HomeMy WebLinkAbout11-07-1973 SS I I I MINUTES OF SPECIAL MEETING OF THE CITY COMMISSION OF CITY OF OCOEE HELD NOVEMBER 7, 1973 PRESENT: MAYOR FOX, COMM.,Turner, Lyle, and Harper Comm. Hamby attended evening meeting & Comm Crawford replaced Comm. Turner at evening meeting. ABSENT: NONE The meeting was called to order at 12115 p.m. Attorney Caldwell read definition on City Charter, Section 5; It states in a Mayoralty Election candidates for this office having the majority of votes cast shall be elected. Attorney Caldwell had a call placed to the Attorney General, based on this Comm. Lyle made a motion to recess until said call was received, seconded by Comm. Harper. Meeting was called back to order at 12:30 p.m. Attorney Caldwell could not contact the Attorney General. The City Attorneys opinion based on Article 7, Section 1 of the City Charter is to have a run off election between the two top candidates done thru a resolution. Comm. Turner stated eight illegal ballots were cast. The City Attorney explained Section 102.166 in the Florida Statute states a written protest maybe filed by a candidate or elector within five days to the canvassing board or Circuit Judge. John N. Carter from the audience stated he would like to protest. Attorney Caldwell suggested to Mr. Carter that he seek the advice of an Attorney. Comm. Lyle made a motion to accept the votes on the Commissioner race, seconded by Comm. Harper. Unanimous. Comm. Turner Turner made a motion to recess until 7:00 p.m., seconded by Comm. Harper. Meeting recalled to order at 7:15 p.m. Attorney Caldwell reported on call from Attorney General; he could offer the City no guidance. in this matter. Mr. Vandergrift~ attorney came before council and gave his views on said situation. There was much discussion on whether all three candidates should run again or just the top two. Comm. Harper ask Mr. Whitehead his opinion, he stated if there is to be a run off election he wants to be included. Comm. Harper stated that its his opinion the council should accept the advice of the City ~ttorney.. Comm. Harper made a motion that the City Attorney draw up a resol~tion for a Special Election between the three candidates for Mayor with provisions for a Run Off Election to be held if no One candidate receives the majority of votes cast.The Special Election to be held I I I (2 ) 27 November 1973, and the Run Off Election (if needed) to be held 04 December 1973, seconded by Comm. Lyle. Comm. Harper, Crawford, and Lyle voted yea Comm. Hamby nay. Motion carried. There will be a Special Meeting held 08 November 1973, at 7:00 p.m. Comm.
