HomeMy WebLinkAbout09-06-1977 I I I MINUTES OF CITY COMMISSION MEETING OF THE CITY OF OCOEE HELD 6 SEPTEMBER 77 Mayor Breeze called the meeting to order at 7:30 P.t1. and the meeting was opened with prayer from Reverend Pinson, followed by the Pledge of Alle- giance to the Flag. Present were Comm. Lyle, Crawford and Whitehead; City Manager, Vignetti; City Attorney, Rhodes; and City Clerk, Gann. Comm. Stinnett was absent. 16 AUGUST 77 COMMISSION MEETING MINUTES Minutes of the 16 August Commission Meeting were read. Corom. Crawford moved to accept as read, seconded Comm. Whitehead. Unanimous. 22 AUGUST 77 SPECIAL COMMISSION MEETING MINUTES Minutes of Special Commission Meeting held 22 August were read and accepted with the following correction, page one, paragraph 'three; "Corom.Crawford suggested using the funds as far as they would go to construct sidewalks in the area north of Silver Star Road". 23 AUGUST 77 ZONING BOARD MEETING MINUTES Minutes of the Zoning Board meeting held 23 August were read into the record for information purposes only. ANNEXATION ORDINANCE-2ND & FINAL READING-PUBLIC HEARING-1ST REALITY ADVISORS Corom.Crawford moved that City Manager read title only of Annexation Ordinanc~ seconded Comm.Whitehead. Unanimous. City Manager read title only of said ordinance. No one wished to speak for or against the Annexation Ordinance. Comm. Crawford moved to adopt said ordinance, seconded Corom.Whitehead. Unanimous. Annexation Ordinance adopted. ZONING ORDINANCE-2ND & FINAL READING-PUBLIC HEARING-1ST REALITY ADVISORS Comm.Crawford that title only of Zoning Ordinance be read, seconded Comm. Whitehead. Unanimous. City Manager read title only of said Zoning Ordinance. No one wished to speak for or against said ordinance. Comm.Crawford moved to adopt said Zoning Ordinance with C-3 zoning, seconded .Comm. Whitehead. Unanimous. Zoning Ordinance adopted. Mr. Nix representing owner read letter from said owner (1st Reality Advisors) stating he agreed to pay for the construction of a six inch water line at an approximate cost of $2,000.00. ORDINANCE-ZONING CHANGE-1ST READING-CURRY PROPERTY ON FRANKLIN ST.-R1 TO Cl Corom. Crawford moved that title only of Zoning Ordinance be read, seconded Comm. Whitehead. Unanimous. City Manager read title only of Zoning change Ordinance. 2nd and final reading and Public Hearing will be held on 20 Sept. TELEPROMPTER Jay Doub and Torn Alexander came before council on behalf of Teleprompter requesting that the City delete the requirement in the franchise giving the city the power to set Teleprompters rates. Comm. Crawford questioned Mr. Doub and Mr. Alexander about the refund of $2,300. in legal fees the city spent recently in court action brought against the City by Teleprompter. (2) I Mr. Alexander agreed that Teleprompter would reimburse the City the $2,300.00. Comm. Crawford moved to accept the $2,300. and to delete the requirement from the franchise that the City would set the rates for Teleprompter and to delete the requirement that Teleprompter would maintain records and have an office in the City of Ocoee, :seconded Comm. Whitehead. Unanimous. _. SAM OLIVERS' ANNUITY CONTRACT It is the unanimous feeling of Council and the City Manager that any monies received from the annuity contract belongs to Mrs. Oliver. The City Attorney stated the ownership of the Annuity Contract was not clearly defined in the contract or in the minutes that were written when the plan was purchased, therefore he was recommending that a court of law decide the ownership of said Annuity Contract. The City Attorney further stated he would not charge the city for any time he spent having the ownership clarified in court. City Attorney was directed to take the necessary steps to have the ownership clarified. Mayor Breeze left the meeting and Comm. Lyle presided as Vice-Mayor for the remainder of the meeting. ADOPTION OF FY 77/78 BUDGET City Manager explained that the proposed FY 77/78 Budget had not been changed since the last briefing. Comm. Crawford moved to adopt the FY 77/78 Budget, seconded Comm. Whitehead. Unanimous. I NOISE COMPLAINT Velma Bronson of Kissimmee Ave. came before council asking if the City could do something about re-routing the Florida Rock and Tank Line .trucks down Bluford Avenue instead of Geneva from 3:30 a.m. until mid-morning. Several residents from this area were present and they all complained about the noise from Florida Rock during the early morning hours. Comm. Crawford and City Manager will look into this matter. CITY MANAGER, MAYOR/COMMISSION REPORTS AND INFORMATION City Manager requested that council take action to write off uncollected Tangible Property Taxes for FY 73-74-75 in the amount of $1,830.54 and other accounts receivable in the amount of $250.00. Comm. Crawford moved to write off the $1,830.54 in Tangible Property Taxes and other accounts receivables in the amount of $250.00, seconded Comm.Whitehead. Unanimous. City Manager stated that J.L.Slemons Paving had requested a draw of $5,000. Comm. Crawford moved to pay Slemons Paving $5,000 from Street Dept.acct#7049, seconded Comm. Whitehead. Unanimous. City Manager stated the caution light on Kissimmee Avenue at Story Road was now in operation. LAKE BUTLER FIRE CONTRACT I City Manager stated Mrs. Mc Cullough of the Lake Butler Fire District had informed him that 23 persons in the Wausean Bay area had decided to contract fire services from the OrlaVista Fire Department. City Manager explained that the Wausean Bay area was an easily defined area and Mrs.McCullough had requested that the remaining persons in the Lake Butler Fire area be I I I (3) LAKE BUTLER FIRE CONTRACT CONTINUED allowed to re-new their fire contract with the City of Ocoee. Council directed the City Manager to have the Fire Chief look into this matter and make recommendation to council. Council further stated that persons in the Lake Butler Fire Area should be informed that once their fire contract with the City of Ocoee was broken coverage from the City of Ocoee could not be obtained again. CORRECTIONS Any needed corrections to these minutes will be reflected in the Minutes of the City Commission Meeting to be held on 20 September 77. ADJOURNMENT Meeting adjourned at 9:10 P.M.
