RSS FIRST READING: 10-1-85 SECOND READING: 11-5-85 - AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA, TO CONTRACT ITS TERRITORIAL AND MUNICIPAL LIMITS TO DEANNEX, PURSUANT TO FLORIDA STATE STATUTE 171.051, THE HEREINAFTER DESCRIBED LANDS SIT- UATED AND BEING OWNED BY ROBERT LEE SMITH AND ALVIN SMITH; PROVIDING FOR AND AUTHORIZING AMENDMENT OF THE OFFICIAL CITY ZONING LAND USE MAPS AND COMPREHENSIVE LAND USE PLAN; PROVIDING DIRECTIONS TO THE CITY CLERK; CONfbI~'j:S;.~.? " ,_'~ _ EFFECTIVE DATE ",::. ,,-' b 9 L.."". 4 ORf-lt-.l\1E <..0 f L , . 01 21,00PM 07;30i86 WHEREAS, Robert Lee Smith and Alvin Smith have petitioned the City Commission of the City of Ocoee, Florida to deannex the following listed property located on State Highway 50 approximately 220 feet east of Marshall Farms Road, Ocoee, Florida; and OR 3 8 0 8 PG l~ 5 3 2 were never officially 648 on September 6, 1977; WHEREAS, Robert Lee Smith and Alvin Smith notified of the annexation done by Ordinance Number and, WHEREAS, Florida State Statute 171.051 provides that a municipal governing body may contract its corporate limits by passing and adopting a non-emergency ordinance; and WHEREAS, the City Commission of the City of Ocoee is desirous of correcting said annexation done in error. NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF OCOEE, FLORIDA: SECTION I: That the following described property, being situated in Ocoee, Florida, totalling approximately .71 acres be and the same is hereby deannexed from the City of Ocoee, Florida, pursuant to contraction provisions of Chapter 171.051 Florida Statutes. Commencing at the Northwest corner of the NE 1/4 of Section 30, Township 22 South, Range 28 East in Orange County, Florida; thence South 85 feet along the centerline of Marshall Farms Road; thence east 30 feet to the SE corner of the intersection of Marshall Farms Road and State Road 50; thence continuing east 220 feet to the point of beginning; thence south 102 feet; thence east 300 feet; thence north 112 feet; thence west ap- proximately 50 feet; thence south 10 feet; thence west ap- proximately 250 feet to the point of beginning. SECTION II: That the corporate territorial limits of the City of Ocoee, Florida are hereby redefined to include said land herein described and deannexed. - SECTION III: That the City Clerk is hereby authorized to amend, alter, and supplement the official City zoning and land use maps and compre- hensive land use plans of the City of Ocoee, Florida to include said land herein described and deannexed. SECTION IV: That if any section or portion of a section or sub- section of the Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or subsection of this Ordinance. SECTION V: That all ordinances or parts of ordinances in conflict herewith are repealed. SECTION VI: That this Ordinance shall take effect upon passage and adoption, thereafter the City Clerk is hereby directed to file a certified copy of this Ordinance with the Clerk of the Circuit Court in and for Orange County, Florida and to file a certified copy with the Department of State of the State of Florida.
