Mayor lson called the regularly scheduled City Carrmission Il'eeting to order at
7:34 p.m.. Camn. Cox led those present in prayer and to the Pledge of Allegiance
to the Flag.
APPRJ\TALS
Comn. Rodgers rroved to dispense with the reading of the minutes, Corrrn. Cox se-
conded, and the vote carried unaninously. Cornn. Bateman and Corrrn. Rodgers
made corrections and clarifications to the minutes of March 5, 1985. Corrrn. Bateman
rroved to approve the minutes of the regular meeting of March 5, 1985, as corrected,
ConIn. Cox seconded, and the vote carried unaninously.

Mr. Henry Van Brackle was present to talk about the Arrerican Cancer Society.
Mr. Henry Van Brackle told of the seven warning signs of cancer, and stated that
l'-f..s. Jane Winchell is the cancer representative in this area. Her phone number
is 293-2661. Mr. Van Brackle stated they needed volunteer persons to make phone
calls, and persons to help get packets together.
Mr. John Alexander, Ocoee Lions Club, presented the Carrmission with the President's
Trophy, and the Vinson Trophy, for the largest number of agricultural products
displayed at the Central Florida Fair. Cornn. Rodgers corrmended the Lions Club
for the display they built at the Fair.

Mr. Tom Kelley, City Engineer, recOIt'lrended final plat/plan approval for Hidden Oaks
Mr. Kelley stated he recorrrrended the Comnission give the Mayor authorization to
execute the final plat subject to final review by the City Engineer and City Attorney.
ConIn. Cox made the rrotion, Camn. Bateman seconded, and the vote was unaninous.
Mr. Kelley stated the bids will open on Friday for the Water System Irnproverrents.
Mr. Kelley stated next we will review the budget; award the contract; then go with
one area first. Mr. Kelley stated at the next regular Ireeting we will decide the
order of priorities of the sections open for bidding.
Mr. Kelley stated he contacted Mr. Alex Hull, who is 'WOrking with the Industrial
Park Sewer Plant. Mr. Hull inforIl'ed that DER has given us their cooperation for
six rronths. At that tirre we will phase out the sewer plant.
Mayor lson inforrt'ed that Orange County has changed the location for their planned
sewer plant. Mayor lson asked the City Engineer to stay on top of the Orange
County sewer plant. Mr. Kelley stated that he would, and at the present tirre it
would not be a rronetary cost to the City. Corrm. Cox also suggested keeplng the
pressure on the County.

SPOCIAL STAFF REPORl'S - CITY PLANNER - RUSS WAGNER
Mr. Russ Wagner, City Planner, gave a surrmary of the Evaluation and Appraisal
Report, which is required by the State. Mr. Wagner inforrred the Comnission that
they mayor may not adopt this report. If the Comnission decides to adopt the
report, it will becare a part of the present Corrprehensive Land Use Plan. Mr.
Wagner recamended the Carmission not adopt the Evaluation and Appraisal Report,
as in the near future he will be rewriting the present Canprehensive Land Use Plan.
HFAR:IR.;S - <nlSENI' AGENDA
ConIn. Cox rroved to approve first readings of items "c" and "d" on the agenda,
and to read them by title only. Corm1. Bateman seconded, and the vote was unanirrous.
(The other items under consent agenda were asked to be pulled.) Mr. Griffin
read the proposed Ordinance annexing Bolin/Olive/Creech property, by title only.
Mr. Griffin infonred the Board that the second reading will be April 16, 1985.
Conm. Rodgers questioned whether the three different individuals awning the four
parcels have each paid a fee. Mr. Griffin explained that the Ordinance is written
such that everything you petition to annex is one fee; there can be rrore than one
land owner, as long as one person is acting agent for all property petitioned to
annex. In this case, Mr. Bolin ownes one parcel and is the agent for the other
three parcels. Corrm. Rodgers asked whether he was an agent only for annexation
purposes. Mr. Griffin stated Mr. Bolin has intent to develop the properties.
Mr. Griffin read the proposed Ordinance amending Ordinance 637, by title only.
Mr. Griffin infonred the second reading will be on April 16, 1985.

Corrm. Rodgers stated this should fall under the Canprehensive Land Use Plan.
Mr. Griffin stated it is a part of the CLUP, but to cover the City at this
point and time, we ItUlst pass an Ordinance. Camn. Rodgers asked Mr. Griffin if
he realized that technically we cannot address anything in the CLUP, which is
not in the territorial bolll1daries of the City. CarIn. Rodgers explained further;
we can not go into the Colll1ty and anticipate in our CLUP what we are going to do
in the County. r-tr. Griffin stated we ItUlst have an Ordinance to have a law. The
Comprehensive Land Use Plan, Hr. Griffin stated, is in fact designed to tell
citizens, and future citizens what the land use the City desires is. We passed
a Resolution a couple of weeks ago, putting everyone on notice that this is
mere we think our planning boundaries are going to be, so when we get into the
CLUP we can address the extent of the boundaries. This Ordinance is being
presented at this tiIre to is protect the City: when a developer cares into the
City to develop a certain parcel; along this road, if we do not have it identified
as a collector or an arterial street, we can not make certain requirements about
the width of the road, set backs of buildings, etc.. Corrm. Rodgers argued that
the City can not pass a law which governs the County. Mr. Bateman, Attorney,
stated he ~uld research the Ordinance to identify if the Ordinance is legal.
Mr. Griffin stated he wanted the Corrmission to be aware that Old Winter Garden
Poad is classified as an arterial street, per Corm1. Rodgers. Mr. Griffin stated
some property, on Old Winter Garden Road, is already zoned residential, and R- 3
is allowed on an arterial street, but by putting Old Winter Garden Road under
Arterial, it is strongly suggesting the zoning will be c<JIlllErcial.

Camn. Bateman expressed concern about whether or not the owner of the Chinese
Restaurant property was aware that if some tiIre in the future he 'WOuld need

water lines to his property. Mr. Griffin stated the property owner is aware
of this policy. Camm. Batemm and Conm. Hager asked to get this understanding
in writing so there is no confusion sare tiIre in the future. Mr. Griffin
asked to go ahead with the first reading and he ~uld have the agreerrent in
writing by the second reading. Conm. Bateman rroved to approve the first reading
of this prop::>sed Ordinance subject to Mr. Griffin getting the agreerrent in
writing, Conm. Cox seconded, the rrotion died with a vote of 3-2, Ccmn. Hager
& Cornn. Rodgers voting ney, Cornn. Batemm & Camn. Cox voting yeh. 'Ihe Mayor
votes in the case of a tie, Mayor lson voted ney. 'Ihe rrotion died as the
Corrrnission expressed concern about the property owner not using City water.
Cornn. Hager stated if this property owner had sarething wrong with the water
in his well, since the City permitted him to use the water from his well, the
City may be liable to some extent. Mr. Griffin disagreed stating that DER must
approve the well, therefore DER 'WOuld be liable. Corrm. Rodgers asked why the
City doesn't force property owners annexing into the City to use City water, as
soon as it is available to those persons. Mr. Griffin stated that it was the
sarre reason Prima vista could not force sorreone Who had a septic tanK. to connect.

Conm. Rodgers stated we are not in the busrness to sell or release property.
CorrIn. Rodgers stated it was essential that we have a fifteen foot easerrent,
and when we put the water line in we needed rrore that fifteen feet. conrn.

the vote was unanJ.ltOus. Mr. Griffin stated that Mr. Davis contacted the City
for the additional flve feet to enable him to build a house. Mr. Griffin
stated he has discussed this with Mr. Kelley and his staff and he assured hJl11
there 'WOuld be no problem with releasing this five feet. Mr. Grlffrn stated
the water line is already in the ground, and the only reason we 'WOuld need to
get rn there ~uld be to repair the water line. Mr. Griffin stated he was
acting on Mr. Kelley's recomrendation, and the fact that a cltizen is trying to
do something to improve a piece of property. '!he City Attorney recorrm:mded
this is done by Ordinance. Mr. Grlffrn stated Mr. Davis can not Ireet the
set backs without the additional five feet.

two chfferent estimates. 'lne first, to level the foundatlons, rrove the addltion
to the back part of the house, and return it to ltS original condltion using a
photograph as a guide. The second, is to bUlld bookcases rnside the house.
The individual who gave the estimate carre highly recarnrended by the Orlando
Hlstorical corrrnission. Mr. Horton Johnson, who gave the bld for the flrst project,
sul:xrutted a bid which ~uld inclUde jacking and leveling the house, supp::>rting
the house where lt is necessary, rerroving the ad.d.itlons, replacing windows,
and the clean-up and rerroval of the debris. Mr. r-t:>rrlS explarned the bid for
the bookcases, and stated they 'WOuld be 44 shelvrng units, which 'WOuld be free-
standing. Mr. Griffin stated he discussed the library idea Wlth the building
and flre departIrent heads, they have concern whether the bOOKS 'WOuld be too
heavy for the floors, and we 'WOuld need a sprinkler system for the llbrary.
Mr. Grlffrn stated he has sp::>ke to two individuals Who are interested in bidding
the restoratlon, and both recomrended gettrng a draftsman in to shOW the bldders
exactly what we are putting up for bid. Mr. Griftin stated he thought the project
'WOuld have to go up for the bidding process. Mr. Grlffrn was instructed to look
rrore into this project, set up a tiIre frarre, and rep::>rt back to the Corrrnission.

Mr. van lJeMark stated that tOday was cablevlsion' s six rronth deac1line. Mr .
Van DeMark was happy to announce that the north end of town has been corrpletel y
installed and partially connected. with servlce. Ocoee Garden villas were also
included, Haroour Highlands, and Lake ul yrrpic 'Ibwnhouses are complete. Mr .
Van DeMark assured that Cablevislon will extend as developers bUlld. Mr. Terry
Mesner, Regional Manager, CaIre from Daytona Beach. Mr. Van DeMark stated. they
have intentions of suppl Yillg cable to Ploneer Key Park II, Forest OaKs, and
on into the county, Sanders Drive, and Crown Poillt Apartrrents. Mr. Van DeMark
stated. they decided to go front easerrent for tne safety ot the 'WOrkers and tne
safety of tne residents. Mr. Van DeMark thanked the Carrmission for having
confldence ill Cablevision. Mr. Van DeMark also stated cablevlsion is having to
drop sarre channels in order to pick up a few "Imlst - carry" channels. Lhannel
8 and 13 were aropped to accarrodate channels 5:l & 43.

Camn. Rodgers rroved to accept the aUdit report and send to the state. COIrm. Cox
seconded., and the vote was unaninous. Mr. Griffin stated as a poillt of info:rmation
that the report has been made avallanle to the press and the citizens.

38.9 acres of land, across the street from Johio Shores Road, across the street
trom the R- 3 zoning, 'Which has not been developed yet. Mr. Bruce Stricker, 2450
Jestie way, Orlanclo, and Dan Holler, his partner, have developed. one Subdl vision on
the east !,:1_de of Orlando. Mayor lson illforrred Mr. Bruce StriCKer that conceptual
approval is basically to save the City sorre advertlsing rronies, ill case the Comn-

Mr. Newy Breland asked. the Comnission for permission to have tne annual Fun Day.
Mr. Breland stated May 3-7 WlII be the carnival and Don white wlll take care
of the carnlval. Mr. Grlfflll explained that anyone wantillg to have a c~i,:"al ill

the vote was unanirrous. Mr. Breland stated they were plannmg to use
Glenn Miller's property. Mr. Breland stated the Fun Day lS planned for OctoJ:Jer

Mr. Grlffm reported that the Flre Department took flrst place m three events,
and filst place overall. The Flre Depart:Irent was 18/100 ot a second from
setting a new record.

Mr. Gritfin reminded the Cormusslon that the Boat Races were this ~end.
They will start at aoout 10: 00 a .m. on ~turday, and end bunday afternoon.

Mr. Griffin asked for the Conmission' s approval of the plans set for the 60th
anniversary celebration. t.:onm. Rodgers rroved to approve the plans, Contn. Cox
seconded, and the vote was unaninous.
Mayor Ison stated he appreciated all of the v..ork done by all at the Magulre
House.

Mr. Bateman apologized for Mr. Kruppenbacher' s absence. He stated that Mr.
Kruppenbacher went to New York to confer Wl th the surgeon.

Hignt-of-way. Mr. Grlffm stated that Prima Vista nad lald the plpe and the
sod was supposed to be replaced by March 31st. Corrm. .Hodgers then corrrrented

to cover ourselves. corrm. Rodgers stated we must cut out all the unnecessary

card concept. Conm. Rodgers encouraged the comnission to reconslder the rrotlon
made to extend the water line on Hwy. 50, to carry that spending into next
year's bUdget. Mayor lson stated the water improverrents on the north end

Mayor Ison urged the Cl tizens of c.x::oee to contact the County CorrrnlSSloners to
pressure them to do sorrethlIlg about the intersection of ApOpKa Vmeland and
Silver Star Road. Mayor loon stated. they are installmg traffic lights at
the mtersection ot Gcxx1 HoIres mad and Hwy 50. Mayor Ison also stated we needed
to entorce the speed. limit on Hwy 50 rrore.
