AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA
AMENDING SECTIONS 7-3, 7-11 AND 7-12 OF THE
CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY;
PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Ocoee City Board of Commissioners is most desirous of
maintaining a quality Cemetery for the good of the citizens; and
WHEREAS, in order to do so it is necessary to insure that all citi-
zens, and other visitors to the City's Cemetery follow a standard set for all.
NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF OCOEE, FLORIDA:
I SECTION 1: Amending Section 7-3. Superintendent - Appointment;
removal. Adding "The City Manager may choose to act as the Superintendent of
Ii the Cemetery and not appoint a second individual".

SECTION 2: The current Section 7-11 of the Ocoee Code of Ordinances
be superceded and replaced by the following:

(a) The Cemetery will be open to visitors at all times between the
hours of sunrise and sunset. Permission to enter at any other time
must be obtained from the Chief of Police.
(b) No person shall break or injure any tree or other plant, pick
any flowers, nor mar any landmark, marker, or memorial, or in any
way deface the grounds of the Cemetery.
(c) No boxes, shells, toys, discarded glassware, sprinkling cans,
receptacles or similar articles will be permitted on any grave, lot
or tree.
(d) Persons within the Cemetery grounds shall only use the estab-
lished avenues, walkways and roads and are forbidden from tres-
passing on Cemetery lots.
(e) Children under sixteen (16) years of age shall not be permitted
within the Cemetery nor its buildings, unless accompanied by an
adult.
(f) No person may discharge a firearm in or adjacent to the Ceme-
tery. This prohibition shall not apply to authorized volleys at
militarily oriented burial services.
(g) No person may use any form of advertisement on Cemetery
grounds.

(h) No person may consume refreshments or liquors within the
Cemetery, or carry same onto the premises.
(i) No person shall throw rubbish or debris on walks, drives, or
any part of the Cemetery grounds.
(j) Unauthorized persons shall not loaf, lounge, or otherwise use
any of the grounds, graves or monuments in the Cemetery, or in any
of the buildings thereon.
(k) No loud talking shall be permitted on the Cemetery grounds
within hearing distance of funeral services.
(I) No money shall be paid the City's attendants of the Cemetery
grounds. The entire time of the persons regularly employed on the
grounds belong to the Cemetery; visitors and owners must not other-
wise engage them unless authorized by the Commission or the Super-
intendent.

(m) Any person found on the grounds after dark will be considered
a trespasser.
(n) All orders, inqu~r~es and complaints by visitors or owners
should be reported to the Superintendent or the Commission.
(0) Flowers, and other symbols of tribute may be temporarily placed
upon graves. The receptacles for these flowers must, however, be
a flush mounting device as a part of the monument or disposable.
SECTION 3: The current Section 7-12 of the Ocoee Code of Ordinances
be superceded and replaced by the following:

The design of markers, stones, or monuments shall be flat in nature.
The markers, stones or monuments shall not protrude more than two (2) inches
above the ground. Any violation of these rules shall result in the City of
Ocoee notifying the owner of the property, by Certified Mail ( or hand carried
with proof of service), requesting the nmrker, stone or monument be either
adjusted or replaced to comply with these regulations. After sufficient time
to correct the violation (generally 30 days) without a response, the City Hall
shall cause the marker, stone or monument to be removed, and brought into
compliance prior to it being replaced into the ground.
There shall be no posts, chains, or other markers protruding out of
the ground by more than two (2) inches bordering or any lot within the Cemetery
Stones or monuments with detachable/flush mounting vases are perfect-
ly acceptable for use in the Cemetery.
The superintendent shall only prohibit individualistic designs in
monuments when it would be offensive to other owners, or tend to degrade from
the appearance of the Cemetery.
This section will not be interpreted to be retroactive. It does
not effect those monuments already in place.
SECTION 4: If any portion of this Ordinance is deemed to be void
or otherwise unconstitutional, the remainder of this Ordinance shall retain
its effectiveness.
SECTION 5: This Ordinance shall take effect upon adoption by the
City Board of Commissioners.
