AN ORDINANCE TO BE ENTITLED AN ACT RELATING
TO PENSION PLAN, ADOPTING THE CITY OF OCOEE
DEFINED BENEFIT PENSION PROGRAM; APPOINTING
AN ADMINISTRATOR; CREATING THE PENSION PLAN
ADMINISTRATIVE COMMITTEE; PROVIDING M>>mERS;
PROVIDING TERMS AND APPOINTMENT; PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City of Ocoee, Florida, Board of Commissioners is most
desirous of retaining quality City employees; and,

WHEREAS, a well proven method of keeping good quality employees is by
providing employees a pension program with full vested rights after working
for the City for a specified number of years; and,
WHEREAS, the City of Ocoee, Florida, Board of Commissioners demonstrated
their interest and support in a quality pension program by providing for same
in the FY 85-86 Budget; and,
WHEREAS, the City of Ocoee, Florida, Board of Commissioners further demon-
strated their desire of establishing a permanent defined benefit pension plan
by their unanimous action at the City Board of Commissioners meeting on Octo-
ber, 1, 1985; and,
WHEREAS, such a continuing program will have a very positive influence
on the employees of the City.
NOW, THEREFORE,
BE IT ENACTED BY THE PEOPLE OF THE CITY OF OCOEE, FLORIDA:
Section 1. The City hereby agrees to enter into a Pension Program with
the Southern Business Group of Orlando, Florida through Joinder Agreement #002
and the associated Plan and Trust Document creating the City of Ocoee Defined
Benefit Pension Program (non-standard - non-integrated), as amended from time
to time and incorporated herein by reference (Plan).
Section 2. The Southern Business Group shall serve as the Administrator
of the Plan, but a Pension Plan Committee as created in Section 3 shall dic-
tate the investment policies for the Plan.
Section 3. (1) There is hereby created a Pension Plan Administrative
Committee which shall be composed of: a City Commissioner or the Mayor, as
appointed by majority vote of the City Commission; the City Manager; the City
Finance Director; a non-managerial employee of the Police or Fire Departments,
appointed by mutual agreement of those two department supervisors; a non-mana-
gerial employee of the Water or Sanitation Departments, appointed by mutual
agreement of those two department supervisors; and a non-managerial employee
of the Street, or Recreation, or General Government Department, appointed by
mutual agreement of those three department supervisors. For the purposes of
this ordinance, the City Clerk shall serve as supervisor of the General Gov-
ernment Department.

(2) The members of the Pension Plan Administrative Board
shall serve for a term of one year from October 1 until September 30 and may
be reappointed. Initially, the members will serve from the date of appoint-
ment until September 30, 1986, at which time they may be reappointed or re-
placements selected.
(3) Any disputes in appointments shall be resolved by deci-
sion of the City Manager, and said decision may be appealed to the City Board
of Commissioners, if desired by a department supervisor or the employees in-
volved in the dispute.

Ii: (4) Vacancies shall be filled by the appropriate appointment
procedure for the vacant seat and shall serve the unexpired term subject to
reappointment.
Section 4. This Pension Plan Administrative Board will operate under
the guidelines provided in the Plan.
