AN ORDINANCE OF THE CITY OF OCOEE. FLORIDA. REGU-
LATING THE LOCATION. DESIGN AND OPERATION OF JUNK-
YARDS WITHIN THE CITY AND PROVIDING PENALTIES FOR
THE VIOLATION THEREOF
BE IT ENACTED BY THE PEOPLE OF THE CITY OF OCOEE, FLORIDA:
Section 1. No junkyard shall be operated or maintained within one hundred
fifty (150) feet of any public highway or street within the municipal boundaries of

the City of Ocoee. Florida. unless the view from such public highway or street
is obscured by natural objects. plantings or fences. as herein defiried. on the
property line of such junkyard.
Section 2. A fence constructed under the provisions of this act shall be
kept in good order and repair and any advertisements thereon shall be regulated
by the zoning ordinances of the City of Ocoee. Florida.
Section 3. Definitions:
(1) "Junk" shall mean old or scrap copper. brass. rope. rags.
batteries. paper. lumber. trash. rubber. debris. oddments.
wastements. litter. leavings. ruins. castoffs. rummage.
waste. or junked. dismantled or wrecked automobiles. or
parts thereof. iron. steel and other old or scrap ferrous or
non-ferrous material.
(2) "Junkyard" shall mean an establishment or place of business
which is maintained or operated for the use of storing. keep-
ing. buying or selling such junk. or for the maintenance or
operation of an automobile graveyard and smll be construed
to include garbage dump and sanitary fills. The term shall
not be construed to mean an establishment having facilities

for processing iron. steel or non-ferrous scrap and whose
principal produce is processed or remelted scrap iron.
steel or non-ferrous scrap for sale.
(3) "Automobile graveyard" shall mean an establishment or
place of business which is maintained or operated for the use
of storing. keeping. buying or selling wrecked. scrapped.
ruined. or dismantled motor vehicle or motor vehicle parts.

(4) "Fence" shall mean an enclosure at least six (6) feet in
height so constructed or planted and maintained as to ob-
scure the junk in said enclosure from ordinary view to
those persons passing upon the streets and highways in
the City of Ocoee. Florida.
Section 4: A junkyard operated or maintained in violation of the provisions
. of this Ordinance is hereby declared to be a public nuisance. Any person who
shall own. operate or maintain a junkyard in violation of the provisions of this

Ordinance shall be punished. upon conviction therefor. by a fine not exceeding
Five Hundred ($500. 00) Dollars or by imprisonment for a period not exceeding
sixty (60) days. or by both fine and imprisonment; provided. however. said
penalties of fine or imprisonment shall not be imposed unless such person shall
have first been notified inwriting that such person is violating any provisions
of this Ordinance and such person has failed to comply with this Ordinance within
thirty (30) days from the receipt of said written notice.
Section 5: Should any portion of this Ordinance be held invalid. then such
portions as are not declared to be invalid shall remain in full force and effect.
Section 6: This Ordinance shall become effective immediately upon its
becoming a law.
