MINUTES OF THE CITY OF OCOEE
CODE ENFORCEMENT BOARD MEETING
APRIL 22, 2008
CALL TO ORDER
Chairman Godek called the regular meeting of the Ocoee Code Enforcement Board to order
at 7:03 p.m. in the Commission Chambers at City Hall. Member Lowery led the Invocation
and Member Ballard led the Pledge of Allegiance to the Flag. The roll was called and a
quorum was declared present.
PRESENT: Chairman Godek, Members Ballard, M. Godek, Lowery, Sais, Stanley, and
Alternate Member Alexander. Also present were Code Enforcement
Supervisor Loeffler, Code Enforcement Officer Delgado, Code Enforcement
Officer Rodriguez, Code Enforcement Officer Siegrist, Division Chief Stanley,
Permitting Clerk Everett, Attorney Sneed, and Deputy City Clerk Sibbitt.
ABSENT: Vice Chair Chancey and Alternate Member Elliott were absent excused.
GUESTS: None.
Permitting Clerk Everett administered the oath to Code Enforcement Supervisor Loeffler,
Code Enforcement Officer Delgado, Code Enforcement Officer Rodriguez, Code Enforcement
Officer Siegrist, Division Chief Stanley, and anyone intending to speak regarding a case.

Officer Rodriguez gave a detailed history of the case and further stated, as of today, the

Jose Rodriguez, 1505 Foxfire, inquired ifhe could get an extension. He stated he is currently
working on the project and may need a few more months. Officer Rodriguez stated he has
been working with the City to come into compliance and did get a permit, but he needs to
work on a revision at this time and provide the City with a list of materials used in order to get
a final inspection.

Officer Rodriguez gave a detailed history of the case and further stated, as of today, the
property is in non-compliance.
Willie Anderson, 1001 Marlene Drive, stated that he is not sure why it is expired since he
was told by the inspector he would get an extension for 6 months from the date that an
inspection passed. He further stated that the last inspection that passed was exactly 6 months
from the previous inspection. Officer Rodriguez stated that without the inspector present it is
just hear say. She further explained that the respondent did receive a letter from the Building
Department on February 21, 2008, notifying him of the upcoming expiration of the permit.
Alternate Member Alexander inquired if the letter sent out by the Building Department
explained the process of renewing an expired permit. Officer Rodriguez stated she is not
aware of what is mentioned in the letter. She did explain that the letter was sent out in
February letting him know his permit was expired but he called for an inspection in March. A
brief discussion ensued and it was decided that this case was not ready to be presented so they
should continue it until the May 2ih meeting.

Observation: Failure to obtain any required fmal inspections for a mechanical change-out, permit #0602873,
issued on December 21,2006, and expired on June 19,2007.
Officer Rodriguez gave a detailed history of the case and further stated, as of today, the
property is in non-compliance.
Kelly Anderson, 701 Broadway Drive, stated Crums installed the unit on April 14, 2006, and
did not pull the permit until December of 2006. He explained at length all the problems he is
experiencing in his home due to the faulty work done by Crums. Wayne (last name not
known, speaker form not filled out), 701 Broadway Drive, also gave testimony regarding the
many problems they are experiencing in the home. Officer Rodriguez read a letter from
Crums Climate Control addressed to the City regarding the problems they are having with the
respondents on getting into the home to do the inspection, and another letter that was sent to
the respondents from the contractor letting the homeowners know they needed to confirm an
inspection date. -..
Member Ballard inquired from Mr. Anderson if they had anything in writing showing that
they contacted the contractors about their problems. Mr. Anderson stated that everything has
been verbal, either on the phone or he has stopped by their office. Member Lowery stated he
understands their frustration but feels they need to go before small claims court to resolve
their bigger issues. The board will still have to make a decision on what was presented before
them.

Officer Rodriguez gave a brief history of the case and further advised the board that the
respondent did contact her when he came into compliance.
Jim Macon, 750 S. Orange Blossom Trail, stated he has owned the property since 1998 and
has never had any problem with maintaining the property until last year when he lost his lawn
person and the replacement person overlooked that property. He finally just purchased a lawn
mower to maintain the property himself. Member M. Godek inquired if his lawn person was
maintaining his other properties. Mr. Macon stated they are maintaining his other properties.

Observation: Overgrown grass/weeds. Swimming Pool dirty and green.
Anissa Bolton, Law Offices of Marshall Watson, stated in this particular situation the
property was in foreclosure and when the bank acquired the property they did so in its
deteriorating condition. She further stated she noticed the violation notices were sent to
Dallas and may not have been passed on as quickly as they should have been to the local
office. The bank has brought the property into compliance and is maintaining the property so
they can sell it, which is why they are asking for fines to be reduced. They would be more
than willing to pay administrative cost or any other costs which would be more appropriate
then the $26,750.00 lien that is currently being requested. Member M. Godek inquired if
they had any evidence that the home was deteriorated when the bank acquired the home. Ms.
Bolton stated she does have letters, in her case files, from the owners who had lived there
stating that they had not been employed for several months and that they were not able to
maintain the property. Officer Rodriguez mentioned that when she received the compliant JP
Morgan was the listed owner on the property taxes. Member M. Godek inquired if the City
had to go onto the property to make the property safe. Officer Rodriguez stated they did not
have any safety issue problems with this house. A brief discussion ensued regarding the lack
of immediate action and the property currently maintaining compliance.
Member Stanley. moved in Case No. 07-211 to reduce fine down to City administrative costs.

Observation: Zoning violation. Single family dwelling utilized as a multi-family dwelling. Multi-family
dwelling only permitted within areas zoned as R-3, 910 Nola Drive is within a area zoned as R-lAA.
Additionally, multiple complaints involve vehicle parking, number of persons entering and leaving and rented
rooms. Junk, debris: Old TV set, landscape debris/weeds around house.

Officer Loeffler stated the board gave the respondents 30 days and he has not been contacted
by the occupant of the house so the property is being found in non-compliance.
Steve Rocci stated at the last meeting he had asked to continue the case for a month to have an
attorney present. He stated after the last board hearing he advised his roommates that they
would have to leave and so far one person has left and several others will be leaving soon. His
attorney could not be present tonight; however, he was advised from his attorney to read the
definition of multi-family from the City's Land Development Code. The Land Development
Code states, "Family - One or more persons occupying a single dwelling unit, provided that
unless the members by law, blood, or marriage, no such family may contain more then 5
persons..." It does not state that they must be related to occupy the dwelling. Chairman
Godek stated he thought the problem was how he was getting the roommates. Attorney
Sneed stated the board can not find the respondents in violation of multi-family if the living
arrangement meets the City's code for single family. She further stated most of the time when
unrelated people are living together someone is paying rent, which is why the code defines a
limit. Attorney Sneed advised the board that they can extend the compliance for two more
weeks and give the City time to verify that Mr. Rocci is in compliance. Chrysoula Lile stated
that she knows for a fact that there were 8 people living in the home, 6 adults and 2 children.
Mr. Rocci stated the children were only visiting on the weekends and did not reside at the
home.

Observation: Small parcel of land adjacent to and bordering residential structures and property. Parcel contains
excessively tall and overgrown weeds and grass and several large dead and decaying trees which are near
residential structures within the Prima Vista neighborhood. Multiple complainants are concerned about fIre,
rodent, and falling tree danger. County and state records do not indicate ownership address or physical address
of parcel. All records researched specify "unknown".
Officer Loeffler stated that this case is regarding the tract of land that is not buildable. He
further stated he called Orange County Tax Collectors Office to find out who was paying the
taxes on this parcel. He also interviewed several ex-employees of the City and found out that
there may have been some kind of deed agreement with the City, for a portion of the parcel.
After a brief discussion on his findings, Mr. Loeffler stated he would like to continue the case
for further investigation.

Member Ballard inquired about a property on the street west of Montgomery Road. He
stated that the house has cars covered with tarps, batteries, and misc. debris in the yard.
Officer Loeffler stated he believes the property he is speaking of is in the enclave of Orange
County. The County has received numerous complaint calls on this property.
