MINUTES OF THE CITY CQ\1MISSION SPECIAL SESSION HELD JANUARY 30, 1985
PRESENT: Mayor lson, Corrmissioners Cox; Rodgers; Bateman; Hager,
City Manager Griffin, City Attorney Kruppenbach2r, and
Deputy Clerk Louloudis.
ABSENT: None
CALL TO ORDER
Mayor loon called the Special Session to order at 7: 32 p.m.. Mayor
Ison announced that Special Attorney Drew Thanas was present. Mayor
Ison led those present in prayer and then to the Pledge of Allegiance.
~1'ayor Ison stated that Ccmn. Cox had called for the Il'eeting. The City
Attorney confinned that the Ccmnissioners could only speak of what was
on the agenda.

Corrm. Rodgers questioned the City Attorney, stating the last instructions
the Carrmissioners were given was not to talk to anyone about Prima
Vista, and by having this subject on the agenda is conflicting with
those instructions. City Atty. responded by saying he thought this
'WOuld be consistent with those instructions. The subject was not going
to get into details. Carm. Cox stated while he was campaigning, several
people asked him what he thought about the Prima Vista situation, and
he responded to those people by saying he needed rrore tiIre to review
what exactly has taken place then make a decision on what to do next.
Ccmn. Cox rroved to have the City Attorney, City Engineer, City Manager,
and Mayor lson meet as a negotiating team for the City of Ocoee, with
Prima Vista, upon their request to initiate negotiations, and pursue
a settlerrent with Prima Vista, and report at regular meetings, or if
needed a Special Session, to keep the Carrnission as updated as possible.
Ccmn. Bateman seconded. Carrm. Rodgers questioned whether Mayor Ison
should be part of the negotiating team as he is specifically na:rred. in
the law suit. Canm. Rodgers continued, if Prima Vista 'WOuld drop the
individual law suits then he would have no objection for anyone sitting
on the Board to sit in on these Ireetings. CarrIn. Bateman asked the Atty.
if there 'WOuld be a problem legally with Mayor lson being a part of the
team. The City Atty. stated not legally, but he understood Corrm. Rodgers
concern. Corrm. Bateman then asked Camm. Cox to change his rrotion to
exclude Mayor loon from the team until such tiJre the individual law
suits are dropped. City Atty. stated he would like to have saneone
from the Board there to guide them sarewhat, but who ever it 'WOuld be
'WOuld not be saying Im.lch to Prima Vista. Camm. Hager stated he had
no problem with Mayor lson being on the team, but he questioned whether
that 'WOuld vleaken our position. City Atty. stated it would not, as
the Mayor 'WOuld only be there as a representative, and he generally has
one representative present to guide the Attorneys. Mayor lson stated
he did not like being in litigation as an individual, although the
City needs to make SaTE progress with the suit. Mayor lson stated
that the Ccmnissioners would be better inforIred if saneone from the
Board were on ,the team, which 'WOuld be reported on a Il'eeting by
Ireeting basis, that way any time the Ccmnissioners want to act they
can. CarIn. Bateman withdrew his request of Corrm. Cox to exclude Mayor
lson from the rrotion. Corrm. Rodgers stated the first priority is to
get Prima Vista to drop the individual lawsuits against the officials.
Ccmn. Rodgers protested against having Mayor lson on the negotiating
team, as he stated he did not want anyone to represent him that is
also being individually sued.

Mayor Ison stated this was Irerely to corrmence a Ireeting to see if the
City can settle with Prima Vista. Mr. Ira Johnson ccmnented that the
team should consist of persons who have not negotiated previously.
The vote was taken, Ccmn. Cox, Bateman, and Hager voted yeh, and Ccmn.
Rodgers voted ney. Ccmn. Rodgers asked Hayor Ison if he could go to
the Ireeting and not say anything. Mayor lson stated he 'WOuld not qive
that ccrnnitbrent. Mr. Drew Thanas stated he 'WOuld call Prima Vis~
the following rrorning to tell them they have a negotiating team, and
secondly, to ask them to drop the individual law suits against the
officials. City Attorney Kruppenbacher advised against letting Prima
Vista pick who they 'WOuld like on the team. Mr. Drew Thanas stated
he would personally update Canm. Rodgers on the negotiations.
At this ti.Ire City Atty. Kruppenbacher left.
RECREATION

Carrn. Cox rroved to develop the South Park to include a paved street
off of Geneva St. entering the park and dead ending in a cul-de-sac,
a paved street coming from the proposed Highlands II subdivision, also
dead ending in a cul-de-sac, therefore there would not be a through
street, and two lighted tennis courts, to be completed in the May -
June ti.IrefraIre. Corrm. Bateman seconded. Corrm. Rodgers asked where
the rronies would care from. City Manager stated the paving 'WOuld
cane from paving and drainage rronies, and the Army might possibly
do the gradeing. City Manager continued that if this was the Comn-
issions priority he could take other rronies to construct the tennis
courts. Mr. Beech stated he had $5,000.00 for the Peach Lake Park,
which has no develormmt as of yet, and he VJould have to draw from
this to support Camn. Cox's rrotion. City~ger Griffin stated that
if Mr. Beech could care up with the rronies for the lighting needed,
he could supply the rest of the rronies needed fram the budget.
Mr. Beech stated he was trying to concentrate on one park, to get it
canpleted, which is Vignetti Park. He has a landscape architect
making plans for the South Park. And Mr. Beech stated he has told
hareowners that he will have a decent park for them by June 5th.
He will ask the Army battalion to do the gradeing free of charge.
Mr. Beech stated the architect stated we did not need two entrances
into the park, he thought to eliminate the Highlands II entrance.
Mr. Beech stated the people want rest areas, a place for small
children to play, tot lots, basket ball court, and a pick up area.
Mr. Ira Johnson asked what we have available for the senior citizens.
Mr. Beech stated the senior citizens want a park with benches they
can rest and talk with others. City Manager Griffin stated the Fire
Dept. is going to have an excercise with the trees, anything 8 ft. or
under will be cleared out, and new trees planted, near the new Fire
Station, then we will put picnic tables, and grills. The Fire Station
will be close enough to watch out for the grills and tables.
Ccmn. Rodgers stated there is $20,000.00 for Geneva St. Park allocated,
and the $37,000.00 of FRS monies is actually $22,000.00 as $8,000.00
is allocated for the generator for the Ccmnunity Center, and $7,000.00
for a truck and trailer for the Recreation Dept.. City .r-1anager
stated he felt sure he could find the rronies to support Camn. Cox's

if the South Park was a priority then he had no problem with it.
Ccmn. Rodgers thought there are other streets needing paving rrore,
such as Third Street. City Manager stated only 1/3 of Third Street
is in the City, the rest is County. The vote was taken, and it
carried with CarIn. Cox; Bateman; and Hager voting yeh, and Ccmn.
Rodgers voting ney.
