HomeMy WebLinkAbout07-19-88 WS . MINUTES OF THE CITY COMMISSION WORKSHOP HELD JULY 19, 1988 The meeting was called to order at 6:35 p.m. by Mayor lson. PRESENT: Mayor lson, Commissioners Johnson, Dabbs, Bateman (arrived at 6:38 p.m.), and Hager, Attorney Rosenthal, City Manager Ryan and City Clerk Catron. ABSENT: None REVIEW OF PROPOSED CHANGES TO THE CHARTER - Chairman Beatty Review of Article IV Section 1 - Chairman Beatty explained that the committee had continued the strong City Manager form of city government. Other than minor technical enhancements, provisions were made that the City Manager would be hired by vote of all City Commissioners, have a minimum one year term and receive an annual review/evaluation from the City Commission. The City Commission questioned the vote of "all" of its members. Chairman Beatty explained that this would be a maJority of the Commission, such as 3 out of 4 or 3 out of 5 if the provision that the Mayor votes was included in the Charter. There was general agreement by the Commission on the changes in Section 1. e Section 2: Chairman Beatty explained that this section dealt with the removal of the City Manager. Proposed changes were: three City Commissioners vote on a resolution to remove the City Manager; then the City Manager would be suspended for up to 45 days; the City Manager could file a written reply. request a public hearing or resign; and it would take a vote of four City Commissioners to vote on the resolution to remove. There were several minor technical enhancements. The Commission questioned the provision for 4 votes to remove the City Manager when it only took 4 votes to hire the person. Chairman Beatty said that the board was receptive to the maJority vote 3 out of 4 or 5. There was a question on the current contract for the City Manager and Attorney Rosenthal explained that the existing contract would not be affected. Section 3 - Chairman Beatty explained that this section provided for an Acting City Manager that would serve at the pleasure of the Commission. The Commission had no problems with this section. .. Section 4 - Chairman Beatty explained that other than minor technical enhancements to the duties of the City Manager, quarterly financial reports would be given to the Commission. annual financial reports would be continued and the City Manager would recommend the salary and wage scale for city employees to the City Commission. Review of Article V Section 1 - Chairman Beatty explained that along minor technical enhancements, they continued the strong Manager form of government. They also provided that the Manager could not serve as Police Chief or City Clerk. Commission had no problems with this section. with City City The Section 2 - This section dealt with the City Attorney and provided for appointment of and procedures for the attorney. Mayor Ison asked if the board had considered different attorneys: e.g., special legal advisor for the Police Department. Attorney Rosenthal suggested utilizing the Prosecutor section to appoint an attorney for the Police Department. The City Manager could recommend an attorney but the Commission would appoint. Section 3 - This section provided for an oath that was to be taken by every official of the City. There were comments on this section. e Section 4 - This section provided for the City Clerk. Chairman Beatty explained that they had enhanced the appointment, duties, powers, provided for a Deputy City Clerk and had made several minor technical enhancements. The Commission asked that the appointment of the City Clerk be subJect to the approval of the City Commission. There were no other comments. There were no comments on section. . Section 6 (NEW) - Chairman Beatty explained that this was a new section added to provide for a personnel system and board. Commissioner Bateman explained the personnel committee that was in place at the present time and expressed his desire to see that procedure continued. Attorney Rosenthal asked if they wanted to leave it in the Charter and the Commission indicated that they would. Chairman Beatty would meet with the appropriate people and review the current procedures. 2 . Mayor Ison stated that the regular meeting would not convene until 7:45 p.m. in order to give the Commission time to visit the Funeral Home to honor the memory of a long time resident of the City of Ocoee.
