MINUTES OF THE SPECIAL SESSION COMMISSION MEETING HELD
ON SATURDAY, MAY 21, 1988
CALL TO ORDER:
3:55 P.M.
PRESENT: Mayor Ison; Commissioners Bateman, Dabbs, Hager,
and Johnson; City Manager Ryan; City Attorney Rosenthal; and
Assistant to the City Manager Resnik.

Mayor Ison asked if the Commission had any further comments
on the evaluation of the City Manager or on the "State ox the
City". There were no other comments and Mayor Ison opened
the discussion on the interlocal agreement with St. Johns
River Water Management District. Attorney Rosenthal said
Attorney Woodson was working on the state of the water bodies
in Ocoee. He said the City had several options for
protecting the City's lakes and other surxace water bodies.
Attorney Rosenthal said presently the City and St. Johns
Water Management regulated the maJority of surface water
bodies. The regulations of these entities often overlapped
without any additional benefit to water quality. Because of
this, the City could opt to delegate the regulating of these
matters to St. Johns. The downside to this would be that St.
Johns would only research certain size water ways. Attorney
Rosenthal said the City would need to create certain
regulatory measures for the smaller water bodies. Attorney
Rosenthal said the Spring Lake proJect was an example of the
present situation where the City and St. Johns were
overlapping in regulating. The Developer had already
received a permit from St. Johns and the City Staff and
Consultants duplicated that effort to make sure the City
standards were met. Attorney Rosenthal said this was an
expensive process and did not provide xor anything St. Johns
had not already done. Attorney Rosenthal recommended that
the City hire someone to review and enforce regulatory
measures in regards to water bodies. He said the City had
the ability to pass on some of the cost to the Developers.
He also suggested that the City cooperate with St. Johns
Water Management in the review process. Attorney Rosenthal
said the other option would be to discuss with St. Johns
about lowering the thresholds to provide for more stringent
criteria. Attorney Rosenthal felt that St. Johns would
respond that that would require additional staxxing.
Attorney Rosenthal said Attorney Woodson felt it was not
worth the extra work the City Consultants were presently
doing.

City had a recent breakdown that listed development proJects
versus City proJects. Commissioner Dabbs provided Mayor Ison
with a recent breakdown. Mayor leon said it did not appear
that there would be enough money there to hire someone.
Commissioner Bateman said iz the City had the right
ordinances in place, it would not need to hire a staff
person. City Manager Ryan said that this would make a good
topic for discussion at the day-long meeting scheduled for
June 23 since water and drainage would be diecuesed.
Commissioner Bateman said for the record that he wae
interested in reviewing and strengthening current ordinances
and establishing new ones if necessary. Commissioner Johnson
suggested that the Commiesion wait to see how much the new
City Engineer could handle.
Mayor Ison asked iz the Commission wanted to make any other
comments or take action on anything other than what had
already been said. Since there were no comments, Mayor Ison
asked for any closing comments from each Commissioner.

Commissioner Johnson wanted to take another look at the
ProJect Manager position for Bowness Road that was discussed
at the Commiesion Meeting on Tuesday night. Mayor Ison asked
if the money to fund this position could come out of the
money set aside for the Bowness Road proJect. City Manager
Ryan said it could and that the City would also be looking
into other improvements in the area around the proJect.
Mayor Ison said the Staff also needed to look at the section
of road from Story to Highway 50. He felt it would need to
have three lanes to handle the expected growth.

Mayor Ison said he wanted to make a comment about the issue
of setting the agenda for meetings. He said it was his
understanding that the Mayor and Commiseioners had the
authority to get something on the agenda at any time, but
that it was the City Manager who had control over what was on
the agenda. The Mayor said the Commission did not have the
time to review what was proposed to be on the agenda and that
the City Manager should review it and make any decisions.
Mayor Ison said the agenda should also accommodate citizens
and that they should be able to approach the Commission
early. Mayor Ison aleo said if there was a full agenda, the

City Manager should hold certain items until the following
meeting and not overload the agenda. Mayor Ison said to make
the meetings progress, they would need to follow Robert's
Rules of Order and that no discussion would occur until a
motion was made and seconded. Mayor Ison also said to place
more items on the Consent Agenda to conserve time. Mayor
lson said the agenda could be altered to move citizens'
comments toward the beginning of the meeting and that any
other improvements the City Manager could make should be
done. Mayor Ison said the Commission should also be holding
a mini-agenda at 7:15 p.m. and that they should all be in
attendance for that.
