FL.. 01 17 20p~ 07/30/86 AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA ORa 8 0 8 PG45 I 0 TO EXTEND THE TERRITORIAL AND MUNICIPAL LIMITS TO ANNEX, PURSUANT TO FLORIDA STATUTE 171.044 THE HEREINAFTER DESCRIBED LAND SITUATED AND BEING IN ORANGE COUNTY, FLORIDA AND PETITIONED BY JOHN M. SEITZ, AGENT FOR W. C. AND C. A. DAVIS; PROVIDING FOR AND AUTHORIZING THE UPDATING OF OFFICIAL CITY MAPS; PROVIDING FOR DIRECTION OF THE CITY CLERK; CONFLICTS; EFFECTIVE DATE. WHEREAS, JOHN M. SEITZ, AGENT FOR W. C. AND C. A. DAVIS, has petitioned the City Commission of the City of Ocoee, Florida to annex the property lo- cated North of Silver Star Road and East of Clark Road Extended in Orange County, Florida; and, WHEREAS, Florida Statute 171.044 of the General Laws of Florida provides that a municipal corporation may annex property into its corporate limits, upon voluntary petition of the owners and by passing and adopting a non-emer- gency ordinance to annex said property; and, WHEREAS, the City Commission of the City of Ocoee, Florida is desirous of annexing and redefining the boundaries of the municipality to include the subject property pursuant to Florida Statute 171.044. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF OCOEE, FLORIDA AS FOLLOWS: Section 1. That the following described property, being situated and in Orange County, Florida totaling approximately 24.5 acres be and the same is hereby annexed into the City of Ocoee, Florida, pursuant to the voluntary annexation provisions of Chapter 171.044, Florida Statutes and other applic- able laws. Within the N~ or Section 16, Township 22 South, Range 28 East; Orange County, Florida; Lot 13 "Lake Johio Shores" as recorded in Plat book 0 at page 54 or the Public Records or Orange County, Florida; Less right-or-way ror Silver Star Road. Section 2. That the corporate territorial limits of the City of Ocoee, Florida are hereby redefined to include said land herein described and an- nexed. e Section 3. That the City Clerk is hereby authorized to update and sup- plement official City maps of the City of Ocoee, Florida to include said land herein described and annexed. Section 4. That the land herein described and future inhabitants of the land herein described shall be liable for all debts and obligations and be subject to all species of taxation, laws, ordinances, and regulations of the City of Ocoee, Florida and be entitled to the same privileges and bene- fits as other areas of the City. e e Section 5. That if any section or portion of a section or subsection of this ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or subsection or part of this ordinance. Section 6. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. Section 7. That this ordinance shall take effect upon passage and adop- tion, thereafter the City Clerk is hereby directed to file a certified copy of the ordinance with the Secretary of State of the State of Florida and the appropriate agencies in and for Orange County, Florida.
