HomeMy WebLinkAboutOrdinance 804 First Reading December 18, 1984 Second Reading 'lr'lnllrlry 1 S 1 198 C; ORDINANCE NO. rj Q 4 CITY OF OCOEE, FLORIDA AN ORDINANCE OF THE CITY OF OCOEE, ORANGE COUNTY, FLORIDA, ADOPTING A SECONDARY WATER TAP FEE FOR IRRIGATION PURPOSES ONLY, FOR THE CITY OF OCOEE WATER DEPARTMENT; PROVID- ING FOR COLLECTION OF SAID FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Ocoee currently charges a fee of seven hundred and fifty dollars for each equivalent residential unit tap fee into the City of Ocoee's Water System; and, . WHEREAS, some of the sewer companies operating within the Cit of Ocoee charge or intend to charge a sewer rate based upon the water usage running through the meter; and, WHEREAS, in order to provide the most equitable service to our citizens the City Commission feels that water utilized for ir- rigation purposes should not be counted as water that is being ut- ilized in the traditional potable water sense. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF OCOEE, FLORIDA: Section 1. The City Board of Commissioners of the City of Ocoee, Florida hereby authorizes the establishment of a secondary tap fee for the purposes of installing a second water meter to be used for irrigation purposes only. This fee shall be in the amoun of one hundred dollars as long as the primary tap fee of seven hun- dred fifty dollars has been paid. This hundred dollar fee shall be charged only in the instance where an irrigation meter can be installed parallel to the already existing potable water meter without the City of Ocoee Water De- partment personnel having to install a second meter box or other additional installation. In such a case where a secondary meter box must be installed there will be an additional fifty dollar service charge thus making the total tap fee of one hundred fifty dollars where additional work is required in order to install this secondary meter. At such a time when the City Board of Commissioners deems it appropriate that the seven hundred fifty dollar tap fee be in- creased this secondary tap fee will be increased proportionately. Section 2. If any section or portion of a section or subsec- tion of this Ordinance proves to be invalid, unlawful, or unconsti- tutional it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of a section or subsection or part of this Ordinance. .'
