AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA TO
CONTRACT ITS TERRITORIAL AND MUNICIPAL LIMITS
TO DEANNEX, PURSUANT TO FLORIDA STATE STATUTE
171.051, THE HEREINAFTER DESCRIBED LANDS SIT-
UATED AND BEING OWNED BY ALMA GENEVA SMITH;
PROVIDING FOR AND AUTHORIZING AMENDMENT OF THE
OFFICIAL CITY ZONING LAND USE MAPS AND COMPRE-
HENSIVE LAND USE PLAN; PROVIDING DIRECTIONS TO
THE CITY CLERK; CONFLICTS; EFFECTIVE DATE.

WHEREAS, Alma Geneva Smith has petitioned the City Commission of
the City of Ocoee, Florida to deannex the following listed property located
on Marshall Farms Road South of Highway 50, Ocoee, Florida; and
WHEREAS, Alma Geneva Smith was never officially notified of
the annexation done byOrdinance Number 648 on September 6, 1977; and
WHEREAS, Florida State Statute 171.051 provides that a municipal
governing body may contract its corporate limits by passing and adopting a
non-emergency ordinance; and
WHEREAS, the City Commission of the City of Ocoee is desirous of
correcting said annexation done in error.

NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF OCOEE, V

FLORIDA:
SECTION I: That the following described property, being situated in
Ocoee, Florida, totalling approximately 1.01 acres be and the same is
hereby deannexed from the City of Ocoee, Florida, pursuant to contraction
provisions of Chapter 171.051 Florida Statutes.

Commencing at the N.W. corner of the NE 1/4 of Section 30,
Township 22 South, Range 28 East, in Orange County, Florida;
thence south 85 feet along the centerline of Marshall Farms
Road; thence east 30 feet to the southeast corner of the
intersection of Marshall Farms Road and State Road 50; thence
south 102 feet to the point of beginning; thence east 627.18
feet; thence south 117.5 feet; thence west 346.18 feet; thence
north 105.5 feet; thence west 281 feet; thence north 12 feet
to the point of beginning. (Parcel 27)
SECTION II: That the corporate territorial limits of the City of
Ocoee, Florida are hereby redefined to include said land herein described
and deannexed.
SECTION III: That the City Clerk is hereby authorized to amend,
alter, and supplement the official City zoning and land use maps and compre-
hensive land use plans of the City of Ocoee, Florida, to include said land
herein described and deannexed.

SECTION IV: That if any section or portion of a section or sub-
section of the Ordinance proves to be invalid, unlawful, or unconstitutional,
it shall not be held to invalidate or impair the validity, force or effect
of any other section or subsection of this Ordinance.
SECTION V: That all ordinances or parts of ordinances in conflict
herewith are repealed.
SECTION VI: That this Ordinance shall take effect upon passage and
adoption, thereafter the City Clerk is hereby directed to file a certified
copy of this Ordinance with the Clerk of the Circuit Court in and for Orange
County, Florida, and to file a certified copy with the Department of State of
the State of Florida.
