MINUTES OF THE CITY COMMISSION SPECIAL SESSION HELD ON MONDAY,
NOVEMBER 7, 1988
Mayor Ison called the meeting to order at 7:00 P.M. in the commission chambers
and led in the prayer and the pledge of allegiance to the flag.
PRESENT: Mayor Ison, Commissioners Bateman, Dabbs (arrived late), Hager and
Johnson. Also present were Acting City Manager Finch, Assistant City Attorney
Woodson, Planning Director Behrens, Senior Planner Harper and City Clerk Grafton.

SPECIAL STAFF REPORTS:
Hackney Prairie Shores
Acting City Manager Finch requested direction from the Commission on this
development since the nearest sewer is one mile away. Staff recommends approval
of septic tank for the area. The Developer Agreement envisioned septic tank
service for this property. Commissioner Hager stated that the County would
enforce the septic provisions and would provide adequate protection for the
surrounding properties. Mayor Ison reminded the Commission of its commitment to
provide sewer service to commercial properties and secondly to lake properties.
This development fell into neither category and is a candidate for septic tank
service. The Commission agreed to allow the Developer Agreement to stand on its
own and utilize septic tanks.
Geneva Manor Subdivision
Acting City Manager Finch presented the plat for this one lot subdivision.
Planning and Zoning Commission recommended approval of the plat. Of the eight
items on the staff report, the Developer does not agree with the following: The
5% recreational assessment, 10 foot utility easement on the front of the
property, requirement of a sidewalk being constructed across the front of the
property, and a water line extension issue. Mayor lson recalled the original
discussion on the water line that would go along Lakewood Avenue to the
easternmost property line, this would be supplied by the developer and would be
oversized. This was contrary to the Developer's memory of a stub at the front of
the property. The Mayor indicated a pro rata share (based on front foot charges
to future owners) of this line from the westernmost boundary of Lot 1 to Lakewood
Avenue, to be paid by future development, seemed a fair arrangement. Regarding
the 5% recreational assessment, Commission consensus was to waive this
requirement providing the property remained a single family development. No
action can be taken on the utility easement since it is required by ordinance.
Mayor Ison advised that he has requested direction from the Building Department
regarding requiring that all homes be provided sidewalks. Commissioner Bateman
wants to see sidewalks on Geneva Street, on the south side preferably. The Mayor
requested and received support for the sidewalk requirement. To summarize, the
recreational fee was waived, the owner would put in the sidewalk, put an 8" water
line from the easterlymost portion of the property down to Lakewood Avenue, and
from the westerlymost portion down to Lakewood Avenue. An agreement will be
worked out with the owner so that when the money is collected from other users
in that area, the cost, prorated, will be refunded.
PROPOSED ORDINANCES - FIRST READING - Second Reading and Public Hearings are
Scheduled for November 22, 1988.

Acting City Manager Finch mentioned transmittal of the comprehensive plan and
comments from the State. Mayor Ison requested that Mr. Finch respond to D.O.T.
in a positive manner, stating specifics for each case regarding funding, etc.

Lake Lotta, Ltd. Petition
Plan Amendment Ord. No. 88-57 (Case No. 11C-88) and Rezoning Ord. No. 88-58 (PUD)
(Case No. 14R-88) read by title. Commissioner Bateman reminded the Commission
of White Road and other east/west road conditions and requested that the Minutes
of July 26, 1988 be cited as evidence of the owners' willingness to work with
City.

by title. Attorney Woodson indicated a correction in the legal description in
Ordinances 88-61 and 88-62. In the second sentence of second clause of legal

Barry and Michael Goodman Petition (Davis, Ogilvie & Pitchford)
Plan Amendment Ord. No. 88-63 (Case No. 13C-88) and Rezoning Ord. No. 88-64 (Case
No. 16R-88) read by title. Commissioner Bateman asked that staff review this C-1
or C-2 difference. In this particular instance with less than nine acres, a C-1
classification would allow this thing to spread considerably. Mr. Bateman stated
that it was his understanding along that this was C-2 and he would like a staff
recommendation on whether this should be C-1 or C-2. Steve Fieldman reported
that his owners are attempting to expand the parcel by acquisi tion of surrounding
parcels. The owners had requested C-2 but staff had recommended
C-1. If the parcel is expanded, the owner intends to ask for C-2. The Commission
discussed traffic problems in this immediate area. Mayor Ison requested a follow
up before the second reading.
Mayor Ison discussed a Highway 50 study done by Orange County and, in some way
reflected in the above actions. He clearly stated that Ocoee did not endorse
that study, the City did not participate in that study, the City has not publicly
acknowledged agreement with any item of that study. Some of the correspondence
to the City and to Tallahassee appears to say that Ocoee was in agreement with
that study. Mayor Ison indicated he would like to see anywhere between Hiawassee
and Union Park where the County has done anything like was stated in the study.
DOT will be notified. Commissioner Bateman reminded the Commission that Ocoee
has developers using frontage roads. Ocoee is developing a first in Orange
County frontage road concept from Good Homes to Bluford.
Reformed Presbyterian Church Petition
Plan Amendment Ord. No. 88-65 (Case No. 14C-88) and Rezoning Ord. No. 88-66 (Case
No. 17R-88) read by title. By letter of November 4, the owners had requested a
change to A-2. The change to A-2 was denied, property will be R1-AAA as
originally requested.

The Canvassing Board will meet on Wednesday at 12:00 in the City Manager's
Conference Room.
