HomeMy WebLinkAbout05-25-1976 SS MINUTES OF A SPECIAL MEETING OF THE CITY COMMISSION OF THE CITY OF OCOEE HELD 25 MAY 76 I PRESENT: MAYOR BREEZE, COMM.LYLE,STINNETT,CRAWFORD AND WHITEHEAD -ABSENT: NONE I I. Mathis vs City of Ocoee and Sgt. Dodson: City Attorney stated he could not represent both the City and Sgt.Dodson, therefore Sgt.Dodson needs an attorney. Comm.Crawford stated a decision needed to be made as to whether or not the city is going to furnish an attorney for Sgt.Dodson. Comm.Crawford feels that being Sgt. Dodson is an employee of the city and was acting as such in the arrest of Mr.Mathis he feels the city should furnish him an attorney. City Attorney stated that someone that was a specialist in this field should be hired. After much discussion Comm.Lyle moved that the city obtain an attorney for' Sgt. Dodson subject to mutual agreement from Sgt. Dodson on the attorney to be hired and the city, seconded by Comm.Crawford. City Attorney stated he doubted any attorney would take the case based on that stipulation as no attorney can have two masters. Comm. Stinnett amended the motion to "City will pay for Sgt.Dodson an attorney subject to Sgt. Dodson following the City Attorneys' recommendation on the initial hiring of an attorney", seconded by Comm. Crawford. Unanimous. City Attorney recom- mended John Sewell. Mayor stated that Sgt. Dodson hires attorney, the attorney bills Sgt.Dodson and Sgt.Dodson gives bills to city. Doug Everd discussed coverage on aforementioned litigation. Comm. Crawford stated that the city had been told about every type of insurance they needed except this particular coverage. Comm.Crawford feels insurance agent has been negligent in representing the city. Mr.Weeks (Wurst Ins.) stated it was impossible for him to tell council every type of coverage and every exclusion the city had, and that he had never brought this matter to council but that he had made it known that the coverage was needed but that it was very expensive. Comm.Stinnett suggested the Interim City Manager check with surrounding cities as to what they are doing about this type coverage, also that performance bonds on every employee should be looked into. Mr. Weeks was asked to come to next regular meeting with information and cost for this type coverage. II. Bids for Sealing and Striping City Hall and Police Department ~arking lot and related driveways: Slemons Paving: $1,545.00, Del Ron Const. :~1,295.00, and TEFCO Maint.: $1,119.00. Comm.Whitehead moved to accept low bid of $1,119.00, seconded by Comm.Lyle. Unanimous. III. NEW ADDRESS 150 LAKESHORE DRIVE~ Interim City Manager requested permission to put City Hall address below the City Hall sign in front of building. Permission granted. IV. ,RESOLUTION HIGH WEEDS (ORD.#593): Interim City Manager stated there have been numerous complaints from Sleepy Harbor residents on excessive weed growth in the area on unimproved property. Comm.Crawford moved that a letter be sent giving Ross ten days to mow said property, if not mowed then city mow and add cost to the next building permit Ross obtains, seconded by Comm. Stinnett. Unanimous. V. Movement of house from outside of city to 703 Pine St.: Comm.Crawford stated a house was moved in the night to Mr.Queerrs property on Pine Street and that the Building Inspector had issued Mr. Queen a permit to move a house when he had no right to do so, house does not meet zoning requirement.Comm. Crawford stated that the building inspector is to be told to familiarize himself with zoning ordinance before issuing any permits and that he (Building Inspector) is to notify Mr. Queen he is violation of zoning ordinance. VI. Former City Attorney request if council wishes him to represent city in the Teleprompter appeal.City Attorney request this be deferred until next meeting. Comm.Crawford moved to table,seconded by Comm.Whitehead.Unanimou& I -2- I Bobby Brown of 404 Mabel Street complained to council that the Police Department had given him written notice to remove the junk cars from his yard. Mr. Brown stated they are not junk cars, that one of them is a stock car and he is repairing the other two. Mr. Brown admitted that the cars have neither a license plate or inspection sticker on them. After much discussion Comm.Crawford stated the stock car could be kept in yard and one of the other two vehicles is to be put in carport and the other one removed from his yard. Comm.Stinnett stated an electric pole at the senior league field is split and Florida Power should be contacted to repair it. Comm.Crawford moved that Mr. Lee, of Florida Power be contacted and have him do what he' feels is necessary, seconded by Comm.Stinnett. Unanimous. Comm.Crawford stated the new city hall building and its contents should have some insurance coverage. Mr.Weeks stated it was automatically covered for 180 days. Mr. Weeks was ask to give council a cost estimate at next regular meeting for $125,000.00 coverage on building and $75,000.00 coverage on contents. Comm.Whitehead stated tha Mr. Lee of Florida Power should be told that the pole he is to repair will be moved when ball field is turned around. Comm.Lyle ask that the Interim City Manager remind the sanitation crew to close residents gates after removing their garbage. Comm.Crawford stated that the cemetery gates are not being opened. Comm.Stinnett directed the Interim City Manager to tell the Chief of Police that the cemetery gates are to be opened at the appointed time and closed at the appointed time every day and that this problem had better never come before council again.
