AN ORDINANCE OF THE CITY 0 CHANGIN~ THE ZONIN LASSIFICAT ORANGE COUNTY A GRICULTURAL DIS TO A-2 SUB DISTRICT , ON CERTAIN REAL PROPERTY LOCATED OCOEE-APOPKA ROAD AND ONE- UART NORTH OF FULLERS CROSS ROAD AS PETITIONED BY THE PROPE TY OWNERS; PROVIDING FOR AND AUTHORIZING HE ON OF THE OFFICIAL CITY ZONING MAP; REPEALING INCONSISTENT ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. wrr ORDINANCE NO. 90- 56 WHEREAS, the ci ty Commission of the ci ty Florida has on the date of ado tion of this Ordinance, a exed into the corporate limits.of t city of Ocoee, Florida c rtain real property now located in t e city of Ocoee, Orange Coun y, Florida, as hereinafter describe ; and WHEREAS, t owner or owners of said real property ("the Peti tioner") have p ti tioned the city Commission of the city of Ocoee, Florida (" he Ocoee city commission") to rezone and establish an in it , I zoning classificati said real property of A-2 , SU RBAN DISTRICT ( "the Initial Zoning"); and t to section Chapter II of Appendix f the de of Ordinances ci ty of Ocoee, Florida ( "th 0 ee City Code"), the anning Director has reviewed said petition and determined t at the Ini tial Zoning requested by the Petitioner is consist t with the 1979 City of Ocoee Comprehensive Plan as set forth in rdinance No. 719, adopted April 15, 1980 ("the Ocoee Comprehens' e Plan"); and WHEREAS, said petition an zoning request was scheduled for study and recommendation by th Planning and Zoning commission of the City of Ocoee, Flori a ("the Planning and Zoning commission"); and WHEREAS, and Zoning Commission has reviewed said petition and the requeste Initial Zoning for consistency with the Ocoee Comprehensive Plan nd determined that n1 'al Zoning requested by the Petitio er is consis with e Ocoee Comprehensive Plan and is i the best i rest of the ci y and has recommended to the Ocoee C ty Comm' 10n that said re property be zoned A-2 , SUBUR TRICT , as requested by the Petitioner and that the Ocoee City C ission find that the Initial zoning requested by the Petitione is consistent with the Ocoee Comprehensive Plan; and 1 s held a de novo with respect to WHEREAS, the Ocoee City Commission public hearing with official notice there proposed zoning of said real property; and . WHEREAS, the Ocoee City commiss'on has determined that the Initial Zoning requested by the Peti oner is consistent with the Ocoee Comprehensive Plan; and WHEREAS, this Ordinance has ci ty Commission in accordance with t e procedure section 166.041(3) (a), Florida statut s. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA, AS WS: section 1_ commission of the city of Ocoee, Florida has the author' y to adopt this Ordinance pursuant to Article VIII of the onstitution of the state of Florida, and Chapters 163 and 166 Florida statutes. section _ That the zoning classification, as defined in Appendix A 0 the Code of Ordinances of the city of Ocoee, Florida, of the ollowing described parcel of land located within the corporate imits of the City of Ocoee, Florida, is hereby changed from " range County AG. AGRICULTURAL DISTRICT " to " A-2 SUBUR AN DISTRICT ": . SEE EXHIBIT "A" ATTACHED ERETO AND BY THIS REFERENCE A PART HEREOF. section 3. That the city/commission of the City of Ocoee, Florida, hereby finds the new 'zoning of the lands described in this Ordinance to be consisten with the Ocoee Comprehensive Plan. section 4 _ Clerk is hereby authorized and directed to revise the Zoning Map of the city of Ocoee in order to incorporate the ning amendments enacted by this Ordinance and the Mayor and city Clerk are hereby authorized to execute said revised Officia Zonin ' cordance with the provisions of section 1.1 of Chapter III of Appen ix A of the Code of Ordinances of the City of Ocoee. section 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed and resc'nded. section 6. Severability. subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by ny court of competent jurisdiction, such portion shall be deemed , 'stinct and independent provision and such holding shall not aff ct the validity of the remaining portion hereto. section 7.
