the excavation while geotechnical inspections
were underway.
The ultimate decision by City and project engineers was to fully excavate the affected area, remove the
construction debris and other unsuitable materials, and fill the area with suitable material put into place
with proper compaction. This work was accomplished by excavating down to the original soil at the
location where the unsuitable material was initially discovered and proceeding to the limits of the area to
the east, south, and west until all such material was removed. In addition, the southern slope of the pond
was adjusted to 4: 1 and an intermediate shelf was constructed to prevent slope face collapse.
Acceptable replacement material was acquired from elsewhere on the site The total cost of delay and
remediation caused by the unsuitable materials was:
$16,860.00 for Delay (Contract Section 00700, Article 12 for Compensable Delay)
$14,459.50 for Remediation (cost of soil excavation, relocation, and placement)
$31,319.50 Total
Actual project time involved = 3 weeks (8 work days idle, 7 work days remediation)
Requested change in Contract Time = 2 weeks
During the two-week period of delay, work crews were significantly idle while Devo Engineering and PEC
investigated the problem and decided on a course of action; however, some useful work did occur, so the
actual delay reimbursement requested is only for five full days. The cost of remediation was based on

the actual number of hours required for equipment and labor.
In addition to reflecting the financial and contract time impacts of the unsuitable materials, the change
order includes $2,640.00 for a drip irrigation system that will sustain the trees being planted around the
pond. This alternative system will provide direct moisture to the trees without requiring excessive use of
the spray irrigation system, which could impact the viability of sod placed on pond slopes if enough water
were to be broadcast over the entire site in order to ensure tree survival.
Issue:
The Engineering Department has proposed a mutually beneficial settlement regarding the issues of
irrigation system design and unsuitable underground materials discovered at the Pioneer Key Regional
Pond construction site and requests that the City Commission approve the proposed change order. The
change order includes an increase of $33,959.50 in Contract Price and an increase of 14 days in
Contract Time.
Recommendations
The Engineering Department recommends that the City Commission approve the proposed change order
and authorize the Mayor and City Clerk to execute the required legal documents. To fund the change,
staff recommends that the City Commission approve the reallocation of $33,959.50 from remaining funds
budgeted for this project.

CHANGES ORDERED:
I. GENERAL
This change order is necessary to cover changes in the work to be performed under this Contract.
The GENERAL CONDITION, SUPPLEMENTARY CONDITIONS, SPECIFICATIONS and all
parts of the Project Manual listed in Article 1, Definitions, of the GENERAL CONDITIONS apply to
and govern all work under this change order.
II. REQUIRED CHANGES
Provide additional Contract Price and Time for delay associated with unsuitable materials discovered
at the site and subsequent remediation of the problem.
III. JUSTIFICATION
Unsuitable materials were discovered in the southern area of the project site near the end of pond
excavation. Project delay was experienced as geotechnical investigations were conducted and design
engineers decided on a course of action. The ultimate decision was to fully excavate all unsuitable
material and to replace it with acceptable materials.
IV. NARRATIVE OF NEGOTIATIONS
Change order is based on mutual agreement by the parties.

The aforementioned change, and work affected thereby, is subject to all provisions of the original
contract not specifically changed by this Change Order; and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on
the original contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the
adjustments in Contract Price and Time shown hereon constitute full and complete compensation and
satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a
result of this Change Order. No other claim for increased costs of performance or modifications of
time will be granted by the OWNER for the Work covered by this Change Order. The
CONTRACTOR hereby waives and releases any further claims for cost or time against the OWNER
