HomeMy WebLinkAbout05-04-1976 I I I MINUTES OF THE MEETING OF THE CITY COMMISSION OF THE CITY OF OCOEE HELD MAY 4, 1976 PRESENT: Mayor Breeze; Commissioners Lyle, Stinnett, Whitehead ABSENT: Commissioner Crawford I. a&b. Meeting was called to order at 7:32 P. M. by Mayor Breeze. Rev. Titus offered the opening prayer, followed by the pledge of allegiance. II. a. The minutes of the commission meeting held 20 April 76 were corrected .. by Comm. Stinnett to show that Comm. Crawford made the suggestion regarding Theisen property. Comm. Stinnett then moved to accept the minutes as corrected, seconded by Comm. Lyle. Unanimous. b. The motion to accept the minutes of the 27 April 76 meeting was made by Comm. Lyle and seconded by Comm. Whitehead. Unanimous. c. The minutes of the Planning & Zoning Board meeting held 27 April 76 were read for information. Comm. Lyle moved to accept the board's recommendation \ that the Seventh Day Adventist Church on Wofford Road be annexed into the City XY~ with R1AA zoning. Seconded by Comm. Whitehead. Although Mayor Breeze recommended d )..!U:A zoni ng the vote was unanimous in favor of the moti on as stated. Comm. ~~~ Stinnett moved to request the City Attorney draw up proper ordinances, seconded cfi^~y~y Comm. Whitehead. Unanimous. ~ ~ III. a. Mr. Parker Harrison came before Council regarding Ocoee Hills Project. The City Engineer was scheduled to recommend to them a solution to a drainage problem on May 5, and Mr. Harrison requested permission to proceed with the recommendation when it was submitted. City Manager showed Council a diagram explaining options. Comm. Stinnett moved to grant permission, seconded by Comm. Whitehead. Unanimous. Mr. Harrison also requested clear Certificate of Occupancy, which the Council agreed to. Council agreed to issue necessary building permits to Mr. Harrison. b. See II c. c. City Attorney advised that the expense of advertising Retirement of Street Refunding Bonds will be $220.00 per column inch in the Wall Street Journal. City Manager advised in another publication the cost is $84.00 per 72 words. Board agreed to leave it up to City Manager and City Attorney to research and evaluate the situation whether to retire the bonds or not. V. g. Mr. Lovejoy with Florida Telephone advised Council that regarding the Utilities 1% Franchise and Utilities 10% Tax a discrepancy has been found and is being corrected. Mayor Breeze thanked Mr. Lovejoy for the information and commended City Manager for finding the discrepancy and starting the straightening out process. IV. a. City Manager deferred to City Attorney regarding Lillian Maguire Trust Fund of $5,000.00. City Attorney explained this was a portion of the purchase price of the property City bought from Miss Maguire that was to be returned to the City in the event the City Complex was named for her. If it is not named for her the fund was to be retained by the Maguires. Mayor Breeze stated that it was his intent to have it incorporated into the original plans of the City Hall building. but in the rush to get the building started overlooked that detail. Comm. Stinnett declared it was his intent to have a monument in the park dedicating it to Lillian Maguire. City Attorney suggested a plaque covering whole area site. Mayor Breeze is to work with City Manager and Mr. Maguire to arrive at a satisfactory solution. IV. b. Our allocation from Community Development Program has been raised from $15,000 to $35,000 for Bay Street. Comm. Stinnett stressed his feeling that the contractor should have to buy permit to work for the county in the city. However, he doesn1t want to stand in the way of good working relationship with the county. All commissioners present concurred. COMMISSION MEETING 4 MAY 76 PAGE 2 I V. a. In the judgement regarding Teleprompter vs City of Ocoee the decision was in the City of Ocoee's favor. Teleprompter has 10 days from the date order was filed to file a motion for rehearing. They can also appeal to Fourth District Court of Appeals within 30 days of final judgement. b. ' Columbus Street will be finished in 10 days. Comm. Whitehead moved to pay contractor from Acct. #7048 $4,403.92, seconded by Comm. Stinnett. Unanimous. c. CETA Title II program has been extended to January 31, 1977. e. Repairs to Pump #2 have been completed at an approximate cost of $1,700. f. City Manager briefed Council on Health Department requirements on septic tanks. g. See following III c. City Manager briefed Council regarding the portalets for girls soft ball teams. The teams are now playing at a place where there are existing facilities so those recently acquired portalets can be returned. Comm. Lyle commended City Manager for his dedication to his job and to the City of Ocoee. Comm. Whitehead announced a new big league game Saturday at 4:00 P.
