CITY OF OCOEE, FLORIDA
AN ORDINANCE RELATING TO GARAGE SALES
WITHIN THE MUNICIPAL BOUNDARIES OF THE
CITY OF OCOEE; PROVIDING DEFINITIONS;
REGULATING THE DURATION AND FREQUENCY
OF GARAGE SALES; REQUIRING PERMITS BE
OBTAINED BEFORE SUCH SALES AND DISPLAYED
AT THE SALE; PROVIDING FOR A FEE FOR
SUCH PERMIT; PROVIDING FOR THE DENIAL
OF THE ISSUANCE OF PERMITS AND THE REVO-
CATION OF SAME; PROVIDING FOR REMOVAL OF
ITEMS FOLLOWING THE SALE;PROVIDING FOR
RULES AND REGULATIONS; PROVIDING FOR
SEVERABILITY; PROVIDING PENALTIES; PRO-
VIDING AN EFFECTIVE DATE.
Be it enacted by the People of the City of Ocoee:
Section 1. This Ordinance is enacted for the purpose of
providing the necessary regulations of garage sales in the City o
Ocoee in the interest of the public health, safety and welfare of
the citizens and residents of the City of Ocoee. This ordinance
shall apply and be in force within the municipal boundaries of th
City of Ocoee.
Section 2. "Garage Sale" shall mean the offering for sale
sale by a person, group of persons, firm or corporation of more
than one item of personal property displayed or offered for sale
on a lot, parcel or tract of land within the municipal boundaries
of the City of Ocoee, located within an area zoned for a residen-
tial use.
Section 3. It shall be a violation of this ordinance for
garage sales to extend more than forty-eight (48) hours or to be
conducted more than once every four (4) months on any single lot,
parcel, or tract of land.
Section 4. It shall be a violation of this ordinance for
any person, firm or corporation to conduct a garage sale on any
lot, parcel, or tract of land without first obtaining a permit
therefor from the City of Ocoee which permit shall set forth the
time and place of such garage sale. Such permit may be obtained
by requesting same in writing from -said city. The application for
permit shall state name or names of person, firm or corporation
conducting the garage sale and the time and place where it is to
be held. The sale shall be held only on the days stated in the
permit. The permit provided for herein shall be displayed on the
premises at which the sale is being conducted and the Board of
City Commissioners may charge such fee for issuance of such permi
as it may deem necessary to cover the cost thereof.
Section 5. A permit to conduct a garage sale shall not be
issued to the same person, group of persons, firm or corporation
more frequently than three times in any calendar year.
Section 6. At the conclusion of the sale, all unsold articlos
and items and all tables, chairs and display cases, and signs
used in conjunction with such sale shall be removed or packed
away so as not to be visible from any public street.
Section 7. It is declared to be the intent of the Board of
' City Commissioners that, if any section, sub -section, sentence,
clause, phrase, or portion of this ordinance is for any reason
held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision, and such holding shall not affect the
validity of the remaining portions hereof.
Section 8. A violation of this ordinance is a misdemeanor
and shall be punishable in accordance with general law. The Board
of City Commisioners may bring suit to restrain, enjoin or other-
wise prevent the violation of this ordinance in the Circuit Court
of Orange County.
Section 9. This ordinance shall take effect immediately
upon passage by the City Commission of Ocoee.
