AN ORDINANCE .AMENDING ORDINANCE NUMBER 710
(APPENDIX A OF THE CITY CHARTER) OF THE CITY
OF OCOEE, FLORIDA, TO MODIFY THE REQUIREMENTS
FOR STREE:r SETBACKS AND RIGHTS-OF-WAY INCLUD-
ING DEFINITIONS AFFECTING SAME; RATIFYING THE
ORDINANCE TO THE EXTENT NOT SO .AMENDED; PRO-
VIDING FOR . SEVERABILITY; AND ESTABLISHING AN
~TIVE DATE.

BE IT ENACTED BY THE PEOPLE OF THE CITY OF OCOEE, FLORIDA:
Section 1. Chapter III, Section 7.1 of Ordinance #710 of the City of
Ocoee, Florida, is hereby amended to read as follows:
7.1 SETBACK STANDARDS. For purposes of further street widening,
setback lines are established for certain streets as set out in
this section. All setbacks required by this Ordinance shall be
measured from street right-of-way lines. No portion of a struc-
ture or appurtenances thereto shall intrude streetward beyond
the setback line, except as specifically set out in this Ordi-
nance. Street setbacks constitute the minimum building line
in all zoning classifications, and may be exceeded by the yard
regulations of individual districts. In addition to required
major street setbacks, additional dedication of public rights-
of-way may be required along Arterial and Collector streets as
specified in the City of Ocoee Subdivision Ordinance and Compre-
hensive Plan.
(1) For all Arterial streets listed in Section 7.2, the required
setback shall be fifty (50) feet.
(2) For all Collector streets listed in Section 7.2, the required
setback shall be thirty (30) feet.
(3) For all streets not otherwise listed in Section 7.2, the
required setback shall be twenty-five (25) feet.
Section 2. Chapter VI. Definitions, Section (13), (87), and (113) of
Ordinance #710 of the City of Ocoee, Florida, are hereby amended to read as
follows:
(13) Building Line: A line establishing the minimum allowable distance
between the nearest portion of any building, excluding the outermost of
any uncovered porches, steps, gutters and similar fixtures, and the
street right-of-way line when measured perpendicularly thereto.
(87) Setback: The minimum horizontal distance between the street right-
of-way line and the building line.

(113) Yard: An open space at grade between a building and the adjoin-
ing lot lines unoccupied and unobstructed by any portion of a structure
from the ground upward, except where otherwise specifically provided in
these regulations that the building or structure may be located in a
portion of a yard required for a main building. In measuring a yard for
the purpose of determining the width of the side yard, the depth of a
front yard or the depth of a rear yard, the shortest horizontal distance
between the lot lines and the main building shall be used.
(a) Front Yard: A yard located in front of the front elevation of
a building and extending across a lot between the side lot lines and
being the minimum horizontal distance between the front propertylihe
and the outside wall of the main building.
(b) Rear Yard: A yard extending across the rear of a lot measured
between the lot lines and being the minimum horizontal distance be-
tween the rear lot line and rear of the outside wall of the main
building. On both corner lots and interior lots the rear yard shall
in all cases be at the opposite end of the lot from the front yard.
(c) Side Yard: A yard between the building and the side lot line
extending from the front yard line to the rear yard line and being
the minimum horizontal distance between a side lot line and the out-
side wall of the side of the main building.
Section 3. Ordinance #710 of the City of Ocoee is hereby ratified in
all other sections and subsections not changed in this Ordinance.

Section 4. That if any section or portion of a section or subsection of
the Ordinance proves to be invalid, unlawful, or unconstitutional, it shall
not be held to invalidate or impair the validity, force or effect of any
other section or portion of a section or subsection of this Ordinance.
Section 5. This Ordinance shall take
