Present: Mayor 1son, Commissioners Bateman, Dabbs, Hager and Johnson. Also present Assistant City Attorney Woodson, City Manager Ryan and City Clerk Grafton. Absent: None The Mayor led in the prayer and the pledge of allegiance to the flag. Continuation of Public Hearings from September 19, 1988 City Manager Ryan read Ordinance 88-30, as second reading by title only. Mayor lson opened the Public Hearing. There was no public comment. Public Hearing closed. The adoption of Ordinance 88-30 was moved by Commissioner Dabbs, seconded by Commissioner Hager. Motion to amend Ordinance 88-30 by adding Section 4:"This Ordinance shall take effect immediately upon its final passage and adoption.", seconded by Commissioner Johnson. Amendment passed by unanimous vote. Roll call vote: Hager, "aye", Bateman, "aye", Dabbs, "aye" and Johnson, "aye". Roll call vote on the main motion to adopt Ordinance 88-30 as amended: Hager, aye, Bateman, aye, Dabbs, aye and Johnson, aye. City Manager Ryan read Ordinance 88-31, as second reading by title only. Mayor lson opened the Public Hearing. There were no public comments. Public Hearing closed. Upon motion of Commissioner Johnson, seconded by Commissioner Hager, Ordinance 88-31 was adopted. Motion of Commissioner Dabbs, seconded by Commissioner Bateman, to amend Ordinance 88-31 to add Section 2: "This Ordinance shall take effect immediately upon its final passage and adoption." and correct line 3: "made a part hereof be reference", rather than:"made a part of by reference". Amendment passed unanimously. Roll call vote: Johnson, "aye," Dabbs/aye,"Bateman, "aye," and Hager,'" aye'~ Motion to adopt Ordinance 88-31 as amended, adopted unanimously. MINUTES OF THE OCOEE CITY COMMISSION SPECIAL SESSION HELD SEPTEKBER 27, 1988 Mayor Ison opened the meeting by explaining that there are two developers trying to work out changes in the City Developer Agreement. The City Clerk has prepared a waiver, which is one way this can be done. There is an executed Developer's agreement with Wescar and an approved agreement with Pul te Homes. There is also an addendum in accord with direction from the Commission at the last meeting. City Manager Ryan recounted the history of this project. At the last meeting there was discussion about the roadway now known as Lake Olympia Drive, concerning taking some corner clips and the right-of-way allocation from the design of the road. The City had a 50 foot dedication from Wescar and 36 foot Dedication from Hawthorne Pulte Group and the City Commission directive was for a 50/50 cost bearing for road construction. The disagreement seemed to be over the road design and level improvements. Staff felt if they could agree with a compromise with the developers, it would work out appropriately. It could be accomplished with the two easements as granted, plus an additional 5 foot easement from Hawthorne to be used as a buffer. Good engineering techniques could work out the left turn lane at Silver Star, and left turn lanes into the commercial areas. Road design extending the taper, going south of entrance to Pulte needs broadening, and the location of entrance into Pulte and entrance into Wescar are off center. If the entrances were realigned, the Wescar tract would only be subject to City approval. Wescar had committed to constructing a wall on the property. Pulte, in compromising, is now building this $10,000.00 wall. Attorney Woodson pointed out that the agreement does a lot of things to Wescar. Although the agreement reads fine, until the City has an agreement with Wescar that reflects the same thing this agreement does, it is going to be very difficult for the City to enforce or require Wescar to do things this agreement says. Mr. Geys (Wescar) agreed to sign a revised Developer's Agreement. Mayor Ison commented that if Mr. Geys will sign the revised agreement and the Hawthorne Pulte group will sign a counter document between the two developers agreeing, in substance, to the materials presented tonight, the Commission could act on this tonight, subject to received countersigned agreements. 11\,,1:'> Commissioner Johnson, seconded by Commissioner Dabbs,~to execute the amended Developers' Agreement, Case # 09R-87, dated September 28,1988, subject to subsequent amendment to the Wescar Agreement to reflect the changes as shown in the Hawthorne Agreement, as well as the agreement between Wescar and Hawthorne, within 30 days. Subject to review and approval of City Manager and City Attorney. Motion carried unanimously. . . . Page 2 Ocoee City Commission Special Session September 27, 1988 Representatives of Wescar and Hawthorne Pulte thanked the City Manager and the Commission for their efforts. Mayor Ison announced that the Department of Community Affairs has granted the requested extension for submitting our comprehensive plan. Mayor Ison will sign it.
