HomeMy WebLinkAboutOrdinance 603 ORDINANCE No. h 63 CITY OF OCOEE, FLORIDA AN ORDINANCE VACATING, CLOSING AND ABANDONING ALL OF CHICAGO AVENUE, ALL OF POLK STREET, AND A PORTION OF OAK STREET AND A PORTION OF CALIFORNIA AVENUE, AS MORE PARTICULARLY DESCRIBED HEREINAFTER AND LOCATED IN THE 'C~TY OF OCOEE, FLORIDA: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OCOEE, FLORIDA: SECTION ONE: It is hereby determined that property herein- . after described has been platted as follows: LAKE SHORE GARDENS, TOWN OF OCOEE, Plat Book 2, Page 134, Public Records of Orange County, Florida, approved by the City of Ocoee on June 23, 1969; LAKE SHORE GARDENS, FIRST ADDITION, TOWN OF OCOEE, Plat Book 4, Page 108, Public Records of Orange County, Florida, approved by the City of Ocoee on September 19, 1972; LAKE SHORE GARDENS SECOND ADDITION, TOWN OF OCOEE, Plat Book 5, Page 10, Public Records of Orange County, Florida, approved by the City of Ocoee on September 19, 1972; and that said property is no longer useful or needed as a public street or way, and that it is in the public interest that said property be abandoned, vacated and closed as a public street or way and as public property, and be released from any and every public right, use, title, and interest. The following described property be, and the same is hereby vacated, closed and 'abandoned and said property be, and the same is hereby released and dis- charged of any and every public right, use, title and interest of the City of Ocoee, and said property shall be platted in accordance with each of the plats above-described, which plats are hereby confirmed and the dedication of all public streets or . ways shown therein accepted by the City of Ocoee, said property lying and being in Orange County, Florida, and more particularly described as follows: 1. The North 30 feet of the NE 1/4 of the NW 1/4 of Section 20, Township 22 South, Range 28 East, and the South 30 feet of the SE 1/4 of the SW 1/4 of Section 17, Township 22 South, Range 28 East, being also described as that portion of Oak Street extending from the West line of the NE 1/4 of the NW 1/4 of Section 20~ Township 22 ~ . \ South, Range 28 East and the West line of the SE 1/4 . of th~ SW 1/4, Section 17, Township 22, Range 28 East, Easterly to the East line of the NE 1/4 of the NW 1/4 of Sec- tion 20, Township 22 South, Range 28 East and the East line of the SE 1/4 of the SW 1/4, Section 17, Township 22 South, Range 28 East, as designated in Plat Book A, pages 100-101, Public Records of Orange County, Florida. . ,2. The East 30 feet of the NE 1/4 of the NW 1/4 of Se~tj.on 20, Twp. 22 South, Range 28 East, less the South 30 feet thereof, and the West 30 feet of the NW 1/4 of the NE 1/4, Section 20, Twp. 22 South, Range 28 East, less the Soutl1 60 feet and the North 30 feet thereof; also described as all of Chicago Avenue lying between the South right-of- way line of Oak Street and the North right-of-way line of White Road, as designated in Plat Book A, pages 100-101, Public Records of Orange County, Florida. 3. The South 60 feet of the North 95 feet of the S 1/2 of the NW 1/4 of the NE 1/4 of Section 20, Twp. 22 South, Range 28 East, also described as all of Polk Street lying between each right-of-way line of Chicago Avenue and extend- ing easterly to the West line of California Avenue, less the East 30 feet thereof, being part of California Avenue, as designated in Plat Book A, pages 100-101, Public Records of Orange County, Florida. 4. The North 30 feet of the NW 1/4 of the NE 1/4 of Section 20, township 22 South, Range 28 East, designated in Plat Book A, pages 100-101, Public Records of Orange County, Florida, as Oak Street, extending from the West line of the NW 1/4 of the NE 1/4 of Section 20, Twp. 22 South, Range 28 East, Easterly to the East line thereof. 5. The East 30 feet of the NW 1/4 of the NE 1/4 of Section 20, Twp. 22 South, Range 28 East, being also des- cribed as the ~1est 30 feet of California Avenue extending from the North boundary line of White Road Northerly to the South bourldary line of Oak Road as designated in Plat Book A, pages 100-101, Public Records of Orange County, Florida. SECTION TWO: The Mayor and City Clerk of the City of Ocoee be, and they are hereby authorized and directed to execute such instruments as may be necessary or required to show that said property has been absolutely and completely abandoned. SECTION THREE: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any Court of competent juris- 4It diction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereof.
