HomeMy WebLinkAbout07-26-88 SS . MINUTES OF THE SPECIAL SESSION COMMISSION MEETING HELD ON TUESDAY, JULY 26, 1988 The meeting was called to order at 7:40 p.m. by Mayor Pro Tern Hager. Commissioner Dabbs led in prayer and the pledge of allegiance to the flag. PRESENT: Mayor Pro Tern Hager, Commissioners Johnson, Dabbs, and Bateman, City Attorney Woodson, Acting City Manager Finch, Assistant Planner Myers, City Clerk Catron, and Deputy Clerk Resnik. ABSENT: Mayor Ison and City Manager Ryan NEW BUSINESS - Approval of Change Order #4 for West Orange Transmission System Public Works Director Brenner Public Works Director Brenner explained that the requested change order was necessary to provide sewer service to the southern part of the City and that it was more cost effective to do the work now while other utility relocations were underway. He said the sewer extension would provide service in the future to several businesses along Maguire Road south of SR 50: the Colony Plaza, Village Market Shopping Center, Orange Bank, a planned health care facility, and Orange Tree Cinema and the other businesses located in that plaza. Public Works Director Brenner said it would provide the Heller Developers with partial sewer service as well. Acting City Manager Finch explained that since this request by Mr. Brenner, he had spoken with the City's consulting engineers and that they recommended that the Commission approve the authorization for Professional Engineering Consultants (PEC) to design and permit the work to be done and within that time the City could bid the project out. He said he had received an estimated cost on consultant's fees of $12,500 for the designing and permitting. e commissioner Dabbs said he wondered how staff could give the Commission two recommendations on the same night. He asked Acting City Manager Finch to provide the Commission with his recommendation since he was acting in the place of the City Manager. Acting City Manager Finch said he was not at work on the previous Friday when the packets had to go out to the Commissioners and therefore the staff report from Public Works Director Brenner went to the Commission. Mr. Finch said he was given a period of 60-90 days for PEC to design and permit the 1300-1500 foot extension of the sewer lines. He recommended that the Commission authorize PEC to begin this process and for staff to go to bid on the project. Commissioner Johnson moved to approve the recommendation for PEC to design and obtain the necessary permitting for the project and for staff to go to bid, Commissioner Bateman e Page 2 Special Session Commission Meeting July 26, 1988 seconded and upon a roll call vote, unanimously. the motion carried Acting City Manager Finch also addressed another project that was discussed at the previous City Commission meeting. Mr. Finch referred to the three bids listed in his staff report to the Mayor and Commissioners concerning the Silver Star Road/Bluford Avenue water main improvements. Acting City Manager Finch recommended that Free Piping, Inc., who had the lowest bid, be awarded the contract. Mr. Finch reminded the Commission that Free Piping was already involved with doing similar work at the intersection of Maguire Road and SR 50. Acting City Manager Finch said sufficient funds were available for the project. e City Attorney Woodson said the Commission would need to declare this an emergency item if it wanted to take action on it since it was not already on the agenda. Acting City Manager Finch said it was important that they did not lose time by waiting to put the item on the agenda for the next meeting since the Department of Transportation (DOT) would be starting its work soon. Mr. Finch recommended that the City Commission declare the item an emergency and take action on it at this meeting. Acting Mayor Hager formally declared it an emergency item. Commissioner Bateman asked for verification that funding was available. Acting City Manager Finch said he asked Finance Director Poston and that there were sufficient monies available. Commissioner Bateman moved to approve the awarding of the contract to Free Piping, Inc. with the provision that contingency monies also be set aside if needed, Commissioner Johnson seconded, and approval was unanimous. PUBLIC HEARINGS COMPREHENSIVE PLAN AMENDMENTS e CASE 01C-88, Moremen, Sheppard, Murray, and Davis Assistant Planner Myers said the property was a 27 acre parcel located south of Geneva Street and east of Chicago Avenue. She said the County presently had the land use as low density, single family residential and that the staff was recommending that a land use of medium to high density residential with one acre of commercial be approved. Assistant Planner Myers said that the Planning & Zoning Board had recommended approval of the above with a further request to make sure adequate access was provided for. Acting Mayor Hager opened the public hearing. Ellen Slessinger of the e Page 3 Special Session Commission Meeting July 26, 1988 Orange County Planning Department told the Commission that the County was opposed to the recommendation of City staff. She said the land use was inconsistent with the County's strategic plan as it extended the commercial boundary past where it was previously planned. Commissioner Bateman asked for clarification from Assistant Planner Myers as he thought the commercial would be south of Maine Street and within the area where commercial was planned. Ms. Myers said Commissioner Bateman was correct and that the commercial area was the area south of Maine Street. Ms. Slessinger apologized for her confusion and stated that the County therefore had no problems with the City staff's recommendation. e There being no further public comments, Acting Mayor Hager closed the public hearing. Commissioner Dabbs moved to approve the recommended land use, Commissioner Johnson seconded, and upon a roll call vote, the motion carried unanimously. CASE 02C-88, Anemar, Inc. Assistant Planner Myers described the property as an 8 acre parcel located south of Silver Star Road and west of Lake Street. Ms. Myers said the property's land use in the County presently was listed as rural residential. Commissioner Bateman pointed out that either the staff report or the map was incorrect as one said the parcel was 7.9 acres and one said 8.9 acres. Ms. Myers said the map was incorrect and that it was a 7.9 acre parcel. Assistant Planner Myers said staff was recommending a residential land use and that the Planning & Zoning Board had agreed with staff's recommendation. Acting Mayor Hager opened the public hearing. Dave Outlaw of Wescar, Inc. said he represented the managing partners of this property and was at the meeting to answer any questions the Commission had. Since there were no other public comments, Acting Mayor Hager closed the public hearing. Commissioner Dabbs moved to approve the residential land use, Commissioner Bateman seconded, and approval was unanimous by roll call vote. e CASE 03C-88, Yusuf Mohamad Assistant Planner Myers said this was an 8.5 acre parcel located north of Silver Star Road between Good Homes Road and Lake Johio Shores Road. The present land use under the County was stated as residential but the petitioner was requesting commercial. Ms. Myers said the Planning & Zoning e Page 4 Special Session Commission Meeting July 26, 1988 Board requested denial of the petitioner's request by a vote of 6-1 stating that there was no other commercial land use surrounding that area. Staff also recommended that the petitioner's request be denied. Acting Mayor Hager opened the public hearing. Slessinger from the Orange County Planning Department that the County agreed with City staff's recommendation deny the petitioner's request for commercial land use. Slesinger said the land surrounding this property residential. Ellen said to Ms. was Jeff Annis, 8505 Silver Star Road, Orlando, an adjoining property owner, also requested that the petitioner be denied a commercial land use because the surrounding area was residential. e Nellie Arthur, 8312 Northgate Drive, Orlando, the area, also urged the Commission to deny the request. who lives in petitioners J.D. Hammock, 3000 North Apopka-Vineland Road, Orlando, who also lives in the area, requested that the Commission deny the commercial land use. Ms. Hammock said that homes in the area are generally worth around $100,000 and that this would hurt the value of these homes. She mentioned the new development, Coventry at Ocoee, that was being built and that homes in that subdivision were selling near $100,000. Ms. Hammock said the area did not need more shopping areas since there was a shopping plaza at Hiawassee and Silver Star Road and that there were still vacant shops there. There were no other public comments and Acting Mayor Hager closed the hearing. Commissioner Bateman moved to disapprove the petitioner's request for commercial land use, Commissioner Johnson seconded, and approval was unanimous by roll call vote. e CASE 04C-88, Wayne Atwood Assistant Planner Myers described the 53 acre parcel Lake Johio and west of Johio Shores Road. Ms. Myers petitioner was requesting a residential land use and existing areas were also residential. Commissioner Bateman asked Mr. Atwood if he had any problem with the City's plans for Clark Road. Mr. Atwood said he knew of the City's plans for Clark Road and was willing to work with the City on specifics. Since there were no other comments, Acting Mayor Hager closed the public hearing. Commissioner Johnson moved to approve the residential land use, Commissioner Bateman seconded, and approval was unanimous by roll call vote. CASE OSC-88, Lake Blanchard Partnership Assistant Planner Myers described the property as a 16 acre parcel located north of Lake Blanchard, south of Maine Street and east of Chicago Avenue. Ms. Myers said the petitioner requested a commercial land use and that it was presently classified as high density residential. She said under the City's land use plan it had been planned for commercial. The Planning & Zoning Board unanimously recommended approval of the request, provided that the street network was maintained. e Acting Mayor Hager opened the public hearing. Bruce Milray, representing the petitioner, said the petitioner was already committed in the Developer's Agreement to continue the street network. He requested approval of the commercial land use. There being no other comments Acting Mayor Hager closed the public hearing. Commissioner Dabbs moved to approve the commercial land use, Commissioner Bateman seconded, and approval was unanimous by roll call vote. CASE 06C-88, E. H. Crow Assistant Planner Myers described the property as a 10 acre parcel located south of Marshall Farms Road and east of Windermere Road. She said the Heller tract was directly east. Staff recommended that the petitioner's request be approved. The Planning & Zoning Board recommended approval of the residential land use as well. Acting Mayor Hager opened the public hearing. Ann Crow, who owns the property along with her husband, said she was at the meeting to answer any questions. She requested approval of their request and said the residential land use was consistent with the Heller property. e There being no other public comments, Acting Mayor Hager closed the public hearing. Commissioner Dabbs moved to approve the residential land use, Commissioner Johnson seconded, and approval was unanimous by a roll call vote. CASE 07C-88, Roger Freeman Assistant Planner Myers described the property as an 11 acre e Page 6 Special Session Commission Meeting July 26, 1988 parcel located west of Ocoee-Apopka Road and approximately 1320 feet north of Palm Drive. Ms. Myers said the petitioner was requesting industrial land use and planned to develop the property for light industrial in the future. The Planning & Zoning Board recommended that approval be granted for the industrial land use. Staff also recommended approval of the petitioner's request. Acting Mayor Hager opened the public hearing. Roger Freeman, 151 W. Silver Star Road, requested that the industrial land use be approved and said he was at the meeting to answer any questions the Commission had. . Ellen Slessinger of the Orange County Planning Department said the County recommended denial of the petitioner's request for industrial land use. Ms. Slessinger said it was inconsistent with other zoning in the area. Commissioner Johnson asked Ms. Slessinger if she had been out to look at the area. Ms. Slessinger said she had not. Commissioner Johnson said that there was a funeral home and other businesses in the area and that not many homes remained. He suggested that she visit areas before making recommendations. There being no other comments, Acting Mayor Hager closed the public hearing. Commissioner Bateman moved to approve the industrial use, Commissioner Johnson seconded, and approval unanimous by roll call vote. land was CASE 08C-88, Roger Freeman Assistant Planner Myers described the property as a 5 acre parcel located east of Ocoee-Apopka Road approximately 900 feet north of Silver Star Road. Ms. Myers said the petitioner was requesting industrial land use and staff recommended approval of the request. The Planning & Zoning Board recommended approval of the industrial land use by a 4- 3 vote. e Acting Mayor Hager opened the public hearing. Roger Freeman, 151 W. Silver Star Road, said he again requested his petition be approved and that he did not feel that the land could be used for residential purposes. Ellen Slessinger, representing Orange County, said the County wanted to go on record as recommending denial of the request since it felt the land use would be inconsistent with the surrounding area. Commissioner Bateman reiterated Commissioner Johnson's comment to Ms. Slessinger that the County should go and physically look at the area to see that it would not be inconsistent with what was there. There being no other e Page 7 Special Session Commission Meeting July 26, 1988 comments, Mayor Hager closed the public hearing. Commissioner Johnson moved to approve the industrial land use and Commissioner Bateman seconded. Commissioner Dabbs questioned Acting City Manager Finch on the buffer zones that would be necessary since the property abuts a mobile home park. Acting City Manager Finch said he was sure a buffer would be needed but was unsure as to the amount. Assistant Planner Myers said she thought it was between 10-20 feet. Commissioner Johnson moved to approve the industrial land use, Commissioner Bateman seconded, and approval was unanimous by roll call vote. Commissioner Dabbs approved the industrial land use with reservation. e CASE 09C-SS, Pearl Terry Assistant Planner Myers described the property as a 20 acre parcel located south of Geneva Street and east of B.C. Terry Road. Ms. Myers said the present land use in the County called for low density residential and that the petitioner was requesting a residential land use. The Planning & Zoning Board unanimously recommended approval of the request. Acting Mayor Hager opened the public hearing. Lou Raeder, agent for Pearl Terry, said he was at the meeting to answer any questions the Commission had. Since there were no public or Commissioner comments, Acting Mayor Hager closed the public hearing. Commissioner Dabbs moved to approve the staff recommendation of residential land use, Commissioner Bateman seconded, and approval was unanimous by roll call vote. CASE 10C-SS, Phoenix Development Group Assistant Planner Myers described the property as a 196 acre tract located at the southern most edge of the City. She said the petitioner was requesting that 173 acres be approved for residential land use and 23 acres for commercial land use (the commercial to be at the southern edge of the property) . Staff recommended approval of residential and commercial land uses with the provision that the portion outside the Joint Planning Area (JPA) be approved upon amendment of the Joint Planning Area Agreement with Orange County. The Planning & Zoning Board recommended approval subject to the JPA being amended. e Acting Mayor Hager opened the public hearing. Lou Raeder of Phoenix Development Group said he was at the meeting to answer any questions for the Commission. Ellen Slessinger, Orange County Planning Department, said the County requested denial of this request for high density residential and commercial land use because it would e e e Page 8 Special Session Commission Meeting July 26, 1988 negatively impact the surrounding area. Ms. Slessinger said under the present County land use the property was planned for two-acre lots. She also said the unavailability of services to that area would create a problem. Vera Carter, County Commissioner and resident of the Windermere area, said she had seen the Ocoee City Commission respond to its neighbors and friends in the past when they had requested denial of multi-family housing and that she hoped they would again deny the high density residential for this area. Commissioner Carter said she was not concerned with the growth of Ocoee, but was concerned with the City putting different densities and land uses where they were not appropriate. She also asked the Commission to consider what impact a shopping center at this site would have on existing Ocoee businesses along SR 50. Commissioner Carter also asked the Commission to consider the impact that the additional traffic would have on Maguire Road. She said she was concerned with the quality of life in west Orange County and that many people wanted it to remain rural. She asked that the Ocoee Commissioners not give in to the pressure of developers who want approvals granted before they annex into the City. She concluded by stating that as a resident of the area she wanted to see low density residential in this specific area. Debra Abbuhl, 10555 Gotha Road, Windermere, told the Commission that she bought a home in Gotha for the rural atmosphere and that she was concerned with the traffic that high density residential and commercial development would bring in. She asked the Commission to deny the petitioner's request. R.P. Mohnacky, 1820 Prairie Lake Boulevard, was concerned that if the Commission eliminated the high density residential, they would have to locate that type of housing elsewhere in the City. Mr. Mohnacky said he would rather see it go where it was planned for in the first place. He asked whether or not the Commission was interested in obtaining federal funds and said he thought that the City needed to have a certain amount of high density residential to qualify for those monies. James Ferdinand, a principal in the Phoenix Development Group, said he had not heard any objections to the project for two years and that the people at the meeting were not Ocoee residents. Dr. Ferdinand said the staff and the Planning & Zoning Board both recommended approval of the requested land use and County Commissioner Marston had only a - Page 9 Special Session Commission Meeting July 26, 1988 minor problem. Dr. Ferdinand said the project would help the City's utility plans, add to the City's tax base, and provide recreational space for City residents. He said that the area was not rural in nature and that some property adjacent to this property was already multi-family. He said his company had hired a firm to do a traffic study and that the study showed that there would not be a traffic problem caused by this project. Florence Johnson of Gotha approached the Commission and asked that the petitioner's request be denied. She also was concerned about keeping the area rural. e There being no other comments, Acting Mayor Hager closed the public hearing. Commissioner Bateman moved to approve the staff's recommendation for a residential and commercial land use, and Commissioner Johnson seconded. Commissioner Bateman said he appreciated the comments from the individuals who had spoken against the petitioner's request. He said he does not feel that Ocoee has experienced the growth that people think. He said that in his four years on the Commission, there have been less than 400 new residences built and that the commercial building had been mostly the "town square" type such as the Walmart plaza. Commissioner Bateman said he took his own survey outside of Walmart when he was registering voters with the Kiwanis Club. He said he asked people where they were from as they went into Walmart. He found that three out of ten people were from Windermere and three out of ten people were from Lake County. Therefore, six out of ten people were from somewhere other than Ocoee. Commissioner Bateman said he felt this proved there was a need for shopping centers such as the Walmart plaza and that something like a Goodings, Publix, or home or office supply store would be helpful to the residents of West Orange County. He said he had no concern for Maguire Road and felt that the traffic generated would not create a problem. Commissioner Bateman said he did not see the growth that everyone seemed to be so concerned with. He said he thought that the West Orange County area could use some good restaurants instead of having to travel to International Drive. . Commissioner Dabbs had a few questions for the developer. He said that they had mentioned that Commissioner Marston had a suggestion or a minor problem and asked what it was. Dr. Ferdinand said Commissioner Marston wanted a buffer zone using one acre lots at the eastern and southern portions of e Page 10 Special Session Commission Meeting July 26, 1988 the property. Commissioner Dabbs also wanted to know who did the traffic study that they referred to. Dr. Ferdinand said C.C.L. Consultants did the study and that Martin Kreidt did the demographic data. Commissioner Johnson asked Commissioner Carter what the County planned on doing for Maguire Road since the Belmere Project would 'affect traffic in the area. Commissioner Carter said that the density was the key and that Belmere was planned as a single family residential area that would not produce as much traffic as a high density, multi-family project. Commissioner Carter mentioned the road improvements that the County was presently working on. She again said the issue was density and that the City should not approve a shopping center or high density housing where the people do not want it. Commissioner Carter said that the developer was not interested in building this project for the City of Ocoee, but that it was being built to serve Windermere. e Commissioner Bateman said the County had done a great job on the Silver Star Road construction and thanked Commissioner Carter and the other County Commissioners for their work to improve the roadways in Orange County. Acting vote. Mayor Hager restated the motion and called Upon a roll call, the vote was unanimous. for the CASE 11e-SS, Lake Lotta, Ltd. Assistant Planner Myers described the property as a 238 acre parcel located between SR 50 and White Road on either side of Clark Road. Ms. Myers said the property was planned for high density and single family residential but the staff's recommendations were consistent with the petitioner's request for 220 acres of residential and 18 acres of commercial. The commercial would be the property fronting SR 50. The Planning & Zoning Board recommended approval of the City staff's recommendation. Acting Mayor Hager opened the public hearing. Steve Fieldman, attorney representing Lake Lotta, Ltd., said that Clark Road would split the Lake Lotta property. He said the County planned high density residential for the property fronting SR 50 but that the petitioner felt commercial land use would suit the area better. tit Ellen Slessinger, Orange County Planning Department, said the County was requesting denial of the commercial land use because of the traffic it would bring to the area. She said commercial land use would generate more traffic than a high density residential land use would. - Page 11 Special Session Commission Meeting July 26, 1988 R.P. Mohnacky, 1820 prairie Lake Boulevard, repeated his earlier concerns that if the City did not put the high density residential there as it planned, then it ~ay need to be put in a less desirable location in the future. There were no other public comments and Acting Mayor Hager closed the public hearing. Commissioner Bateman asked Steve Fieldman if he had discussed the east-west connector roads with staff. Mr. Fieldman said they were waiting on the City to make a decision on the roads and that they are prepared to work with the City and are open to almost anything. He said they were neutral as far as cost was concerned and were most interested in the City making a decision. e Commissioner Bateman said he was most interested in knowing that there would be some east-west connector roads, especially to the west. Mr. Fieldman said they had agreed to do connector roads. Commissioner Bateman asked Mr. Fieldman whether the people he represented would be receptive to the realignment of White Road where the bad curve exists because of a sink hole. Commissioner Bateman said he would like to see the sink hole bridged and the road straightened out. Mr. Fieldman said he thought they would agree to that and said he would discuss it with the principals involved. Commissioner Bateman moved to approve the Lake Lotta commercial and residential land uses, Commissioner Johnson seconded, and approval was unanimous by roll call vote. Commissioner Dabbs asked when the issue of rezoning would be addressed. Assistant Planner Myers said the rezoning matters would take place on August 23. CASE 12C-88, Jeffrey Yeager Assistant Planner Myers described the property as a 25 acre parcel located directly east of the Lake Lotta project. Ms. Myers said the petitioner was requesting 16.5 acres of medium commercial land use and 8.5 acres of light commercial (professional services) at the northern edge of the property. The Planning & Zoning Board unanimously recommended approval of the request. e Acting Mayor Hager opened the public hearing. Steve Fieldman, representing the principals for the Yeager property, said they first met with Rose Hill subdivision homeowners and suggested a medium to high density residential land use (townhouses) and then suggested professional offices. Mr. Fieldman said they were willing to go either way. They also instituted their own traffic study to see what affect an east-west road would have on Good Homes Road. Mr. Fieldman e e . Page 12 Special Session Commission Meeting July 26, 1988 said they were neutral economically and were very willing to work with the City and the adjacent homeowners. Commissioner Dabbs asked Mr. Fieldman who they had to do their traffic study. Mr. Fieldman said he had discussed with PEC who to use and they used Jim Lee a traffic engineer. Commissioner Dabbs said he wanted to see an east-west road more north on this piece of property. Commissioner Bateman said the road would make a good buffer between the Rose Hill homes and the development of this property. He said also that an east-west road would take people to Good Homes and then onto SR 50 rather than having another road directly to SR 50. There being no other comments, Acting Mayor Hager closed the public hearing. Commissioner Dabbs moved to approve the commercial and professional land use, Commissioner Bateman seconded, and approval was unanimous by roll call vote. CASE 13C-88, Michael & Barry Goodman Assistant Planner Myers described the property as a 9 acre parcel located south of SR 50 and east of Lake Lotta. The petitioner was requesting commercial land use but staff cautioned this use since the property was not at an established intersection and the property was also surrounded by property owned by a church. The County and City's West SR 50 Study proposed that a high density residential land use be approved for this area. Ms. Myers said that the Planning & Zoning Board unanimously recommended a residential land use be approved. Acting Mayor Hager opened the public hearing. Steve Fieldman said that the Planning & Zoning Board was not unanimous in its decision but that two members had voted for a commercial land use. (Minutes of the Planning & Zoning Board Meeting showed that Harold Swickerath and Burton Smith voted against the residential land use.) Mr. Fieldman said that there was an intersection on the property at Cemetery Road and SR 50. He said the problem with the staff's recommendation was that they did not include Cemetery Road in their decision and that the staff assumed that the church would not sell the property in the future. Mr. Fieldman said he disapproved of the residential land use because the parcel was only 9 acres and they did not believe they could build a top-notch high density residential complex on that small of a site. He said they felt it was most appropriate for commercial land use. Mohnacky, 1820 Prairie Lake Boulevard, said he again wanted to voice his concerns that the City was taking away a lot of the high density residential land use areas it had planned and he thought that some time in the future the City would have to find somewhere in the City limits to put high density housing and that it might end up in a less desirable location. - There being no other comments, Acting Mayor Hager closed the public hearing. Commissioner Bateman asked City Attorney Woodson if it was possible to make a motion for a land use and put a fixed date on when it must be developed in that manner. City Attorney Woodson said it was not possible to make such a motion and that if the City Commission wanted to change the land use in the future, it would have to vote on it again then. City Attorney Woodson reminded the Commissioners that anything they did this evening could be changed since it was only the first public hearing. Commissioner Bateman supported the petitioner's request for commercial property and agreed that the church may decide to sell the property. Commissioner Dabbs asked how far Cemetery Road was from Good Homes Road since he felt the Good Homes Road was already a dangerous intersection and putting another one too close would make it more so. Steve Fieldman said he thought it was about 660 feet. Mr. Fieldman also asked whether a time limit on developing for commercial purposes could be put in the Developer's Agreement. Attorney Woodson said that could be addressed in the Developer's Agreement. commissioner Bateman moved to approve a commercial land use and Commissioner Johnson seconded. Upon a roll call vote Commissioners Johnson and Bateman voted to approve the motion, and Commissioner Dabbs voted against. Mayor Pro Tern Hager voted for the motion for commercial land use. . CASE 14C-88, Reformed Presbyterian Church Assistant Planner Myers described the property as a 5 acre parcel located north of White Road approximately 1/8 mile east of Clark Road. Ms. Myers said the property was surrounded by residential and vacant land. The Planning & Zoning Board recommended unanimously to approve the petitioner's request. . Commissioner Dabbs moved to approve the residential land use, Commissioner Bateman seconded, and approval was unanimous by roll call vote.
