AN ORDINANCE OF THE CITY OF OCOEE, FLORID A, DECLARING IT UNLAWFUL
FOR ANY PERSON, FIRM OR CORPORATION TO CAUSE OR PERMIT NATURAL GAS
TO BE TRANSMITTED TIffiOUGH A SYSTE~1 IN THE CITY OF OCOEE, FLORIDA,
WITHOUT FIRST HAVING OBTAINED AND SECURED A PERl\lIT FROM THE CITY OF '
OCOEE, FLORIDA, AUTHORIZING THE SAME; PROVIDING A PENALTY FOR THE
VIOLATION THEREOF.
WHEREAS, the City of Ocoee, Florida, has found and determined
that natural gas is a highly inflammable combustible substance and
is likely to create a fire hazard; and
WHEREAS, fire hazards endanger the health, comfort, safety and
welfare of persons and property; and
WHEREAS, the City of Ocoee in order to regulate, control, restrain
or prevent highly infammable combustible substance with in the City of
Ocoee; and
WHEREAS, to provide for the preservation of the health, comfort,
safety and welfare of persons and property within the City of Ocoee,
now therefore,
BE IT ORDAINED BY Tfffi CITY COUNCIL OF THE CITY OF OCOEE:
Section I. It shall be unlawful for any person, firm or corporation
to cause or permit natural gas to be transmitted through a system in
the City of Ocoee, Florida, without first having secured or obtained
a permit from the City Council authorizing the same.
Section 2. The term "system" shall mean and include a gas transmission
system and/or gas distribution system, or anyone or more thereof.
Section 3. The term "gas transmission system" shall mean and include
a supply of natural gas, whether acquired from wells or deposits or
from a pipe line or other source of supply and a pipe line or lines,
plant and system for the acquisition and the transporation, trans-
mission and delivery of natural gas, together with all property 8nd
all appurtenances thereto, real, personal or mixed, used or useful in
connection therewith, including franchises, rights-of-way and easements.
A gas transmission system may include facilities for making deliveries
of natural gas to residential, industrial and commercial users as well
as to gas distribution systems.
Section 4. The term lIgas distribution system" shall mean and include
a plant and system for the distribution and sale of natural gas to
residential, commercial, industrial, institutional and other users,
together wi th all apPUl"tenances thereto and all property, real, personal
or mixed used or useful in connection therewith, including franchises,
rights-of-way and easements.
Section 5. The term "fire hazardll is defined to include any combustible,
explosive or inflammable substance that will create fire.
Section 6. Any person, firm or corporation violating any provision
of this Ordinance shall, upon conviction thereof, be punished by a fine
not exceeding Five Hund~ed Dollars ($500.00) and/or imprisonment not
exceeding Sixty Days (6Q), and each day such violation shall continue
to exist shall constitute a separate offense.
Section 7. This Ordinance shall become effective i~medEtely upon its
pas sage and approval by the ~1ayor, or upon its otherwise becoming a law.
