MlNUTBS OF OCOBE CITY COMMISSION REGULAR MEETING HELD MARCH 7, 1989 The regular meeting of the Ocoee City Commission was order at 7:31 p.m. by Mayor Pro Tern Dabbs in the chambers. Commissioner Hager led in the prayer and allegiance. called to commission pledge of PRBSENT: Mayor Pro Tern Dabbs, Commissioners Combs, Hager and Johnson, City Manager Shapiro, Planning Director Behrens, Public Works Director Brenner, Wastewater Supervisor Holland, and City Clerk Grafton ABSENT: Mayor Ison (out of town) Mayor Pro Tern Dabbs explained the petition against unfunded state mandates forms that are available on the entry table and requested that citizens in the audience take advantage of the opportunity to sign one. Upon a motion by Commissioner Combs and second by Commissioner Hager, the Consent Agenda was unanimously approved as presented. The Consent Agenda consisted of: A. Regular Commission Meeting Minutes of February 21, 1989, and B. Commission Workshop Minutes 4It of September 20, 1988. OLD BUSINESS Impact Fee Clarification - Mrs. Donna Zielinski Mrs. Donna Zielinski had appeared before the commission at the last meeting to protest the transportation impact fee about to be imposed on the proposed additions to her home and was asked to return at this meeting for a decision. City Manager Shapiro explained that the ordinance as it is written triggers impact fee on any building permit but that City Attorney Rosenthal had advised that the county does not require the impact fee for an addition to a residential structure. Mr. Rosenthal advised that there is nothing to prevent commission from amending the ordinance to exclude residential additions from the imposition of the fee if they should wish to. Although a formal vote was not taken, the consensus was that residential additions should be excluded from the transportation impact fee, thus Mrs. Zielinski would not be charged the fee for the addition to her home. . SECOND READINGS AND PUBLIC HEARINGS ORDINANCB NO. 89-02, TRANSPORTATION IMPACT FBE City Manager Shapiro read the title only of Ordinance No. 89-02, Transportation Impact Fee, and the public hearing was opened. Mr. R.P. Mohnacky, 1820 Prairie Lake Blvd, Ocoee, asked why the fee for over 200,000 sq. ft. was less than 100,000 sq. ft.. City Manager Shapiro explained that on that chart the amounts were cumulative. Mr. Mohnacky expressed concern that this fee might be challenged as the recently adopted occupational license fees had been and he was assured that homeowners associations and e Page 2 City Commission Regular Meeting March 7, 1989 developers had an opportunity for input and the fees represent the needs of the community at this time. The public hearing was closed without further comment from citizens. Mayor Pro Tern Dabbs called for a motion to either adopt or amend the ordinance, explaining that if the commissioners wanted the additions to residences impacted by the fee to leave it as it is. Each commissioner present expressed a desire to exempt additions to residences for different reasons. Commissioner Combs moved to table Ordinance No. 89-02 until March 21 regular meeting and to instruct the city attorney to make the ordinance whole with the expressed desires of the commission, i.e., to exempt additions to residences from the transportation impact fee. Commissioner Johnson seconded the motion. Motion carried with a roll call vote as follows: AYES: Commissioners Combs, Hager, Johnson, Dabbs NOES: None e ORDINANCE NO. 89-03, DEANNEXATION OP BARNETTE PROPERTY City Manager Shapiro read the title only of Ordinance No. 89-03, Deannexation of the Barnette Property. The public hearing was opened at 7:58 p.m. and, as there were no comments from citizens, the hearing was closed. Commissioner Hager moved to adopt Ordinance No. 89-03, Deannexing the Barnette Property. Commissioner Johnson seconded the motion. The motion to de annex carried with the roll call vote as follows: AYES: Commissioners Combs, Hager, Johnson, Dabbs NOES: None BOWNESS ROAD UPDATE - PUBLIC WORKS DIRECTOR BRENNER Public Works Director Brenner reported that the clearing and grubbing for Bowness Road is underway and everything is on schedule and going fine. COMMENTS FROM CITIZENS/PUBLIC - Mr. Mohnacky said that the commissioners should even up the length of the meetings as this one is very short and the next one will be very long. He also said that a commissioner should attend the Planning and Zoning meetings as he feels that the City Commission is not getting the idea of the opinions of the Planning and Zoning Board. Mr. Mohnacky asked who he should contact regarding posting "No Parking This Side of Street" signs. Mayor Pro Tern Dabbs stated that he would appoint Mayor Ison a committee of one to even up the length of the meetings, that the Planning and Zoning Board is an advisory board and the presence of a commissioner there would serve to hinder the free flow of conversation needed to work out the plans, and the Pire/Police/Street departments should be notified regarding the need for parking signs. ~ e Page 3 City Commission Regular Meeting March 7, 1989 UNUSED REQUBST-A-RIDE TICKETS TO BE REPUNDED Commissioner Combs moved to refund the purchase price of Request-A-Ride tickets that citizens were unable to use due to termination of the service. Commissioner Hager seconded motion and the vote was Commissioners Combs and Hager, and Pro Tem Dabbs, Aye. Commissioner Johnson was away from the at the time the discussion was held and the vote was taken. carried with majority vote. any the the Mayor table Motion REPORTS AND INPORMATION - CITY MANAGER Selection Process-Competitive Negotiations Act City Manager Shapiro presented a selection process for engineering firms. Commissioner Hager moved to adopt the selection process as presented to be used by the City and to appoint Commissioner Dabbs as the commissioner to be on the committee. Commissioner Combs seconded and vote was unanimous in favor. e Hubbard Tract Appraisal Cost Commissioner Hager moved to have expense of not more than $3,000. vote was unanimous in favor. the Hubbard Tract appraised at an Commissioner Combs seconded and COMMENTS PROM COMMISSIONERS Commissioner Hager - None Commissioner Combs reported that Mr. Herbert Strickland, who had been waiting for a heart transplant, passed away Saturday night and Baldwin-Fairchild Funeral Home in Winter Garden will be taking care of arrangements for funeral services. Commissioner Johnson said that the developers who tear up the roads (such as Orlando Avenue/White Road) and leave them in a state of disrepair should be made to fix them. City Manager Shapiro said that staff will check it out Wednesday and report back. e Commissioner Dabbs advised that the Historic Commission meets Thursday night in the Withers-Maguire House and that he had reported to City Commission at the workshop meeting held March 2 regarding an offer made to the Historic Commission for using vinyl siding on the house. The fact that vinyl siding did not meet with immediate approval from the Commissioners was a concern to some of the members. City Manager Shapiro advised that he had suggested that the salesperson provide an example close by to be viewed by the commissioners. e Page 4 City Commission Regular Meeting March 7, 1989 TENTATIVELY SCHBDULBD MEETINGS CANCBLBD City Manager Shapiro advised that the budget meetings tentatively scheduled for Thursday, March 9, 16 and 23, had been canceled as a subsequent meeting rescheduled them to Tuesday, March 28 and Thursday, March 30.
