AN ORDINANCE VACATING AND ABANDONING
A PUBLIC SERVICE EASEMENT DESCRIBED
HEREINAFTER AND LOCATED IN THE CITY
OF OCOEE, FLORIDA.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF OCOEE,
FLORIDA:
Section One: It is hereby determined that property herein-
after described is located within the municipal boundaries of the
City of Ocoee, Orange County, Florida, and is a public service
easement.
Section Two: That said property is no longer useful or
needed as a public service easement, and that it is in the public
interest that said property be abandoned, vacated and closed as a
public service easement and as public property, and be released
from any and every public right, use, title, and interest. The
following described property be, and the same is hereby vacated,
closed and abandoned and said property be, and the same is hereby
released and discharged of any and every public right, use, title
and interest of the City of Ocoee, Florida, said property lying
and being in Orange County, Florida, and more particularly des-
cribed as follows:
From the Northeast corner of the East ~
of the Southwest ~ of the Northeast ~
of Section 18, Township 22 South, Range 28
East, run South 1107.71 feet to the Point
of Beginning; thence South 120.82 feet;
thence West 175.00 feet; thence North
125.49 feet; thence East 175.00 feet to the
Point of Beginning, and also the Easterly
25.00 feet of Lot 126, Pioneer Key Park,
according to the plat thereof as recorded in
Plat Book 6, Pages 77 through 86 of the
Public Records of Orange County, Florida.
Section Three: The Mayor and City Clerk of the City of Ocoee
Florida be, and they are hereby authorized and directed to execute
such instruments as may be necessary or required to show that said
property has been absolutely and completely abandoned.
Section Fouz': If any section, subsection, sentence, clause,
phrase, or portion of this Ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portion thereof.
Section Five: This Ordinance shall take effect immediately
upon passage by the City Commission of the City of Ocoee, Florida.
