MINUTES OF THE SPECIAL SESSION OF THE CITY COMMISSION HELD ON
DECEMBER 19, 1987

The meeting was called to order by Mayor Ison at 5:50 p.m..
PRESENT: Mayor Ison, Commissioners Johnson, Dabbs, Bateman
and Hager, City Manager Ryan, and Deputy Clerk Resnik.
APPOINTMENT OF INTERIM CITY ATTORNEY
For the record, Mayor Ison noted that Will Wellons from the
Orlando Sentinel was present.

Mayor Ison stated that the City had several legal obstacles
facing them and due to the resignation of Frank Kruppenbacher
and the firm of Swann & Haddock, he felt they needed to hire
an interim City Attorney until a replacement can be found.
One of the maJor items facing the City now was the closing on
the acquisition of Prima Vista Utilities. There were several
items that would be needed due to the acquisition. Mayor
Ison stated that he had met with Frank Kruppenbacher on
Friday and Mr. Kruppenbacher advised that interim counsel was
important. City Manager Ryan explained that there possibly
could be a problem with Carriage Oaks as they were
threatening to sue the City over not being able to get
Certificate of Occupancies. He had been able to handle so
far but that may not always be the case. Mayor Ison stated
that he and City Manager Ryan had met with Egerton van den
Berg of the firm of Foley, Larner, van den Berg, Gay, Burke,
Wilson and Arkin. They were a firm of 30 lawyers located at
111 N. Orange Ave., Orlando. Mr. van den Berg said he had no
conflicts with anyone except Heller Brothers and they would
do as the previous attorney had done and step aside if there
was a conflict. Mayor Ison felt they would be a good firm
and they would be willing to start next week. He then asked
for discussion.
Commissionel~ Bateman asked what the fees would be and Mayor
Ison said their fees were standard and ranged from $65/hour
at the lowest to $125/hour for the highest. Commissioner
Bateman also expressed concern over switching some of the
cold business especially at the higher rate. Mayor Ison asked
Commissioner Bateman to get with Ted on the specific matters
he wanted transferred. Commissioner Dabbs agreed that we
needed repl~eserltat ion but emphasi zed that II i nterim" was a
good way to put it. Commissioner Bateman moved to approve the
law firm of Mr. van den Berg to serve as the interim
attorney, Commissioner Hager seconded and the motion carried
unarlimously.
