Subject: Approval of and authorization for the Mayor to execute Change Order No. 1 for Phase 2 of the
Lakeshore Dr. Improvements Project
Background Summary:
Improvements are presently being made to North Lakeshore Drive from Oakland Avenue to North
Lakewood Avenue. These improvements include raising the road and sidewalk to remove a persistent
flooding problem, constructing a retaining wall along Lake Starke to stabilize the shoreline, and other
improvements designed to facilitate pedestrian and recreational activities.
During the course of the work, City Engineering staff and the Contractor identified several value
engineering opportunities to improve the constructability of the project, thereby lowering costs, and to
enhance the final product. An example of reducing costs is the substitution of a simpler foundation
design for the shoreline retaining wall. An example of improving the final product is recovery of original
brick pavers under the asphalt pavement that allows us to reinstall brick paving for the reconstructed
street. In addition to revising the original project scope, it was recognized that changes needed to be
made to the Lakeshore Drive/Oakland Avenue intersection in order to better accommodate boat trailer
traffic. These three categories of plan revision are included in this change order, which provides for both
deletions and additions to the work.
Issue:
The Engineering Department has proposed a change order to implement the project modifications
identified through the value engineering process with regard to Phase 2 of the North Lakeshore Drive
Improvements Project and requests that the City Commission approve the proposed Change Order No.
1. The change order will produce project cost savings that partially offset the increased costs of
proposed project improvements, such as to use brick paving instead of asphalt.
Recommendations
The Engineering Department recommends that the City Commission approve the proposed Change
Order NO.1 and authorize the Mayor and City Clerk to execute the required legal documents. To fund
the change, staff recommends that the City Commission approve the allocation of $52,037.00 from the
Park Impact Fee (110-572-00-6302), $14,250.00 from Water operating funds (401-533-00-6302), and the
balance of $44,144.50 from General Fund contingency reserve (current balance of $78,900.00).

Financial Impact:
The funding for this action is derived from a revised allocation of project costs associated with
improvements related to new facilities for Parks & Recreation and relocation of existing water mains, plus
a new allocation of contingency funds for street improvements. The new park facilities include sidewalks
and handrails along the new elevated lakeside sidewalk. Water mains were relocated to avoid conflicts
with stormwater structures. The reallocation of project costs to these funding sources releases
previously allocated stormwater and street funds for the improvements included in the change order.

CHANGES ORDERED:
I. GENERAL
This change order is necessary to cover changes in the work to be performed under this Contract.
The GENERAL CONDITION, SUPPLEMENTARY CONDITIONS, SPECIFICATIONS and all
parts of the Project Manual listed in Article 1, Defmitions, of the GENERAL CONDITIONS apply to
and govern all work under this change order.
II. REQUIRED CHANGES
The original project plans have been modified to resolve design issues and provide a brick paver
surface for Lakeshore Drive from Lakewood Avenue to Oakland Avenue. The revised project plans
now govern the work under this contract.
III. JUSTIFICATION
In the course of planning the work with the Contractor, City Engineering staff identified several value
engineering opportunities to improve the constructability of the project. The recovery of original
brick pavers under the asphalt pavement presented an opportunity to reinstall brick paving for the
reconstructed street. At the same time, it was recognized that changes needed to be made to the
Lakeshore Drive/Oakland A venue intersection in order to better accommodate boat trailer traffic
headed away from the lakeshore. These three categories of plan revision are included in this change
order, which provides for both deletions and additions to the work.
IV. NARRATIVE OF NEGOTIATIONS
Change order is based on mutual agreement by the parties and the original contract unit prices.

1 Unit price is derived from original lump sum price and quantity.
2 Unit price is based on unit cost per inch of base depth ($1.50/inch for 10 inches) times 12-inch depth.
3 Unit price is based on contract price for furnishing and installing concrete pavers. Although the City is to supply the
bricks recovered from old roadbed, Contractor will need to clean, stack, and transport the brick from Public Works to
Lakeshore Drive; therefore, the extra preparation labor offsets the savings in material costs. Concrete pavers are to be
used at intersections for increased resistance to forces imposed by turning, braking, and acceleration vehicles.
4 Unit price does not include cost of excavation due to the pipe's location in the trench required for the new ACO S300K
boat ramp drain inlet.
5 Unit price negotiated by the parties.
6 Price is based on a 17% reduction in block volume, the savings from changing to a single-elevation footer, the savings
from shortened geogrid anchors, and the original contract price.
7 Price is based on a material cost of $124.91 per linear foot plus $50.00 per linear foot for installation of 80-foot drain.
8 Unit price is roughly 50% of the cost to furnish and install a complete unit.
VI. APPRO V AL AND CHANGE AUTHORIZATION
This proposed change to the Contract is to be approved by the City of Ocoee Commission.
The aforementioned change, and work affected thereby, is subject to all provisions of the original
contract not specifically changed by this Change Order; and,
It is expressly understood and agreed that the approval of the Change Order shall have no effect on
the original contract other than matters expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the
adjustments in Contract Price and Time shown hereon constitute full and complete compensation and
satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a
result of this Change Order. No other claim for increased costs of performance or modifications of
time will be granted by the OWNER for the Work covered by this Change Order. The
CONTRACTOR hereby waives and releases any further claims for cost or time against the OWNER
arising from or relating to the matters or Work set forth or contemplated by this Change Order.
