KINUTES OF THE oeOEE CITY COMMISSION SPECIAL SESSION HELD SEPTEMBER 22, 1988 The Special Session of the Commission of the City Ocoee was called to order by Mayor pro tem Hager at 8:39 P.M. Present: Commissioners Bateman, Dabbs, Hager and Johnson. Also present were City Manager Ryan, Assistant City Manager Finch, Assistant City Attorney Woodson and City Clerk Grafton. Absent: Mayor Ison Mayor pro tem Hager dispensed with the prayer and pledge of allegiance to the flag. Waiver of Board of Adjustment fee for Krs. Kelly Ms. Frances Kelly, one of Ocoee' s senior citizens, has property located on Lakewood Avenue. The only way she can obtain redress for her non-conforming usage for her building would be to go to the Board of Adjustments. The advertising fee for this procedure is $250.00. This would appear to be a burden on this lady. ci ty Manager Ryan asked the Commission to consider reimbursing the fee with some kind of dispensation, since she has already paid it. Commissioner Bateman favors waiving the fee as it appears she is the victim of circumstances. Commissioner Bateman moved that a waiver be effected by the City Manager as expeditiously as possible. Commissioner Johnson seconded the motion. Motion carried unanimously. Mrs. Kelly will now go before the Board of Adjustment. If she does not receive permission, she will, if she decides to appeal, return to the Commission for a final decision. City Manager Ryan pointed out that he had discussed this matter with Attorney Rosenthal, who found no problem with a waiver. Commissioner Johnson remembered that Mrs. Kelly and her husband had given land to the City for the road and he considers her current dilemma a travesty. City Manager Ryan reported that Mrs. Kelly had been told she could continue with her building's non-conforming usage, but with a very tight reading of the ordinance, she was forced to take the Board of Adjustment route. West Orange Girls Club City Manager Ryan reported that the West Orange Girls Club is expanding and they are building two restrooms in the outfield area. They are participants of the wastewater system for the Old Industrial Park that has now been merged with the other system. The restrooms are used only sparingly during the year, when they have softball, so it is not a year round activity. It is the staff's position that would be typical use that is continuing on with its present use and would not indicate a need to charge an additional sewer connection fee. Further, this is a not-for-profit organization, and staff would like to waive the building permit fee. A reaffirmation of the staff's position regarding sewer connection charges is necessary. . . . Page 2 Ocoee City Commission Special Session September 22, 1988 Commissioner Johnson moved in favor of the waiver of fees for the Girls Club. Motion seconded by Commissioner Bateman. Commissioner Bateman amended the motion to request the City Manager to sent a letter of confirmation to the Club Treasurer, citing the cost that has been waived to be considered as a donation from the City of Ocoee to the West Orange Girls Club.
