MINUTES OF THE OCOEE CITY COKKISSION WORKSHOP SESSION HELD
SEPTEMBER 22, 1988
In the absence of Mayor Ison, Mayor pro tem Hager called the meeting to order at
7:12 P.M.
Present: Commissioners Bateman, Dabbs, Hager, and Johnson. Also present were:
City Manager Ryan, Assistant City Manager Finch, Assistant City Attorney Woodson
and City Clerk Grafton.
Absent: Mayor Ison.
Mayor pro tem Hager declared a quorum present. Commissioner Dabbs led in the
prayer and the pledge of allegiance to the flag.

Presentation: Master Transportation Plan
P.E.C. representatives Robert Campbell and Ron Andrews were present to discuss
the Master Transportation Plan - Traffic Circulation Study their firm had
prepared. Mr. Campbell stated this study as being two-fold: first to satisfy 9J5
of Florida Statutes and, second, to provide a basis for impact fee concept that
had been chosen for funding. Impact fees involve 2 funding mechanisms,
improvement level driven system and service level driven system. The improvement
level system is the one that has been court tested, seemed to satisfy the
conditions of the state statutes better and would be appropriate for growth
management studies. The purpose of this study is to provide the basis for an
impact fee ordinance, projected for December of this year. Attorney Woodson
stated he liked the improvement level study because there was court precedent and
it was understandable. Mr. Campbell stated that the statutes require a number of
things, including a data base of existing systems, knowledge of the quality of
service being provided and ygy IllI:l.St. isolation of the times of existing problems
in terms of traffic operations and public safety. Also required by statute is
an analysis of the system, projection of needed roadway system and method to fund
projects, and determination of the City's policies and goals.
A copy of the Traffic Circulation Study prepared by P.E.C. was reviewed page by
page for the Commission by Mr. Campbell.
The report stated the City would need about 36 new lane miles of roads at the
cost of $17,000,000.00. Some of this money can be expected from D.O.T. Staff or
consultant would have to keep up with what D.O.T. is doing. Another way to fund
the $17,000,000.00 would be through Developer's fees. Impact fees are the third
way of funding. Last of the options would be general revenue. Attorney Woodson
reported that the land use map must be updated to produce an accurate recitation
of the numbers necessary for this report.
The Commission discussed the possibility of options and trade-offs on specific
roads. Since impact fees cannot be used to correct existing problems, the
Commission was concerned with very recent growth that contributes to the
problems. Attorney Woodson said the impact fee ordinance is tied to certificates
of occupancy and this fact could be incorporated in the subsequent report to be
prepared by P.E.C.

Attorney Woodson called attention to the fact that impact fees must be spent in
the area they are collected from. If funds will be targeted for certain areas of
the City where traffic will benefit from the improvement, it is likely that

citizens in other parts of the City may raise objections. He suggested that in
the five year plan, the first set of improvements to be made, it may be wise to
spread the money around rather then spending it all in one place. That would
help legally and would help get the impact fee adopted in the first place.
Mr. Campbell mentioned that Ocoee is not alone in the growth and related problems.
Generally, the tri -county area is experiencing the same problems in only slightly
varying degrees.

Commissioner Bateman moved, Commissioner Dabbs seconded, the meeting adjourned
at 8:38 P.M. Motion unanimously carried.

We, the undersigned commissioners of the City Commission of the
City of Ocoee, Florida do hereby waive the requirement for calling
of a special meeting and hereby call for a special meeting to be
held immediately following the workshop meeting of 7:00 p.m.
Thursday, September 22, 1988, called for the purpose of discussion
and possible action, if necessary, on two items:
1. Should the required fee for a Board of Adjustment hearing be
waived for Mrs. Kelly?

2. Should building permit fees and sewer connection fees be
waived for the West Orange Girls Club, or have they already been
waived?
