I. Meeting was called to order at 7r30 p.m. with an offering of silent
prayer, followed by the pledge of allegiance. Minutes of the previous
meeting were read. Comm. Stinnett moved to accept minutes as read, seconded
by Comm.\1Ihitehead. Unanimous.
la. Glen Thomas came before council on behalf of the Planning & Zoning
Board with a written recommendation from said Board stating that due to
the voluntary absenteeism of H.m. Bowness for a period in the excess of
ninety days from the Planning & Zoning Board the members of that board
were recommending that Richard Garlington fill the vacant seat as an
alternate until further action or assignment. Comm. Lyle moved to accept
the recommendation, seconded by Comm. Crawford. Unanimous.
2. 2ND Reading on Ordinance Creating a New Zoning Districtl Comm. Crawford
moved to read Ordinance by heading only, seconded by Comm. Stinnett. Unanimous.
City manager read heading only of said Ordinance. motion to adopt Ordinance
I was made by Comm. Crawford, seconded by Comm. Stinnett. Unanimous. This
being the 2nd and final reading the Ordinance was adopted.
3. Easementsr It is the opinion of the City Attorney that fenced City
accepted easements with no access to water meters are illegal and the land
owner can be sued to have an injuction against said property to remove the
fence or put a gate in it. A valid easement can be fenced with the land-
owners understanding that the fence can be torn down with no liability
to the City if it is necessary to put utility lines in easement. The
City manager is to contact persons involved and try to negotiate, if the
property owners involved refuse to cooperate then the City should take legal
steps to make these persons cooperate.
4. Bids on sale of City Property (water storage tank)1 5950.00 = Frank Turner,
5900.00 = Half-Way, Inc. and 51,000.00 = Indian Lake Fruit Co. Comm.
Crawford moved to sale to the high bidder (Indian Lake Fruit Co.), seconded
by Comm. Stinnett. Unanimous.
a. There is to be a public hearing o~ the NE corner of Silver Star Road
land Bluford from R1aa to Commercial on August 26, 1975.
b. There has been a petition filed by mR. & Mrs. Crosby, Sr. for a public
hearing on August 26, 1975 for a Use Permitted on Review to continue to
live in their mobile Home which is located at 740 N. Lyman Street and is
presently zoned residential. Comm. Crawford moved to send a re~istered letter

to the Crosbys' to remove their trailer from its present location within
fifteen days or on the 16th day the City will remove it at the Crosbys'
expense and any damages incurred during the moving will also be at the
Crosbys' expense, seconded by Comm. Stinnett. Unanimous. (deadline 8-21-7S).
c. City manager stated that on behalf of the Womens Club. mr. Bernard had
ask him to request a donation from the City of 5500 to help defray the cost
of the air-conditioner. Comm. Crawford stated that some of the ladies of
the Womens Club had approached him and that instead of the 5500 donation it
would be to the Clubs advantage if the City would pay the light bill for
the Club henceforth. After some discussion Comm. Crawford moved to pay the
light bill beginning in September. seconded by Comm. Stinnett. Unanimous.
d. Geneva street Pavings Comm. Crawford moved to pay Amick Construction CO.
SI,902.80 from Federal Revenue Sharing and 54,904.00 from street Dept. acct.
#7040, seconded by Comm. Stinnett.Unanimous.
City manager presented the 75/76 Fiscal Year Budgets City manager
recommended that tax milleage for coming year not be lower than 5 mills
or higher than 5.43 mills. Comm. Lyle moved to charge 5 mills, seconded
by Comm. Whitehead. Unanimous. City manager proposed three new police cars
for the Police Dept. After much discussion it was decided that bhe City
would purchase two cars and use the extra money to repair the old cars. A
new mower was proposed in the coming year budget for the recreation department,
however the City Manager explained that the City needed the mower now. Council
agreed that City manager should go ahead with the mower purchase now. Comm.
Stinnett moved to accept budget as presented and amended, seconded by Comm.
Lyle. Unanimous. mayor commended the City manager on a well put together
budget.
City manager ask council if they would consider paying for four Police
Reserves to attend Police School. After much discussion Comm Crawford moved
to hold two months reserve pay from the persons involved until they complete
the school, upon completion they are to be reimbursed the two months pay,
sec~nded by Comm. Stinnett. Comm. Crawford, Stinnett, and Lyle yea. Comm.
Whitehead nay. motion carried.
