AN ORDINANCE OF THE CITY OF OCOEE REGULATING THE DATE OF HOLDING
REGULAR CITY ELECTIONS AND DEFINING THE DATE OF QUALIFICATION OF
CANDIDATES FOR ELECTION TO OFFICE IN THE CITY GOVERNMENT AND THE
ASSESSMENT OF A QUALIFYING FEE TO HELP DEFRAY THE EXPENSES OF THE
CITY ELECTION.
BE IT ORDAINED BY THE CITY COUNCEL OF THE CITY OF OCOEE:
Section 1. An election shall be held on the first Tuesday in November. 1959. and on
the 1st Tuesday in November of each year thereafter. at which time shall be elected.
as their terms of office may expire. a Mayor and City Council. who. shall hold
office until their successors are duly qualified and elected.
Section 2. All candidates for election to office in the City Government of the City of
Ocoee shall on or before thirty (30) days prior to the date of election in which they
expect to be a candidate file written notice with the City Clerk stating their intention
of seeking office and specifying the office. Should the last day upon which said
registration be made fall on Sunday or other day upon which the Clerk's office is not
open for business. then said person must register on the last regular business day
more than thirty (30) days prior to the date of said election.
Section 3. That before registering any candidate for election to office in the City
Government. the City Clerk shall charge and receive a fee from said person. to help
defray the expenses of the City election as follows:
(a) If said person is a Candidate for Mayor the fee shall be One Hundred
($100.00) Dollars.
(b) If said person is a Candidate for Councilman the fee shall be Fifty
($50.00) Dollars.
(c) If said person is a Candidate for any other office the fee shall be
Fifteen ($15.00) Dollars.
Section 4. All fees hereinabove provided shall be placed in a special fund to help
defray the expenses of holding the election at which the persons paying said fee are
candidates and should any surplus in said special fund arise. then the same shall be
transferred to the General Fund. upon a motion duly made and carried by the City
Council.
Section 5. The City Clerk is hereby authorized to pay from the aforesaid special
fund the costs and expenses of holding the election in so far as the funds in said
fund are sufficient.
Section 6. The City Clerk shall have the name of each person who has complied with
the foregoing provisions placed upon the ballot of the election for which said regis-
tration was made.
Section 7. All Ordinance and parts of Ordinances in conflict herewith are hereby
repealed.
Section 8. This Ordinance shall become effective immediately upon its becoming
a law.
. Section 9. Should any portion of this Ordinance be held invalid. then such portions
as are not declared to be invalid shall remain in full force and effect.
