Also present were Development Services Director Shadrix, Planning Manager Wagner, Principal Planner Fabre, and Deputy City Clerk Sibbitt. ABSENT: Members Conkling and Rhodus were absent excused. OVERVIEW OF EAR REQUIREMENTS Development Services Director Shadrix explained that the purpose of the work session is to do some preliminary issue identification. He stated this is a very important endeavor and as a prior consultant he has had the opportunity to work on a lot of Evaluation and Appraisal Reports. E.A.R. is where they identify the issues of the community that are growth related and then decide how to update the Comprehensive Plan to make it better. The Comprehensive Plan is supposed to set the community's vision and in many places normally does not do that; however, he is hoping to set a movement in Ocoee that would have the Comprehensive Plan accurately express the vision of the community. After identifying the issues, they will then identify what they need to do for the plan to address those issues. Every cycle for the E.A.R. is at a seven year cycle. Mr. Shadrix encouraged the board to think about things that they have noticed over the years that they may have questioned as to why it was done that way and his goal is to write down as many of those things that he can. There will also be a community meeting on October 22, 2008, to do the same thing. Once they have a preliminary list they can create a general issues list that they can fit all the comments under. They will then have a scoping meeting with the Department of Community Affairs and the agencies that review comprehensive plan amendments and have them comment on their preliminary issues list. Their goal is to have a letter of understanding with DCA by December. Vice Chair Golden inquired if there were issues that Mr. Shadrix and Planning Manager Wagner had wanted to add to the list. Mr. Shadrix stated they are stepping back and what they are planning on doing is taking the categories that they think are issues that can strengthen the community and use that to focus their energy at the right time into the right Comprehensive Plan amendment. It is very important that the issues come from the community. CONSENT AGENDA Minutes of the Planning and Zoning Commission Regular Meeting held on Tuesday, September 9, 2008. OLD BUSINESS — None NEW BUSINESS OCOEE PINES — FINAL SUBDIVISION PLAN Principal Planner Fabre informed the board that this item was placed under consent agenda because the final plan is really geared toward engineering details and the plan itself has either minimal changes/or no changes since the original preliminary subdivision plan approval. He further gave a brief presentation on the project and stated that the Final Subdivision Plan proposes a total of 343 dwelling units, which will consist of townhomes and single-family units. The Final Subdivision Plan includes the realignment of Clarcona-Ocoee Road consistent with the City of Ocoee Comprehensive Plan and Orange County roadway improvements plans. Planning and Zoning Commission Regular Meeting October 14, 2008 DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION The Development Review Committee (DRC) met on October 1, 2008, and the DRC recommended approval of Ocoee Pines subject to some minor technical issues to be addressed from the Planning Department and the City Attorney's Office that were identified in written staff comments and presented verbally. All of the issues were discussed and changes to the plans were agreed. When the discussion was finished, the Committee voted unanimously to recommend approval of the Final Subdivision Plan. STAFF RECOMMENDATION Staff recommends that the Planning & Zoning Commission, acting as the Local Planning Agency, recommend approval of the Ocoee Pines Final Subdivision Plan date stamped received by the City on October 6, 2008. DISCUSSION Vice Chair Golden stated he was out on the West Orange Trail and the whole site was cleared and he was inquiring as to what was going on. Terry Hagen, property owner, stated they have a clearing and grubbing permit from the city and they cleared part of the right-of-way and also part of the property. He added that they received the permit because they have to move about 150 thousand yards of dirt. They did not clear around the buffer. Vice Chair Golden stated he does not understand how the permit supersedes the Final Subdivision Plan. Member McKey inquired if they had someone from the City mark trees. Mr. Hagen stated someone from the city did come out and they also came across turtles which they moved. He stated the specimen trees on the site are protected and they did not take any of them down. Vice Chair Golden stated he has some minor comments on the landscaping plans and would mark the plans and give them to him since the engineer was not present. A brief discussion ensued regarding trees being removed along the right-of-way. Member McKey inquired if there was a gate entrance to the trail. Principal Planner Fabre stated there was an opening but did not remember a gate. Member McKey inquired about the details and height on the fence near the golf course. Principal Planner Fabre stated since it is considered an interior fence they do not normally require details for it; a separate contractor will be pulling a permit for the fence. Member McKey inquired if the trail would be out of service and disturbed during construction. Principal Planner Fabre stated that it should not be disturbed but if it is disturbed it will be treated like any disturbance on right- of-way; the developer would be responsible to bring the improvement back to 100% of how it is supposed to be. 2 Planning and Zoning Commission Regular Meeting October 14, 2008 Member West, seconded by Chairman Sills, moved to recommend anoroval of the Ocoee Pines Final Subdivision Plan date stamped received by the Citv on October 6. 2008. Motion carried unanimously. Vice Chair Golden stated he would like for it to go on record that it is a bad precedent to set to allow a clearing and grubbing permit before the Final Subdivision approval. FOUNTAINS AT HIGLAND PARK — PUD REZONING/LAND USE PLAN/ PRELIMINARY SUBDIVISION PLAN AND PRELIMINARY SITE PLAN Principal Planner Fabre gave a brief presentation on the project and stated that the PUD Land Use/Rezoning and Preliminary Subdivision Plan for Fountains at Highland Park proposes a professional business park with some accessory uses (retail, restaurant) to service the main development. The subject site is 12.34 acres in size and is located on the north side of Tomyn Boulevard and south of the Florida Turnpike. The Preliminary Site Plan proposes 16 development schemes with one lot (Lot 17) earmarked for future development. The allocation for the total square footage proposed is: 71,200 square feet for Office space, 38,000 square feet for Medical Office, and 5,700 square feet of either Retail or Restaurant space. The major off -site improvements for the project include turn lanes and some right- of-way vacation that will be brought before the City Commission. There were also some waiver requests for this development; which, are typical when rezoning to a PUD. DEVELOPMENT REVIEW COMMITTEE RECOMMENDATION The Development Review Committee (DRC) met on October 1, 2008, and reviewed the Rezoning/PUD Land Use Plan and Preliminary Subdivision /Site Plan for Fountains at Highland Park. The DRC voted unanimously to recommend approval of the PUD Land Use Plan and Preliminary Subdivision Plan/Site Plan, subject to incorporating the final revisions in the plans prior to the Planning and Zoning meeting. *The Fountains at Highland Park Land Use Plan and Preliminary Subdivision Plan/Site Plan date stamped October 2, 2008, (which is before the board today) incorporates the DRC's requested changes. 3 Planning and Zoning Commission Regular Meeting October 14, 2008 STAFF RECOMMENDATION Staff recommends that the Planning & Zoning Commission, acting as the Local Planning Agency, recommend approval of the Rezoning/PUD Land Use Plan and Preliminary Subdivision Plan/Site Plan for Fountains at Highland Parks, as date stamped received by the City on October 2, 2008. DISCUSSION Member McKey stated there are a lot of waivers and he has a problem with the last two. He inquired as to why they are giving the waiver to the maximum building coverage which is above 30% as well as the maximum impervious surface of 70%. Principal Planner Fabre stated the justification is that these are buildable lots for just the structure and they are not going to have the parking and other requirements. He further stated the whole site impervious surface is limited to 70% and they have met that code requirement. City Attorney Palmer clarified that the waiver relates to a lot by lot specific consideration which means that the size of the lot is the building pad; all of the infrastructure and parking is going to be in a common area tract owned by the property owner association. Member Dillard inquired about the cul-de-sac that was shown on the Site Plan. Principal Planner Fabre stated that may go away because there were some issues that came up such as trucks getting around that intersection. Member Campbell expressed his concerns with a tight turn in the corner and was wondering if that has been looked at for emergency vehicles. Principal Planner Fabre stated the Fire Department has reviewed the plan and did not have comments. David Evans, Evans Engineering, briefly described how the business park works. Vice Chair Golden stated that he was looking at the landscape plan before he saw their tree preservation plan and noticed that none of the preserved trees were on the landscaping plan. He stated he would like to see on the Final Subdivision Plan the protected trees added to the landscaping plan. Mr. Evans explained why they have two separate plans. He said what happens is that a site contractor goes out and starts landscaping so they create a separate tree protection plan to help decide what is a tree to save and what would be a tree to add. Vice Chair Golden briefly explained his concerns with some trees that were not saved and advised the engineer that he would like to give him the tree preservation plans with his markups so they can review it. The Public Hearing was opened for Fountains at Highland Park Land Use Plan and Preliminary Subdivision Plan/Site Plan. Inu Planning and Zoning Commission Regular Meeting October 14, 2008 Fred Bennett, 513 Belhaven Falls Drive, & Kelli Brown, 395 Belhaven Falls Drive, both spoke in opposition of the project. Ms. Brown stated she did not receive the notice. Principal Planner Fabre stated they are only required to send notice to those within 300 feet of the development and her home may not have fallen within those boundaries. Mr. Bennett inquired about how the construction is going to affect them as far as sound and privacy. Mr. Evans briefly explained the construction is required to follow the guidelines of the City. There will be noise but with the background sound in that area it should not be any louder then what they hear now. Ms. Brown expressed her concern that with all the development being done on the Maguire Corridor, many retails spaces are still vacant. Mr. Bennett inquired as to what would happen to all the pine trees in that area. Mr. Evans stated what they did was clear all the trees on the exterior perimeter and added new trees, landscaping, and a tree wall all along the front of the property. Discussion ensued regarding the levels of the building, lighting, and security issues. r. Bennett inquired if the letter he received would be the only letter sent out regarding the project. Principal Planner Fabre stated that they have advertising requirements in the local newspaper and they also post the property. He stated they have a timeline that they follow and the letter he received does inform him of both dates this project is to be presented. The Public Hearing was closed for Fountains at Highland Park Land Use Plan and Preliminary Subdivision Plan/Site Plan. Member West. seconded by Member Morris. moved to recommend approval of the RezoninaIPUD Land Use Plan and Preliminary Subdivision Plan/Site Plan for Fountains at Highland Parks, as date stamped received by the Citv on October 2, 2008. BACKGROUND: General Location: The subject property is located on the North side of Palm Drive on the west side of SR 429 (Western Expressway) and the east side of East Crown Point Road. Parcel Identification Numbers: 13-22-27-0000-00-016, 12-22-27-0000-00-031, 07-22-28-0000- 00-095 Parcel Size: 45.85 Acres Actual land use and unique features of the subiect properties: The property is vacant/ undeveloped. The subject property is adjacent to SR 429 (Western Expressway) to the east and East Crown Point Road to the west. Proposed Development: The applicants propose to develop the 45.85 acres as a light industrial PUD with a maximum floor area ratio of 0.6. The permitted uses will be limited to those uses permitted within the 1-1 (Light Manufacturing and Warehousing) except: Automotive Sales (New and Used) Bar Boat Sales and Service Liquor Store Mobile home and Travel Trailer Sales Monument Sales Motor Vehicle Wholesale Pawn Shop November-1 1, 2008 Planning and Zoning Commission Page 2 - Y CONSISTENCY WITH STATE & LOCAL REGULATIONS: Annexation: With respect to State annexation criteria, Chapter 171.044 of the Florida Statutes grants municipalities the authority to annex contiguous, compact, non -circuitous territory so long as it does not create an enclave. The subject property is considered contiguous to the City of Ocoee since it is adjacent to property located within the Ocoee City limits on the southern and eastern portion. Joint Planninq Area Aareement: A portion of the subject property is located within the Ocoee - Orange County Joint Planning Area (JPA). An applicable amendment to the JPA is required for the rest of the proposed site. Staff is in the process of processing the applicable JPA amendments. Orange County has been notified of this petition in accordance with Subsection 13-A of the City of Ocoee -Orange County Joint Planning Area Agreement. Rezoning: The applicant has requested a City of Ocoee zoning designation of PUD (Planned Unit Development). According to the Land Development Code, the PUD zoning designation is intended for all areas shown on the Future Land Use Map. The PUD zoning designation is consistent with the proposed future land use designation of Light Industrial. Comprehensive Plan: The annexation is consistent with the Future Land Use Element Policy 2.5 that states in part, "The City shall consider requests for voluntary annexation into the City when those lands are logical extensions of the existing City limits, when services can be properly provided, and when proposed uses are compatible with the Citv's Comprehensive Plan, the JPA Aqreement, and the Citv's Annexation Policy...." [Emphasis added]. The rezoning is consistent with Future Land Use Element Policy 1.15 that states in part, "The City may assign an initial zoning, after annexation, which is consistent with both the Future Land Use Map and the JPA Agreement..." Wetland Impact: E Based on the PUD Land Use Plan, associated analysis, and City of Ocoee wetland map, there is a small ditch that is considered jurisdictional wetlands. Compliance with the Land Development Code and Comprehensive Plan regarding development within and around the area is required. Endanaered and Threatened Wildlife: Based on a threatened and endangered wildlife study and a species of special concern survey performed by Bio-Tech Consulting Inc., and Stillwater Technologies, Inc. The only listed species ,:. found on the site was the gopher tortoise. Resolution of the gopher tortoise issue will need to be permitted through FFWCC prior to any construction activities. PUBLIC FACILITY IMPACTS: Rule 9J-5.0055(3), Florida Administrative Code, requires that adequate public facilities and services be available concurrent with the impacts of development. The applicant has elected to not seek vesting of Concurrency at this time. There is an existing 12" water main running along the south side of Palm Drive and an 8" forcemain running along the north side of Palm Drive. Approval of the proposed water and sewer utility plan is required prior to the approval of the final subdivision/site plan. Transportation / Traffic: The proposed PUD accesses East Crown Point Road and Palm Drive. East Crown Point Road and Palm Drive has an adopted Level -of -Service "D" and a measured Level -of -Service "C'. Each roadway has an available capacity over 60% and each roadway will maintain the adopted Level -of -Service with the traffic distribution patterns. Neither roadway is programmed for improvements in the County or City of Ocoee's 5-Year Capital Improvement Program. November 11, 2008 Planning and Zoning Commission Page 4 - Schools: ,�, No school impacts are proposed since the proposed use is light Industrial. Public Safetv: The nearest Fire Department is approximately 1.7 miles from Station 1, located at Bluford Avenue. The estimated response time is 2-4 minutes. The Police Station is located 1.4 miles from the subject property. The estimated response time is 3 minutes. Drainage: Jhe subject site is located within the Apopka Drainage Basin and therefore must meet the requirements of Section 11.7 (a) SJRWMD Management and Storage of Surface Water Handbook and Wekiva Study Area BMP's. Design of the drainage system will be evaluated in more detail prior to final engineering approval. Recreation and Open Space: No impacts on recreation facilities are proposed. The applicant will be required to provide thirty (30) percent open space. APPLICABLE POLICIES: Special Districts: The site is located within the Wekiva Study Area and does not contain any of the following protected features: Most Effective Recharge (type "A" soils), Sensitive Habitats, and Karst Features. Comprehensive Plan: The following policies are applicable with the proposed project: Future Land Use Policy 1.5: Buffering Future Land Use Policy 1.9: New Industrial Development Future Land Use Policy 1.10: Density and Intensity Future Land Use Policy 2.4: Land Use Patterns Future Land Use Policy 2.5: Voluntary Annexation Future Land Use Policy 5.11: Ground Water Protection Future Land Use Policy 7.1: Compatibility of Adjacent Land Uses Future Land Use Policy 7.6: Industrial Land Designation Transportation Policy 1.4.1: Operational Movements Conservation Policy 1.2: Industrial Air Quality Standards The Development Review Committee (DRC) met on 10/29/2008 to determine if the proposed annexation and PUD Land Use Plan was consistent with the City's regulations and policies. Based on the above analysis and subsequent discussions, the DRC recommended approval of the annexation and rezoning of the East Crown Point High Tech Industry PUD and PUD Land Use Plan as presented. November 11, 2008 Planning and Zoning Commission Page 5 Staff recommends that the Planning and Zoning Commission / Local Planning Agency recommend approval of the 1) annexation of the 31.45 +/- acres of land, 2) rezoning from R-1 (Single -Family Dwelling) and Orange Country A-1 (Agriculture) to Planned Unit Development (PUD); 3) Transmittal of the Large Scale Land Use Amendment from Low Density Residential to Light Industrial subject to the adoption of an applicable amendment to the Ocoee/Orange County Joint Planning Area (JPA) Boundary Map and JPA Land Use Map. The site consists of three (3) parcels including 13-22-27-0000-00-016, 12-22-27-0000-00-03 1 , and 07-22-28-0000-00-095. The parcel adjacent to S.R. 429 is located within the, City of Ocoee. The remaining two parcels are part of unincorporated Orange County and lie outside of the Orange County/Ocoee Joint Planning Agreement (JPA). This application would include an amendment to the JPA and the property could then be annexed by the City of Ocoee. The site is currently vacant and consists of open pasture on the southern half and wooded to the north. The soils range from somewhat poorly drained to very poorly drained. The site slightly slopes from south to north and has approximately 12' of fall. There is an existing drainage ditch at the north end of the western most parcel. The site currently has both an Orange County and Ocoee future land designation of Low Density Residential. After annexation of the two unincorporated Orange County parcels, the Comprehensive Plan Amendment application will propose all three parcels future land use designation be Light Industrial within the City of Ocoee. Future Land Use Element The site is 45.65 acres of undeveloped land (per Orange County Property Appraiser). The surrounding properties have zoning designations of Orange County A-1 (North), Ocoee C-2 (south), Orange County R-1 and Ocoee R-3 (east), Orange County A -I and Winter Garden C-2 (west).This proposal intends to include the site in the JPA and amend the future land use to Light Industrial. The applicant has submitted applications to the City of Ocoee to be included in the JPA, annexed into the City and establish a future land use di - designation of Light Industrial. - The proposed site will be a light industrial complex. Due to the large amount of future -'. Commercial land use to the south, it is felt that this amendment is consistent with the City's Comprehensive Plan. The proposed site will include additional impacts to the City's infrastructure, however this site lies within the Northwest Ocoee Sector Study and = growth has been anticipated in this area. Infrastructure Element Sanitary Sewer Svstem- There is an 8" forcemain running along the north side of Palm Drive. This line also ends at the Crown Point Apartments; a connection will be made to the east of this location along Palm Drive. The ERU for this facility's 0.050 ERU's per employee. There will be an estimated 3480 employees, therefore the estimated sewer demand is 52,200 gpd. The current demand on the city is 1.534 mad (ADF). Due to the anticipated growth by the city in this area it is expected that the City can accommodate = this increase in demand. Potable Water Svstem- There is an existing 12" water main running along the south side of Palm Drive. This line ends at the Crown Point Apartments; therefore the connection M would have to be made at the eastern most parcel. There is also a 10" water main running along west side of East Crown Point Road however this belongs to the City of Winter Garden. There is also a future City of Ocoee 8" water main proposed to run north -south along East Crown Point Road. The site is a proposed industrial facility. The ERU for this facility is 0.050 ERU's per employee. There will be an estimated 3480 employees, therefore the estimated water demand is 52,200 gpd. The city has three operating water plants which produce an ADF of 6.486 mad. Due to the anticipated growth by the city in this area it is expected that the City can accommodate this increase in demand.. Solid Waste- The City of Ocoee has established an agreement with Orange County which allows utilization of the Orange County Class I Landfill located on Young Pines Road in order to meet the needs of the city. The Orange County Landfill has capacity to meet the needs of the City of Ocoee through the year 2030. Drainage- The site lies within the Apopka Drainage Basin and therefore must comply with the requirements of Section 11.7(a), SJRWMD Management and Storage of Surface Water Handbook. A dry retention system or dry retention/wet detention system may be utilized in order to meet these requirements. The stormwater improvements depicted on this Conceptual Master Plan are for illustrative purposes only and do not create any obligation on the part of the landowners to manage stormwater as reflected hereon. It is acknowledged that the stormwater management plan be a master plan for the entire property, a parcel -specific plan, or a combination of the foregoing. In conjunction with approval of a site plan for development of each parcel, a stormwater management plan for such parcel shall be submitted to the City for approval. Conservation Element Air Oualitv- The proposal is for a light industrial site. This will add additional car emissions but not to a point that would adversely affect the City's air quality. Surface Water Bodies- The site is located within the Lake Apopka drainage basin. All SJRWMD and City of Ocoee standards will be met for the design of the stormwater system. No septic systems will be utilized as the facility will tie into the City of Ocoee's water and sanitary sewer system. Ground Water Oualitv- The Lake Apopka drainage basin has a recharge rate of 4-8 inches per year. The site is does not lie within a wellfield protection area. All SJRWMD and City of Ocoee stormwater requirements will me met. Floodnlains- The site does not lie within the 100 year floodplain. Soils. Geologv. Towaraphv- Soils on site include: 3-Basinger fine sand, depressional 20-Immokalee fine sand 44-Smyrna fine sand 54-Zolfo fine sand The soils range from somewhat poorly drained to very poorly drained. The site falls approximately 12' from the southern end to the northern boundary. Potentiallv Threatened or Endanaered Flora and Invertebrate- There are no threatened or endangered species on the property, other than potential gopher tortoise. This will be addressed during final engineering & permitting. Ecological Communities- An environmental assessment has been provided as part of the application and is attached to this report. Natural Reservations- There are no natural reservations located on the site. Water Use- The site lies in the Lake Apopka drainage basin and has a recharge rate of 4-8 inches per year.
