Subject: Change Order No. 3 for the Pioneer Key Regional Stormwater Pond construction project to
accommodate final construction modifications involving the inflow channel, driveway apron, and
sidewalk.
Background Summary:
During the course of construction, various design elements were judged by the City to benefit from
modification in location and specification. The most significant owner-directed change was in the design
and construction of the weir structure that diverts water from the Northwest Ditch into the new stormwater
pond was originally a fixed earthen dam. A concrete weir structure with a removable gate was designed
as an alternative that would allow diversion of the water around the pond for maintenance. Other
changes made under owner direction were to build a reinforced concrete driveway apron across the
shallow force main on this side of Palm Drive, relocate the sidewalk to a location adjacent to the parking
area in order to facilitate access, and install additional riprap along the inflow channel. Deletions made
were the result of reducing the amount of storm drain piping required and elimination of the Orange
County building permit fee by annexing the property into the City. Construction of the regional
stormwater pond is funded by a State grant.
Issue:
The Engineering Department has proposed a final change order that accommodates additions and
deletions to the final stages of the project. The change order includes an increase of $21,010.37 in
Contract Price and an increase of 55 days in Contract Time.
Recommendations
The Engineering Department recommends that the City Commission approve the proposed change order
and authorize the Mayor and City Clerk to execute the required legal documents. To fund the change,
staff recommends that the City Commission approve the allocation of $21,010.37 from remaining funds
budgeted for this project.

Financial Impact:
The funding for this action will be financed by the existing allocation for the project in Account No. 312-
538-00-6302, which represents receipts from a State stormwater grant.

CHANGES ORDERED:
I. GENERAL
This change order is necessary to cover changes in the work to be performed under this Contract.
The GENERAL CONDITION, SUPPLEMENTARY CONDITIONS, SPECIFICATIONS and all
parts of the Project Manual listed in Article 1, Definitions, of the GENERAL CONDITIONS apply to
and govern all work under this change order.
II. REQUIRED CHANGES
Provide additional Contract Price and Time for additions, deletions, and modifications to the work, as
defined on the original construction plans.
III. JUSTIFICATION
Site conditions unknown at the start of construction required adjustments to the plans to
accommodate the shallow depth to a sanitary sewer force main under the new driveway, which was
accomplished by using a structural concrete driveway apron rather than the planned asphalt
pavement; construction of a removable weir structure rather than the originally proposed fixed
structure; and additional riprap for slope protection around the inflow channel. A change from 4-inch
thickness to 6-inch thickness and from unreinforced to wire-reinforced was made to the sidewalk
where it is adjacent to the parking lot so as to reduce the risk of future damage. Deletions to the
project's cost were realized by eliminating the need for a construction permit and reduction in the
length of a pipe culvert. The period of construction was extended to permit these changes to be
implemented and to delay plant installation until electric power service was available for irrigation.
IV. NARRATIVE OF NEGOTIATIONS
Change order is based on mutual agreement by the parties.

VI. APPROVAL AND CHANGE AUTHORIZATION
This proposed change to the Contract is to be approved by the City of Ocoee Commission. The
aforementioned change, and work affected thereby, is subject to all provisions of the original contract
not specifically changed by this Change Order. It is expressly understood and agreed that the
approval of the Change Order shall have no effect on the original contract other than matters
expressly provided herein.
CONTRACTOR acknowledges, by its execution and acceptance of this Change Order, that the
adjustments in Contract Price and Time shown hereon constitute full and complete compensation and
satisfaction for all costs and modifications of performance time incurred by the CONTRACTOR as a
result of this Change Order. No other claim for increased costs of performance or modifications of
time will be granted by the OWNER for the Work covered by this Change Order. The
CONTRACTOR hereby waives and releases any further claims for cost or time against the OWNER
arising from or relating to the matters or Work set forth or contemplated by this Change Order.
