MINUTES OF SPECIAL MEETING OF THE CITY COMMISSION OF CITY OF OCOEE
HELD NOVEMBER 8, 1973
PRESENT:
ABSENT:
MAYOR FOX, COMM. CRAWFORD, HARPER, HAMBY, AND LYLE.
NONE.
The meeting was called to order at 7105 p.m.
Mayor Fox stated he would abstain from voting at this meeting.
Attorney Caldwell read Resolution on Special Election and Run Off
Election. Comm. Harper moved to accept Resolution as read, seconded
by Comm. Crawford.
Mr. Vandergrifts' attorney gave his views on said Resolution. Much
discussion was held on the fact of whether the top two candidates
should have a Run Off Election or all three mayor Candidates should
have a Special Election and then a Run Off Election between the top
two (if needed).
Barbara Crawford of Pine Hill~ ask to address council on this subject,
she was denied the right to speak because she was not a resident of
Ocoee or a taxpayer of said City.
There was much discussion from the audience as to why the Citizens
of Ocoee were not informed that the prior election was not in fact a
final election. Comm. Lyle explained he himself did not know the
Charter stated a majority vote was needed to electA~ Mayor.
Comm. Harper withdrew his motion, Comm. Crawford withdrew his second
to said motion. Attorney Caldwell corrected Resolution to read the
two men receiving the most votes as a result of the November 6, 1973
election would be on the ballot for said election. It was also
decided that said resolution was in fact a declaration of the votes
cast in the Mayors race.
City Attorney read revised Resolution. Comm. Harper moved to accept
Resolution as revised, seconded by Comm. Lyle. Unanimous. Resolution
adopted.
Minutes of City Commission meeting held on 6 November 1973 and minutes
of Special Meeting held 7 November 1973 were read. Attorney Caldwell
stated that minutes of Special Meeting should read Article 7 Section
5 instead of Section 5. Comm. Lyle moved to accept minutes as corrected,
seconded by Comm. Hamby. Both Commissioners withdrew their motions.
Comm. Harper moved to accept minutes of 6 November 1973, seconded
by Comm. Hamby. Unanimous. Motion carried. Comm. Harper moved to
accept minutes of Special Meeting held 7 November 1973 as corrected,
seconded by Comm. Hamby. Unanimous. Motion Carried.

Mr. Vandergrift asked council if they would go before a Court of Law
and get a Declaratory Judgment on whether or not said Resolution was
legal. Council explained they were going to go ahead with Resolution
on the City Attorneys' advice.
Mayor Fox addressed audience and said he would make a decision by
Monday as th whether or not he would resign his office until after
said election.
Comm. Lyle made a motion to adjourn, seconded by Comm. Harper.
Unanimous. Motion carried. Meeting adjourned at 8:45 p.m.
