MINUTES OF THE WORKSHOP OF THE CITY COMMISSION HELD ON
MAY 17. 1988
The workshop was called to order at 6:40 p.m by Mayor leon.
PRESENT: Mayor lson, Commissioners Johnson, Dabbs. Bateman
and Hager, City Attorneys Rosenthal and Woodson. Consulting
Engineer Kelley, City Manager Ryan, City Engineer Finch, City
Planner Wagner and City Clerk Catron.
DISCUSSION ON PROPOSED TRANSPORATION IMPACT FEE ORDINANCE

Attorney Woodson explained that since the last meeting he had
exchanged letters with with attorneys for the Home Builders
Association (HBA) and the attorneys for the ZOM properties.
He had incorporated the changes and comments recommended by
the Commission and those recommended by the attorneys for
the HBA and Zom. He highlighted the following items that
were changed: He changed the City Manager to DRC on page 3,
he added the list of development agreements on page 8 (all of
those were less than two years old), On page 9 a new section
was added to deal with what they might want exempt and On
page 10 added language reference interest earned. He stated
that these were the major changes. The Commission asked if a
fee could be charged for review and Attorney Woodson said it
could be done by Ordinance. This would cover the cost in
case an applicant woud submit an altertnative road impact fee
per Section 5 of the proposed ordinance. Attorney Woodson
suggested the fee should be about $500.00. There was
discussion as to whether the fee was too high or too low and
Mayor Ison suggested using the $500.00 fee then they could
come back and amend the ordinance if it was found to be
insufficient. Attorney Woodson stated that except for the
percentage of the impact fee, he felt the language was
satisfactory and the ordinance would be ready for first
reading at the next meeting.
Miranda Fitzgerald, representing Zom Properties. stated that
they had an existing Development Agreement and their main
over riding concern was the level of the fee. She urged the
Commission to use the 52% fee. She also questioned Page 6
item (i) and stated that she felt that paving of existing
right-of-way and perimeter roads should not always be singled
out as not available for some credit. Planner Wagner said
the language was drafted to go along with our existing
ordinance. City Manager Ryan questioned the language as we
had given credit for traffic signals. They discussed ending
the paragraph after "ingress and egress". The wording would
be changed so that it would read that anything serving
internal would not be given credit and anything serving
external would be given credit. Mrs. Fitzgerald again asked
the commisison to reconsider the 100% interim fee.

Lynn Zegelbone. attorney for HBA, reiterated the same concern

regarding the 100% fee and urged them to be careful. She
recommended the fee at 52%.
Commissioner Bateman questioned Item D on page 10. Mayor
Ison asked if a provision could be added to make it
retroactive. Attorney Woodson stated that he had tried to
draft the interim fee ordinance without challenge. He stated
that it would be a problem to try and do retroactive and also
to try and speed the process.
Mayor Ison asked if there were any other comments.
Tom Muckler asked what the time frame was for the ordinance
as he had some lots in the City he wanted to develop. Mayor
Ison asked him to get with the City Manager and they would
explain the process.
