HomeMy WebLinkAboutOrdinance 848 ORDINANCE NO. 848 First Reading September 3, 1985 Second Reading October 1. 1985 AN ORDINANCE OF THE CITY OF OCOEE, FLORIDA ESTABLISHING REQUIREMENTS PRIOR TO THE IN!- TIATION OF ANY CONSTRUCTION PR~TS WITHIN THE CITY OF OCOEE; PROVIDING FOR PENALTY AND APPEAL PROCEDURE FOR NON-COMPLIANCE; PROVI- DING FOR SEVERABILITY; PROVIDING FOR AN EF- FECTIVE DATE. . WHEREAS, the City of Ocoee, Florida is experiencing extremely high growth rate; and, WHEREAS, in order to insure quality construction, and thereby quality growth, it is necessary that all such construction be properly controlled by the City; and, WHEREAS, City policy is that no construction shall occur without proper and prior authority so granted by the City; NOW, THEREFORE, be it ordained by the City Commission of the City of Ocoee, Florida, in lawful session: SECTION 1. Each and every construction project of any type, to include initial land clearing that is to be performed within the corporate limits of the City of Ocoee, must be submitted to and approved by the City of Ocoee Building Department prior to start of construction. This includes utilities such as, water lines in building construction projects as well as projects that are within the State road rights-of-way. The term construction is herein defined to include clearing of land, regardless of whether subsequent struc- tures will be built or not. The Building Department will have the responsibility of coordinating with the insuring approval of all of their agencies within the City that may be impacted by any type of construction project. This includes working closely with the City Consulting Engineer and utility departments. SECTION 2. Any individual or firm who fails to comply with this Ordinanc shall be brought before the Code Enforcement Board and/or the City Commission for them to levy appropriate fine or other punishment. Consequently, in keep- ing with the Code Enforcement Board's duties and rights, there may be a fine of up to $250.00 per day levied for failure to comply with this Ordinance. SECTION 3. All ordinances and parts of ordinances that conflict herewith to the extent of such conflicts are hereby repealed. If any phrase, clause, sentence, paragraph, section or subsection of this Ordinance shall be declared unconstitutional or invalid by a court of competent jurisdiction, such un- constitutionality or invalidity shall not affect the remaining phrases, clause, sentences, paragraphs, sections or subsection of this Ordinance. , SECTION 4.
