ORDINANCE No.7~ /v" CITY OF OCOEE, FLORIDA AN ORDINANCE RELATING TO THE ANNEXATION OF CERTAIN PROPERTY INTO THE MUNICIPAL BOUNDARIES OF THE CITY OF OCOEE, FLORIDA; MAKING FINDINGS OF FACT; DESCRIBING THE PROPERTY TO BE ANNEXED; INCORPORATING SAID PROPERTY INTO THE MUNICIPAL BOUNDARIES OF THE CITY; AND PROVIDING FOR AN EFFECTIVE DATE. l.i,:;: I WHEREAS, Harvey R. Heller, the owner of the following described parcel of real property, has requested and petitioned the City of Ocoee, Florida, to annex the same in and to the municipal boundaries of said City; and WHEREAS, said fee simple owner has filed his Petitions and Consents with the City Commission as provided by Article 1, Section 6.1, of the City Charter of the City of Ocoee, and Section 171.044 and 166.041, Florida Statutes; and WHEREAS, a public hearing as provided by Article 1, Section 6.1, of the City Charter of the City of Ocoee, was held on the question of annexation of said parcel of real property no less than 10 days and not more than 60 days from the date oi the iiling of such petition with the City Clerk; and WHEREAS, the City Commission of the City of Ocoee, Florida, has made an independent examination of the said property and determined, and does hereby find, that the area involved qualifies for municipal benefits and that it is in the best interests of the City of Ocoee that such area should be annexed to and be included in the municipal boundaries of the City of Ocoee, Florida, and WHEREAS, the City Commission of the City of Ocoee, Florida, does hereby find and determine that said property is in an unincorporated area of Orange County and is contiguous to the municipal boundaries of the City of Ocoee, Florida and is compact; NOW THEREFORE, ., -. 2. Heller, located in Orange County, Florida, be and the same hereby is incorporated into and made part of the municipal boundaries of the City of Ocoee, Florida; A parcel of land in Section 29, Township 22 South, Range 28 East, Orange County, Florida lying north of the Sunshine State Parkway more particularly described as: That portion of the South ~ of the NW~ and the North ~ of the SW~ lying north of the Sunshine State Parkway, Section 29, Township 22 South, Range 28 East, LESS: Beginning at the point of intersection of the West line of the SCL right-of-way of the County Road; thence West along the South line of said County Road right-of-way 128 feet; thence Southeasterly parallel to the railroad right-of-way approximately 422 feet to a point on the East line of the NW~ of Section 29, Township 22 South, Range 28 East; thence North along said quarter section line to the West line of the ACL right-of-way; thence Northwesterly along said right-of-way to point of beginning. Subject to a right-of-way for Old Winter Garden Road Extension over the North 30 feet thereof and right-of-way for Maguire Road, (SR 439) on the West, ALSO subject to right-of-way for SCL railroad, and subject to Borrow Pit Order of Taking as Min. 42, page 271 Public Records of Orange County, Florida. That the City of Ocoee, Florida, shall have the power, authority, and jurisdiction over and within the lands described in Section 1 hereof, and of the inhabitants thereof, and the property therein, as it does have over its present corporate limits, and all the laws, ordinances and resolutions of the said City shall apply and have equal force and effect as if all the territory had been a part of the City at the time of passage of such laws, ordinances and resolutions.
