AN ORDINANCE VACATING AND ABANDONING
A PORTION OF A DRAINAGE EASEMENT
DESCRIBED HEREINAFTER AND LOCATED
IN THE CITY OF OCOEE, FLORIDA.

BE IT ORDAINED by the City Commission of the City of Ocoee,
Florida:
Section 1. It is hereby determined that a portion of a
Drainage Easement, hereinafter described and located within the
municipal boundaries of the City of Ocoee, Florida and is a
municipal drainage easement.

Section 2. That said portion of the drainage easement is no
longer useful or needed as a drainage easement and that it is in
the public interest that said portion of the drainage easement be
abandoned, vacated and closed as a drainage easement and as
public property, and be released from any and every public right,
use, title and interest. The following described portion of a
drainage easement, be and the same is hereby vacated, closed and
abandoned and said property be, and the same is hereby released
and discharged of any public right, use, title and interest of
the City of Ocoee, Florida, said property lying and being in
Orange County, Florida and more particularly described as follows:

East 1.35 feet of the West 10 feet of
Lot 30, Ocoee Heights, according to
the plat thereof as recorded in Plat
Book 10, Pages ll4, l15, Public Records
of Orange County, Florida.
Section 3. The Mayor and City Clerk of the City of Ocoee,
Florida, be and they are hereby authorized and directed to execute
such instruments as may be necessary or required to show that said
property has been absolutely and completely abandoned.
Section 4. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court or competent jurisdiction,
such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portion thereof.

Section 5. This ordinance shall take effect immediately upon
passage by the City Commission of the City of Ocoee, Florida.
