PRESENT: Mayor Ison, Commissioners Johnson, Dabbs, Bateman and Hager, City Attorney Kruppenbacher, City Manager Ryan, City Planner Wagner, Public Works Director Occhiuzzo, and City Clerk Catron. A8SENT: None CITY ATTORNEY New Legislation Affecting Municipalities City Attorney Kruppenbacher presented the passed in the legislature that a~~ect ~ollows: new laws that were municipalities as CS/CB 593 created the "Florida Governmental Cooperation Act.. which required counties and municipalites to attempt to settle disputes be~ore resorting to litigation. This was initially proposed by Mayor Ison. e H8 1336 allowed city governing authorities and their chie~ executive o~~icers to meet in private with their attorney to discuss pending litigation provided the meeting would be tape recorded and the recording released a~ter the case was closed. SB 792 made revisions to the code enforcement procedure related to notice and the determination of ~ines. SB 1173 specified that the chairman of the code en~orcement board was a voting member. HB 1335 authorized municipalities to enforce tra~fic laws on private streets as long as the municipality and the party controlling the street entered into a written agreement providing for control by the municipality. CS/CS/H8 1421 authorized counties or municipalities representing a maJority o~ a county's population to levy .25, .5, .75 or 1.0% sales surtax with the proceeds earmarked for capital expenditures. SB 1063 expanded the time frame for the submittal of non-coastal county and municipal comprehensive plans from 1990 to 1991. HB 1337 related to fire safety and would require an ordinance prior to January 1, 1988 which would adopt minimum fire safety standards. - CS/HB 114 allowed local governments to require a bond for construction and electrical contractors conditioned only 1 ~ Page 2 Work.hop Co..ission Meeting 3uly 21, 1987 upon compliance with the state minimum building code and local building codes. CS/SB 359, in part, prohibited the issuance of a building permit for a nursing home without a determination that the applicant was licensed as an adult congregate living :facility. CS/HB 972 required that all utility easements also be easements :for cable television SB 790, in part, required that all plats include a notice statement that there might be additional restrictions that would not be recorded on the plat. CS/HB's 324. 341. 531. 168 authorized DOT to enter into agreements with municipalities to reimburse municipalities :for expenditures made on proJects or proJect phases that were not revenue producing and that were contained in DOT's :five year transportation plan. '-, A written memorandum had been sent to the Commission that outlined all of" the above mentioned bills. Proposed Ordinance Regulating Stormwater Run-off to the Lakes City Attorney Kruppenbacher stated that he was waiting on staf":f's and the City Engineer's recommendation be:fore he drafted an ordinance for their review. City Engineer Merkel reorted that he had looked at the ordinance the City had and along with the other regulations of" DER, etc., he was of" the opinion that the City did not need another ordinance as the one they had was '"state of" the art'". He said they could have a stricter ordinance i:f they wanted, but everyone was made to comply with these new stormwater run-of"f" requirments except :for a couple o:f businesses that were being built on existing business sites. Mayor lson and the Commissioners were still concerned with the problem and wanted to make sure the lakes were protected. They did not want the situation that happened at Lakes Peach and Moxie to happen again. The Commission agreed to look at the existing ordinance and regulations to see i:f that is what they want and bring back at the next meeting. Commissioner Bateman stated that someone needed to tell them what was needed, then they could look at what we have. . Discussion/Proposed Ordinance Reference "Impounding Equipm.nt... Mayor lson explained the background behind this request. Attorney Kruppenbacher stated that this would be illegal to do and no ordinance could be drafted :for that purpose. I:f a 2 . He stated he would research our existing ordinances and see what needs to be done to give them more "teeth". Propo..d Ordinance Amending Occupational Licens.. Attorney Kruppenbacher explained that this was on the regular agenda %or tonight's meeting and was placed on the workshop agenda in case they had any questions or thoughts. Commissioner Dabbs questioned the listing %or Dentists and Doctors separately from the professional category.
