MINUTES OF THE CITY COMMISSION WORKSHOP HELD NOVEMBER 19,
198:5
PRESENT. Commissioners Hager; Cox; Rodgers; and Bateman,
City Manager Griffin, City Attorney Kruppenbacher, City Clerk
Catron, and Deputy Clerk Louloudis.
ABSENT. Mayor Ison.
CALL TO ORDER
Commissioner Hager called the scheduled Workshop to order at
7110 p. m. .
DISCUSSION OF ARBOR ORDINANCE AND LANDSCAPE ORDINANCE - CITY
ATTORNEY
Mr. Kruppenbacher stated he simply added to the original
Ordinance and made the changes per Commission request.
Failure to comply with the Ordinance will be directed
straight to the City Commission. Waivers from the Ordinance
will also be directed to the City Commission for their
approval or denial.
Mr. Kruppenbacher stated he added the provision for a fine of
up to $25,000.00 for each violation to the proposed
Ordinance. Comm. Rodgers questioned what constitutes a
violation. Mr. Kruppenbacher stated any form of destroying
trees is a violation of this proposed Ordinance. Mr.
Kruppenbacher also added that if the City Commission would
impose a fine on a developer for destroying the trees, that
developer would have to pay the fine and restore the property
as much as possible. Until these things were done, the
proposed Ordinance provides any preliminary plans previously
approved are null and void by the City Commission.
Mr. Kruppenbacher also pointed out that *24, the Chionanthus
virginica, and *33, the Chionanthus virginicus, according to
the University of Florida, are different trees, therefore
both should be listed.
