Background Summary:
Per Florida State Statutes 932.7055 "...any local law enforcement agency that acquires at least $15,000 pursuant to
the Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less than fifteen (15) percent of
such proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime
prevention, safe neighborhood, or school resource officer program(s).
Issue:
Should the Honorable Mayor and Board of City Commissioners authorize the Police Department
to expend and! or grant forfeiture funds to law enforcement related uses and charities?
Recommendations
It is recommended that the Honorable Mayor and Board of City Commissioners authorize the Police Department to
expend and! or grant monies from its Forfeiture fund to law enforcement related uses/ charities as follows: $1,500
to Central Florida Police Athletic League; $1,500 to A Child Is Missing; $1,500 to Orange County Sexual Assault
Treatment Center; $1,500 to Orange County Victim Services Center; $1,500 to Spouse Abuse Inc. Harbor House;
$2,500 to Lakeside Behavioral Healthcare (aka Central Florida Crisis Intervention Team); $1,500 to purchase
bicycle helmets to be distributed by the Department's Crime Prevention and School Resource Officer unit; $3,000
for the City of Ocoee Spring Fling, $2,500 to the Ocoee Police Explorers; and $1,000 for citizen academies.

Financial Impact:
A total of $18,000 from the Police Forfeiture fund. During Fiscal Year 07/08, the Police Department acquired
approximately $106,493.90 (fifteen [15] percent of which would be $15,973.95). There is approximately $200,000
in this fund.

ISSUE
Should the Honorable Mayor and Board of City Commissioners authorize the Police Department
to expend and/ or grant forfeiture funds to law enforcement related uses and charities?
BACKGROUNDIDISCUSSION
Per Florida State Statutes 932.7055 ".. . any local law enforcement agency that acquires at least $15,000 pursuant
to the Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less than fifteen (15)
percent of such proceeds for the support or operation of any drug treatment, drug abuse education, drug
prevention, crime prevention, safe neighborhood, or school resource officer program(s). The local law
enforcement agency has the discretion to determine which program(s) will receive the designated proceeds."
During Fiscal Year 07/08, the Ocoee Police Department acquired approximately $106,493. 90 (fifteen [15]
percent of which would be $15,973.95). The Department is requesting to expend/grant a total of$18,000. There
is approximately $200,000 in the Police Forfeiture fund.
The Ocoee Police Department would like $1,000 to sponsor its Citizen Police Academies throughout the year;
$1,500 to purchase bicycle helmets to be distributed by the Department's Crime Prevention and School Resource
Officer unit to children in need; to transfer $3,000 to the City of Ocoee Spring Fling event; and to transfer
$2,500 to the Ocoee Police Explorers. Because of the services they provide to the Department and the
community and because duplication of some of these programs by the Ocoee Police Department is not possible,
the Ocoee Police Department recommends grants to the following non-profit organizations: $1,500 to Central
Florida Police Athletic League, a non-profit organization working with law enforcement that helps keep youth
crime and drug free; $1,500 to A Child Is Missing, a public/private partnership, devoted to assisting law
enforcement in search and recovery efforts of missing children, elderly, and disabled persons and notifying the
public about sexual predators; $1,500 to Spouse Abuse Inc. Harbor House, the domestic violence shelter and
assistance center for Orange County; $1,500 to the Orange County Sexual Assault Treatment Center; $1,500 to
the Orange County Victim Services Center; and $2,500 to Lakeside Behavioral Healthcare (aka Central Florida
Crisis Intervention Team), the facility that trains our police officers how to deal with people in crisis.
